The following paragraphs are submitted for information
only. having been dealt with under the
powers delegated to the Committee.

PLANNING APPLICATIONS 736
SUBMITTED: Reports by the Director of
Planning on the following applications which were submitted, together with
letters of objection and support where submitted, and dealt with as follows:
(a) Erection of Breeding Kennels and Dwellinghouse:
Former Overwood Farm. By
Kilmacolm (IC/97/1 13)
DECIDED: That planning permission be
refused for the following reasons:
(1) As the proposals are
contrary to Policy GB 1 of the Strathclyde Structure Plan which states: “The spread of built up areas
and the encroachment of development into the Countryside within a Greenbelt
around the Conurbation and Ayr/Prestwick/Troon, as indicated in the Key
Diagram, shall not accord with the Regional Development Strategy”;
(2) As the proposals fail to
address the criteria of specific locational need, economic benefit and
environmental impact, as specified in GB1A of the Structure Plan and as such
cannot be justified as an acceptable departure from Policy GBl of the Structure
Plan;
(3) As the proposals are
contrary to Policy ENa of the Inverclyde Local Plan which states:
“Development within the
Greenbelt will be opposed unless it is necessary to meet rural needs,
agriculture, recreation, forestry or landscape improvement”;
(4) As the proposals are
contrary to Policy Hb of the Inverclyde Local Plan which states:
“Residential development
within the Greenbelt as defined on the Proposals Maps, will be opposed unless
the development is shown to be in accordance with Policy ENa”;
(5)
As the
proposal is contrary to PAN 36 Circular 24/1985
by virtue of the proposed dwellinghouse being an isolated development in
the open countryside; and
(6) As the application site is
a site of potential archaeological evidence from the 18th century and earlier,
and given that its development would be unlikely to facilitate the preservation
of remains in situ, the proposal is contrary to the terms of PAN 42
(Archaeology) and NPPG 5 (Archaeology
and Planning).

(b) Landfill to Provide Improved Agricultural
Land: Harelaw. Devol Moor. Port Glasgow (IC/96/75’)
DECIDED: That, subject to the
applicants lodging with the Council a Bond to cover the cost of reinstatement
of any given phase of the development, planning permission be granted subject
to the following conditions:
(1) That the infilling operations hereby permitted shall be discontinued
at the expiration of a period of 9 years from the commencement of development,
which shall be notified in writing to the Director of Planning prior to the
commencement of work on site, to ensure the effective management of site works;
(2) That repairs and improvements to the access abutting the B788
shall be carried out to the satisfaction of the Director of Planning in
consultation with, and to the specification of, the Director of Transportation
and Roads prior to the commencement of the infilling operations, in the
interests of road safety;
(3) That Phase 4 of Harelaw I
shall be top soiled and seeded within 8 months of commencement of infill in
Harelaw 2, to the satisfaction of the Director of Planning unless written
agreement is given to an extension of this time period;
(4)That the site hut shall be
painted prior to the commencement of works in a colour to be agreed in writing
with the Director of Planning, conditions (3) and (4) being imposed in the
interests of visual amenity;
(5)That details of the precise
siting of top soils within each phase of operation shall be submitted to the
Director of Planning prior to the commencement of infill;
(6)That the boundaries of each
phase shall be marked on site prior to the commencement of infill, conditions (5) and (6) being imposed to ensure the
effective management of site works; (7) That the planting in the woodland
planting belt along the site boundary with the golf course as detailed on Plan
No L03, hereby approved, shall be carried out between September and December
1997 and any planting which dies, is removed or becomes damaged or diseased
shall be replaced to the satisfaction of the Director of Planning, in the
interests of the amenity of the adjacent golf course;
(8)That the existing wheel
cleaning facilities shall be retained and fully operational at all times during
working hours. All vehicles exiting the site will be required to use the
cleaning facilities, in the interests of road safety;
(9)That the hours of operation
shall be restricted to 07:30 -
18:00 Mondays to
Fridays and 07:30 - 13:00 on Saturdays, in the
interests of the amenity of the adjacent golf course; (10) No vehicles shall
operate under the line of existing overhead power lines, in the interests of
road safety;
(11)That the materials to be
deposited shall be restricted to solid, inert and non-toxic materials to the
satisfaction of the Director of Planning, to ensure the effective management of
site works;
(12) That the haul road between the wheel washing facility and the
area of operation shall not, at any point, exceed 7 metres in width;
(13)That on achieving the
levels detailed on Plan No OlB hereby approved, in a particular phase, top
soiling and seeding shall be completed within that phase within 12 months, to
the satisfaction of the Director of Planning; and
(14) That all top soiling and seeding be completed within one year of
completion of infilling operations, conditions (12), (13) and (14) being
imposed in the interests of visual amenity.

