information only, having been dealt with under the powers delegated to the

PLANNING APPLICATION SUBMITTED FOR CONTINUED
CONSIDERATION |

|
|
|
|
There
was submitted a report by the Head of Planning and Transportation on an
application by Mr J Nelis for the erection of rear entrance porch/canopy in
retrospect at the Tontine Hotel, 6 Ardgowan Square, Greenock (IC/07/189 &
LB/07/013), consideration of which had been continued from the meeting held
on 1 August 2007 following a request by the applicant for more time to
discuss the matter with Historic Scotland. |
|
|
The
report recommended that planning permission and listed building consent be
refused for a number of reasons. |
|
|
The
Head of Planning, Housing and Transportation advised the Board that following
the issue of the report revised plans had been submitted by the applicant. |
|
|
Decided: that the
application be continued to allow further consideration of the revised plans
and subject to these being satisfactory to the Head of Planning, Housing and
Transportation in consultation with Historic Scotland and subject to no
objections/representations being received, authority be delegated to him to deal with
the applications. |
|

There
were submitted reports by the Head of Planning and Transportation on the following
applications, together with letters of objection and support where submitted,
which were dealt with as follows:- |
|
|
|
|
(a) |
Extension to dwellinghouse: |
|
|
|
|
|
|
|
|
Decided: that planning permission be refused as the proposed extension by
virtue of its location and size would result in the extended dwelling
severely reducing the open aspects of the streetscape and dominating the
streetscape when viewed from the junction with Greenock Road and, as such,
the proposal is not in accordance with the guidance contained within Policy
H15 of the Inverclyde Local Plan. |

(b) |
Proposed intensification of use of rear yard as a
beer garden: |
|
|
|
|
|
|
|

Decided:
that planning permission be
refused as the provision of a covered deck area to facilitate the use of the
yard as a beer garden would have a
detrimental effect upon the quality of residential amenity for neighbouring
properties and as such is contrary to Policy R10 (g) of the Inverclyde Local
Plan. |

(c) |
Proposed erection of a garden shed (in retrospect): |
|
|
|
|
|
|
|
|
Decided: that planning permission be refused as the shed is harmful to the
streetscape of Weymouth Crescent and Plymouth Avenue, has an unacceptable
impact on the appearance of the dwellinghouse to which it is attached and
fails to safeguard the character and amenity of the residential area; as such
the development is contrary to the advice in the Council’s PPAN No 7 “House
Extensions” and Policies H1 and H15 of the Inverclyde Local Plan. The failure
of the development to accord with Policy H15 and PPAN 7 produces a
development contrary to Policy H1. |

|
(d) |
Change of use of storage unit to family leisure centre: |
|
|

Decided: that planning permission be granted. |
|
|
|
|
(e) |
Erection of builder’s store: |
|
|
Lock-up Garage/Workshop Site, |
|
|
|
|
|
Decided: that planning permission be granted subject
to the following conditions:- |
|
|
(1) that the development to which this
permission relates must be begun within five years of the date of this
permission, to comply with Section 58 of the Town and Country Planning ( |
|
|
(2) that the presence of any made ground
or waste deposits that become evident during ground preparation works shall
be brought to the attention of the Head of Planning and Transportation within
one week of their discovery; |
|
|
(3) that any necessary treatment of
ground or waste deposits referred to in condition (2) above shall be the
subject of a remediation plan to be agreed with the Head of Planning and
Transportation and shall be implemented in full prior to the development
hereby permitted being brought into use, conditions (2) and (3) being imposed
to ensure that all contamination issues are recorded; and |
|
|
(4) that
notwithstanding the provisions of the Town and Country Planning (Use Classes)
(Scotland) Order 1997, an application for planning permission will be
required for a change of use from the Class 6 use hereby permitted to Class
4, to enable the planning authority to retain control over changes of use
otherwise permitted to help ensure the protection of residential amenity. |

(f) |
Installation of replacement windows (in retrospect): |
|
|
|
|
|
|
|
|
The
report recommended that planning permission be refused as the style and
design of the replacement windows unacceptably alter the appearance of the
building to the detriment of its architectural integrity and the character of
the Greenock West End Conservation Area and, as such, the proposal is
contrary to policies HR11 and HR12 of the Inverclyde Local Plan, the
Council’s Planning Practice Advice Note 11 on Replacement Windows and the
advice and guidance contained within Historic Scotland’s Memorandum of Guidance
on Listed Buildings and Conservation Areas. |

After
discussion, Councillor McCallum moved that consideration of the application
be continued for a site visit to be arranged by the Head of Legal and
Administration in consultation with the Convener. As an amendment, Councillor Fyfe moved that
planning permission be refused for the reason detailed in the report. On a vote, 4 Members voted for the motion
and 5 for the amendment which was declared carried. |

