PLANNING APPLICATIONS SUBMITTED FOR CONTINUED CONSIDERATION

(a)

Erection of a Dwellinghouse (in outline):

 

 

Glenneuk, Clune Brae, Port Glasgow (IC/06/300R)

 

 

 

 

 

There was submitted a report by the Head of Planning & Transportation regarding an application by Mrs M A Melville for the erection of a dwellinghouse (in outline) at Glenneuk, Clune Brae, Port Glasgow (IC/06/300R), consideration of which had been continued from the meeting held on 1 August 2007 for a site visit.

 

 

(Councillor Brooks entered the meeting during consideration of this item of business).

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)          this permission is granted under the provisions of the Town & Country Planning (General Permitted Development Procedure) (Scotland) Order 1992 on an outline application and the further approval of the Council or the Scottish Ministers on appeal shall be required with respect to the under mentioned matters hereby reserved before any development is commenced:-

 

 

(i)           the siting, design and external appearance of any building to which the planning permission or the application relates;

 

 

(ii)          details of the access arrangements;

 

 

(iii)          details of landscaping of the site;

 

 

(2)          that in the case of the reserved matters as specified above, application for approval must be made before:-

 

 

(i)           the expiration of 3 years from the date of grant of outline permission; or

 

 

(ii)          the expiration of 6 months from the date on which an earlier application for such approval was refused;  or

 

 

(iii)          the expiration of 6 months from the date on which an appeal against such refusal was dismissed whichever is the latest: and provided only one such application may be made in the case after the expiration of the three year period mentioned in sub-paragraph (i) above;

 

 

(3)          that the development to which this permission relates must be begun not later than the expiration of 5 years from the date of this permission or within two years from the final approval of reserved matters, whichever is the later, conditions (1), (2) and (3) being imposed to comply with Section 59 of the Town & Country Planning (Scotland) Act 1997;

(4)          that road marking, at the junction with Clune Brae, is provided to the satisfaction of the Head of Planning & Transportation in consultation with the Head of Environmental Services, to ensure safe access and egress to and from Clune Brae;

(5)          that no development shall commence until measures to dispose of any Japanese Knotweed on the site have been submitted to and approved in writing by the Head of Planning & Transportation to prevent the spread of Japanese Knotweed outwith the site.

 

 

 

 

(b)

Erection of Timber Deck and Fencing (in retrospect):

 

 

71 Renton Road, Greenock (IC/07/074)

 

 

 

 

 

There was submitted a report by the Head of Planning & Transportation regarding an application in retrospect by Mr and Mrs McMonigle for the erection of timber deck and fencing at 71 Renton Road, Greenock (IC/07/074), consideration of which had been continued from the meeting held on 20 June 2007 to afford the Head of Planning & Transportation the opportunity to explore the possibility of reducing the floor area of the deck.

 

 

The report recommended that planning permission be refused as the proposed decking by virtue of its location and size would allow the opportunity to undertake a range of functions over extensive periods of day and evening to an extent that the activity may impinge upon the enjoyment of neighbouring properties to the detriment of the amenity of neighbouring residents and, as such, the proposed decking would not be in accordance with the guidance and advice contained within Policy H1 of the Inverclyde Local Plan.

 

 

After discussion, Councillor McCallum moved that planning permission be granted.  As amendment, Councillor Fyfe moved that planning permission be refused for the reason detailed in the report.  On a vote, three Members voted the amendment and five for the motion which was declared carried.

Decided:  that planning permission be granted.

 

 

 

 

(c)

Installation of 15 Metre High Replica Flagpole Telecommunications Mast Supporting 3 Antennas, Associated Equipment Housing and Ancillary Development:

 

 

Greenock Cricket Club, Brisbane Street, Greenock (IC/07/217)

 

 

 

 

 

There was submitted a report by the Head of Planning & Transportation regarding an application by T-Mobile (UK) Ltd for the installation of a 15 metre high replica flagpole telecommunications mast supporting 3 antennas, associated equipment housing and ancillary development at Greenock Cricket Club, Brisbane Street, Greenock (IC/07/217) consideration of which had been continued from the meeting held on 1 August 2007 to allow Members the opportunity to examine the impact of flagpoles on the Conservation Area.  The report recommended that planning permission be granted subject to a number of conditions.

 

 

Councillors Brooks and McKenzie declared a personal interest in this matter.

 

 

After discussion, Councillor Dorrian moved that planning permission be refused as the proposal would be contrary to Department of Health guidelines regarding the siting of telecommunications masts in the vicinity of schools as the proposal would impact on Greenock Academy.  As amendment, Councillor Fyfe moved that planning permission be granted subject to the conditions detailed in the report.  On a vote, five Members voted for the amendment and six for the motion which was declared carried.

 

 

Decided:  that planning permission be refused as the proposal would be contrary to Department of Health guidelines regarding the siting of telecommunications masts in the vicinity of schools as the proposal would impact on Greenock Academy.