(e) Extension to Form Loading Bay and Change of Use
of Roadway to Industrial Use:

DECIDED:
(a) That planning permission
be granted subject to the condition that prior to the commencement of the
development, the Road Closure Order under Section 207 of the Town and Country
Planning (Scotland) Act 1997 shall have been confirmed, in the interests of
road safety as the road closure is required to enable the safe use of the
proposed loading bay; and
(b) That authority be given to
the Director of Legal Services to instigate the Road Closure Order relative to
that part of Pottery Street incorporated within the proposed development.
(f) Change of Use from Office to Licensed Restaurant:

DECIDED: That planning permission be
granted subject to the following conditions:
(1) That no development shall
commence until full details of the mechanical extract ventilation systems have
been submitted to and approved by the Director of Planning in writing; and
(2) That the details approved
in condition 1 shall be implemented prior to the commencement of the use on
site, conditions (1) and (2) being imposed in the interests of residential
amenity.
(g) Erection of Fence to Rear of Dwellinghouse (in

DECIDED: That planning permission be
granted.
(h) Erection of
Enclosed Electricity Sub-Station:

The report recommended that
planning permission be granted subject to a number of conditions.
Councillor Rebecchi was
present and with consent as Ward Councillor spoke on the matter. After
discussion, Councillor Morrison moved that planning permission be granted
subject to the conditions detailed in the report. As an amendment Councillor
Mitchell moved that

736 planning permission be refused as the proposals would be
detrimental to the amenity of the 736 residents of the adjacent area as a
result of (a) potential adverse effects on health by virtue of electro magnetic
radiation and (b) the scale of the proposed building in the development.
On a vote, I Member voted for
the amendment and 7 for the motion which was declared carried.
DECIDED: That planning permission be
granted subject to the following conditions:
(1)That the landscaping
proposals hereby approved shall be completed to the satisfaction of the
Director of Planning within a period of 8 months from the completion of the
building works, in the interests of residential amenity;
(2)That measures for cleaning
the wheels of construction traffic exiting the site shall be agreed in writing
with the Director of Planning prior to the commencement of development.
Throughout the construction period, every construction vehicle exiting the site
shall have its wheels cleaned, in accordance with the agreed measures to avoid
material being deposited onto the public road, to the satisfaction of the
Director of Planning;
(3) That the first 20 metres of the access road shall be made
up to a standard acceptable to the Director of Planning in consultation with
the Roads Authority, prior to any other works being carried out on site;
(4)That a construction
management plan, which shall provide for construction traffic movements to and
from the site during peak pedestrian and other traffic flows along Inverkip
Road to be minimised, shall be submitted to the Director of Planning and
approved in writing prior to the commencement of development and thereafter be
in force throughout the construction period;
(5)That all surface water run-off
shall be intercepted within the site, conditions (2) - (5) being imposed in the interests
of road safety;
(6)That no works associated
with the construction of the sub-station shall take place on site outwith the
hours of 8 am to 8 pm;
(7)That during construction,
noise emissions from the site shall not exceed lOdBa above background noise
levels, to the satisfaction of the Director of Planning in consultation with
the Chief Environmental Services Officer;
(8)That noise levels from the
transformer house, control room and any other permanently installed plant, will
not exceed 62dBLAr 5 minutes between
2300 - 0700 hours at the site
boundary fence, conditions (6), (7) and (8) being imposed in the interests of
residential amenity; and
(9)That notwithstanding the
details shown on plan No 00109248 Rev E hereby approved, a visibility splay of
4.5 metres by 70 metres shall be provided at the entrance to the site, the
proposed stob and wire fencing at the site entrance shall not be erected beyond
the visibility splay lines and access at the junction with Inverkip Road will
be via a footpath crossover, in the interests of road safety.
(i) Change of Use of Treatment Works to
Workshop and Storage Facility (in retrospect:
Larkfield Water Treatment
Station. Weymouth Crescent. Gourock (IC/97/108)
DECIDED:That planning permission be
granted subject to the following conditions:
(1)That the premises shall not
open for use outwith the hours 9 am to 10 pm;
(2)That the premises shall not
be used for the purpose of model railway exhibitions, conditions (1) and (2)
being imposed in the interests of residential amenity; and
(3)That the car park as approved shall be
implemented within 3 months of the date of this consent, in the interests of
road safety.

DECIDED: That planning permission be
granted subject to the condition that any noise originating from the driving
range building shall not exceed 1 OdBa above ambient background noise levels in
the nearest residential dwellinghouse with windows part open for ventilation,
in the interests of residential amenity.

THE SECRETARY OF STATE’S PROPOSED
MODIFICATIONS
SUBMITTED: Report dated 6 June 1997 by
the Director of Planning detailing and commenting on proposed modifications to
the Strathclyde Structure Plan 1995 published by the Secretary of State,
together with copy of the response by the Glasgow and Clyde Valley Joint
Structure Plan Committee agreed at its meeting on 3 June 1997, and recommending
a number of objections to and representations on the proposed modifications.
DECIDED: That it be remitted to the
Director of Planning to make objections and representations to the Secretary of
State’s proposed modifications to the Strathclyde Structure Plan 1995 as
detailed in Annexes 1 and 2 of the report.