Decided: that planning permission be refused as the style and design of the
replacement windows unacceptably alter the appearance of the building to the

Decided: (a) that
planning permission be refused as the proposed alterations to the appearance
of the building would create an undue dominance, be detrimental to the
appearance of the building and contrary to the established building style as
established in the Masterplan Agreement and Design Guide for Greenock Waterfront
and, as such, the development does not accord with Policy R10 (f) of the
Inverclyde Local Plan; and |
|
|
(b) that advertisement
consent be refused for the following reasons:- |
|
|
(1) as
the proposal would, by virtue of the combination of scale, colour and
illumination, have a detrimental
impact on the current visual amenity of the building, contrary to the
context of Policy R10 (f) of the Inverclyde Local Plan and PPAN 13; and |
|
|
(2) as
the proposal would, by virtue of the combination of scale, colour and
illumination have a detrimental impact on the visual amenity at the |
|
|
|
|
(h) |
Proposed storage shed: |
|
|
Unit 3, |
|
|
|
|
|
Decided: that planning permission be granted subject
to the following conditions:- |
|
|
(1) that the development to which this permission
relates must be begun within 5 years
from the date of this permission, to comply with Section 58 of the Town & Country Planning ( |
|
|
(2) that no development shall commence until the
existing CCTV camera covering the application site and the adjoining property
has been resited; details of same being submitted for the prior written
approval of the Head of Planning & Transportation, to maintain CCTV coverage; |
|
|
(3) that no development shall commence until a
sample of the proposed profiled sheeting has been submitted to and approved
in writing by the Head of Planning & Transportation: development
thereafter shall proceed utilizing the approved sheeting unless the Head of
Planning & Transportation gives his prior written approval to any
alternative, to ensure a
continuity of building materials within Port Glasgow Industrial Estate; |
|
|
(4) that no development shall commence until a ground
condition report has been submitted to and approved in writing by the Head of
Planning & Transportation in consultation with the Head of Safer
Communities; |
|
|
(5) that where the risk assessment within the ground
condition report required by condition (3) identifies any unacceptable risk/s
no development shall commence until a detailed remediation strategy has been
submitted to and approved in writing by the Head of Planning &
Transportation in consultation with the Head of Safer Communities; |
|
|
(6) that remediation shall be carried out in accordance
with the approved remediation strategy and any amendments to it shall not be
implemented without the prior written approval of the Head of Planning &
Transportation in consultation with the Head of Safer Communities; |
|
|
(7) that the site shall not be occupied until the
completion of any required remediation works and a verification/completion
report has been submitted to and approved in writing by the Head of Planning
& Transportation in consultation with the Head of Safer Communities; and |
|
|
(8) that the presence of any previously unrecorded
contamination or variation to the reported ground conditions that become
evident during the site works shall be brought to the attention of the Head
of Planning & Transportation within 7 days. Any amendments to the
approved remediation strategy shall not be implemented until it has been
submitted to and approved in writing by the Head of Planning &
Transportation in consultation with the Head of Safer Communities, conditions
(4) to (8) being imposed to
prevent harm from pollution. |

|
There
was submitted a report by the Head of Planning and Transportation advising
that following the decision of the Board at the meeting held on 5 September
2007 to refuse planning permission for alterations and
extension to the dwellinghouse at 77 Oxford Avenue, Gourock (IC/07/125R), an appeal against the refusal of planning permission had been made to
the Scottish Ministers. |

|
There
was submitted a report by the Head of Planning and Transportation advising
that following the decision of the Board at the meeting held on 20 June 2007
to refuse planning permission for the construction of a teaching block and assembly building at St
Columba’s School, Gryffe Road, Kilmacolm (IC/06/391R), an appeal against the refusal of planning
permission had been made to the Scottish Ministers. |

There was
submitted a report by the Head of Planning and Transportation advising that
following the decision of the Planning and Traffic Management Committee at
the meeting held on 4 April 2007 to refuse planning permission for the change of
use of open space to garden ground and erection of a garage at 3 Mossyde Avenue,
Port Glasgow (IC/06/374R) and the subsequent appeal by the
applicant to the Scottish Government against that refusal, the Reporter
appointed by the Scottish Government had issued his decision which was to dismiss
the appeal relating to the erection of a garage and to uphold the appeal for
change of use of open space to garden ground and grant planning permission
for this element. |

|
There
was submitted a report by the Head of Planning and Transportation advising
that following the decision of the Planning and Traffic Management Committee
at the meeting held on 10 January 2007 to refuse planning permission for the installation of replacement
windows in retrospect on the front elevation of a top floor flat at 46
Brisbane Street, Greenock (IC/06/389) and the subsequent appeal by the applicant to the Scottish Government,
the Reporter appointed by the Scottish Government had issued his decision
which was to dismiss the appeal. |
