Religious Marriages
If you are making plans to be married in a ceremony solemnised by an authorised religious celebrant or an approved individual, you must contact the Registrar in the district where the marriage is to take place. Documents to be married in Scotland can be submitted within 3 calendar months of the date of the ceremony. Legally all documents must be received no less than 28 clear days prior to the ceremony.
This process is called "Submitting Notice". You may find others referring to "Posting the Banns". This involved a couples names being called in a place of worship for three consective Sundays however this is no longer a legal requirement in Scotland
The bride and groom are required to complete Marriage Notice Forms (M10's) and a witness form (see under Documents on this page) which must be returned to the Registrar along with both Birth Certificates, passports for both if born after 1st January 1983 and proof of residency (document with name and address shown). The passports must be currently valid. If not, the birth certificate of the parties mother will be required. This is to confirm your Nationality and is a legal requirement for the Immigration Authorities.
If either has been married or in a registered Civil Partnership previously, a decree of divorce or dissolution or annulment must be produced. If either’s former spouse or civil partner is deceased, the death certificate must be produced. The appropriate fee will be required to be paid at the time of submitting the documents.
The Registrar will process the Marriage Notices and produce a Marriage Schedule which must be collected by either the bride or groom within 7 days prior to the date of marriage. The Schedule is signed by fountain pen containing permanent black ink by the bride and groom, two witnesses and the religious celebrant and must be returned to the issuing Registrar within three days of the marriage, in order that the marriage can be registered.