 

 

 

 

(d)

Alterations and Extension to Dwellinghouse:

 

 

77 Oxford Avenue, Gourock (IC/07/125R)

 

 

 

 

 

There was submitted a report by the Head of Planning & Transportation regarding an application by Mr I Jones & Ms E Weir  for alterations and extension to the dwellinghouse at 77 Oxford Avenue, Gourock (IC/07/125R), consideration of which had been continued from the meeting held on 1 August 2007 for a site visit.

 

 

The report recommended that planning permission be granted subject to a number of conditions.

 

 

After discussion, Councillor Blair moved that planning permission be refused (1) as the proposed extension, due to it being 2 storey in height and there being a change in ground level, would have a detrimental impact on the enjoyment of the adjoining house and garden at 79 Oxford Avenue; (2) as the location and size of the proposed extension would necessitate the encroachment of car parking within the front garden, representing overdevelopment of the site and to the detriment of the appearance of the street; and (3) as the position and footprint of the proposed extension added to the existing sloping nature of the garden would result in inadequate usable garden ground. As an amendment, Councillor McKenzie moved that planning permission be granted subject to the conditions detailed in the report. On a vote, three Members voted for the amendment and eight for the motion which was declared carried.

After discussion, Councillor Fyfe moved that planning permission be granted.  As an amendment, Councillor McKenzie moved that planning permission be refused as the fencing is out of character with nearby residential properties and as a result would be detrimental to the amenity of the area.  On a vote, four Members voted for the amendment and five for the motion which was declared carried.

 

 

Decided:  that planning permission be granted.

Change of Use of Retail Shop with Basement Store to Restaurant at Basement Level and Hot Food Take Away at Ground Floor Level:

Decided: that planning permission be refused for the following reasons:-

 

 

(1)          as the proposal will have a detrimental impact on the amenity of the residential properties both above and adjacent to the premises, since the proposed changes may generate an unacceptable level of noise, activity and nuisance in close proximity to the residential properties;

 

 

(2)          as the proposal will have a detrimental impact on the amenity of the residential properties both above and adjacent to the premises due to the creation of a cooking odour nuisance; and

 

 

(3)          as the proposal is contrary to Inverclyde Local Plan Policies R3, R10 and R12, in view of the potential detrimental effect on residential amenity.

(2)          that no development shall commence until samples of all external materials have been submitted to and approved in writing by the Head of Planning & Transportation and that development thereafter shall proceed utilising the approved materials unless the Head of Planning & Transportation gives his prior written approval to any alternatives, to ensure a continuity of materials in this part of Gourock.

There was submitted a report by the Head of Planning & Transportation advising that following the decision of the Planning and Traffic Management Committee at the meeting held on 4 April 2007 to refuse planning permission for the erection of a dwellinghouse and garage at land adjacent to Knapps, Houston Road, Kilmacolm (IC/06/323), an appeal against the refusal of planning permission had been made to the Scottish Ministers.

There was submitted a report by the Head of Planning & Transportation advising that following the decision of the Planning and Traffic Management Committee at the meeting held on 10 January 2007 to refuse planning permission in retrospect for the installation of replacement windows on the front elevation of a top floor flat at 46 Brisbane Street, Greenock (IC/06/389), an appeal against the refusal of planning permission had been made to the Scottish Ministers.

There was submitted a report by the Head of Planning & Transportation on the decision of the Planning & Traffic Management Sub-Committee at the meeting held on 5 November 2003 to advise the Scottish Executive of the Council’s objection to a proposed wind farm at Devol Moor/Corlic Hill and advising that following the public inquiry held in March 2005 the Scottish Ministers had accepted the Reporter’s recommendation that consent be refused under the Electricity Act 1989 and that planning permission be deemed refused.

There was submitted a report by the Head of Planning & Transportation advising that following the decision of the Planning & Traffic Management Committee at the meeting held on 6 September 2006 to refuse planning permission for the erection of one class 1 (food) retail unit, one class 1 (non-food) retail unit and class 2 office space with associated car parking, landscaping and access at Grey Place, Patrick Street, Ker Street, Dalrymple Street and West Blackhall Street, Greenock (IC/06/116) and the subsequent appeal by the applicant to the Scottish Ministers against that refusal, the Reporter appointed by the Scottish Ministers had issued her decision which was to dismiss the appeal.

There was submitted a report by the Head of Planning & Transportation advising that following the decision of the Planning & Traffic Management Committee at the meeting held on 4 April 2007 to refuse planning permission for the installation of a telecommunications radio base station, including a 15 metre high monopole, at Main Street, Inverkip (IC/06/462) and the subsequent appeal by the applicant to the Scottish Ministers against that refusal, the Reporter appointed by the Scottish Ministers had issued his decision which was to uphold the appeal.
