PLANNING
APPLICATIONS |

|
There were submitted
reports by the Head of Planning and Transportation on the following
applications, together with letters of objection and support where submitted,
which were dealt with as follows:- |
|
|
|
|
(a) |
Installation
of Telecommunications Radio Base Station Including
Ancillary Equipment Cabinets: |
|
|
|
|
|
Decided: that the Committee agree to present submissions in the appeal against non determination of this application on the basis that planning permission would have been refused as the proposed radio communications base station, by virtue of the height and design of the monopole, is considered to be inappropriate for the Inverkip Conservation Area being visually obtrusive both from within the conservation area and beyond and, as such, it is contrary to policies UT7, HR11 and HR12 of the Inverclyde Local Plan. |

(b) |
Erection
of Gates on Link road for Emergency Vehicles (in retrospect): Levan
Farm, Gourock (IC/06/375) |
|
|
|
|
|
Decided: that, subject to the applicant entering into a Section 75 Agreement to maintain the link road free of obstruction, to put into place a maintenance inspection and repair scheme to Council specification and the emergency services being given unrestricted rights of passage, planning permission be granted. |
|

|
|
|
|

|
|
The report recommended that planning permission be refused for a number of reasons. |
|
|
Decided: that consideration of the application be continued for a site visit by the Committee following the local government elections on 3 May 2007, to be arranged by the Head of Legal and Administration in consultation with the Convener. |

(d) |
Amendment
to Planning Permission IC/02/055 Including Alterations to 2 Flats and Incorporating
a Third Flat (in retrospect): |
|
|
|
|
|
Decided: that planning permission be refused as the building has an overbearing, over dominant appearance and contains inappropriate fenestration on its northern elevation which has a significant adverse impact on visual amenity and the character and amenity of the area and is therefore contrary to policy H8 of the Inverclyde Local Plan. |
|
|
|
|
(e) |
Erection
of Rear Extension to Dwellinghouse: |
|
|
|
|
|
Decided: that
planning permission be granted subject to the following conditions:- |
|
|
1. (1) that the development to which this permission relates must be
begun within five years from the date of this permission, to comply with Section
58 of the Town and Country Planning (Scotland) Act 1997; and |
|
|
(2) that, prior to the commencement of work on site, full
details of all materials to be used on the external surfaces of the
development hereby permitted be submitted to and approved by the Head of
Planning and Transportation, the construction of the development must then
proceed using the approved materials, to ensure that the materials used in
all external finishes are acceptable in terms of the wider conservation area. |

(f) |
Erection of Timber Deck and Fencing (in retrospect): |
|
|
|
|
|
The report recommended that planning permission be refused for a
number of reasons. |
|
|
Decided:
that consideration of the application be continued to allow those
Members of the Committee not familiar with the application site to visit it
and to afford the Head of Planning and Transportation the opportunity to
discuss the application further with the applicant. |

|
|
|
(g) |
Erection
of Extension to Dwellinghouse: |
|
|
|
|
|
Decided: that planning permission be granted subject to the following conditions:- |
|
|
(1) that the development to which this permission relates must
be begun within five years from the date of this permission, to comply with
Section 58 of the Town and Country Planning (Scotland) Act 1997; and |
|

(2) that prior to the commencement of work on site, full
details of the colour of all materials to be used on the external surfaces of
the development hereby permitted be submitted to and approved by the Head of
Planning and Transportation, the construction of the development must then
proceed using the approved materials, to ensure that the materials used in
all external finishes are acceptable in terms of the colour of the walls and
roof of the existing building and wider streetscape area. |

Change of Open Space to Garden Ground and Erection of Detached Garage: |
|
|
|
|
|
Decided: that planning permission be refused for the
following reasons:- |
|
|
(1) as the garage by virtue of its location and size will be
extremely prominent
unacceptably altering the established building pattern to the detriment of the streetscape of both Mossyde Avenue and Woodside Avenue which
will result in the
proposed garage being extremely prominent to the detriment of the established
building pattern and the streetscape, contrary to policy H1 of the Inverclyde
Local Plan; and |
|
|
(2)
as the change of use to garden ground would
not be in keeping with the established pattern of development to the
detriment of the streetscape of |
|
|
|
|
(i) |
Construction of Teaching Block and St Columba’s Secondary School, Gryffe Road, Kilmacolm (IC/06/391) |
|
|
|
|
|
The report recommended that, subject to the applicants entering into a
Section 75 Agreement restricting the maximum class size in the school to 20
pupils plus a 5% increase in the existing number of staff and allowing for
the accommodation of the transitus year, planning permission be granted
subject to a number of conditions. |
|
|
Decided: that consideration of the
application be continued for a site visit by the Committee following the
local government elections on 3 May 2007, to be arranged by the Head of Legal
and Administration in consultation with the Convener. |
|

(j) |
Construction of Dwellinghouse and Detached Garage: Land Adjacent to “Knapps”, |
|
|
|
|
|
Decided: that planning permission be refused for the
following reasons:- |
|
|
(1) as the level of tree removal likely to ultimately be required to accommodate the proposed dwelling would be unsympathetic to the existing character of this part of the Conservation Area and therefore contrary to policy HR11 of the Inverclyde Local Plan; and |
|
|
(2)
as the
proposal which is likely to threaten the established characteristic of low
density development in abundant mature landscaping is contrary to Historic
Scotland’s Memorandum of Guidance on |
|
|
|
|
(k) |
Erection of Dwellinghouse and Detached
Garage (in outline): “Torwood”, |
|
|
|
|
|
Councillor Fyfe
declared a personal interest in this matter and left the meeting. |
|
|
Decided:
that planning permission be refused for the following reasons:- |
|
|
(1) as the proposed development would result in the loss of trees protected by Tree Preservation Order no. IC16 adversely affecting the character of this part of the village and contrary to policies H1 and HR1 of the Inverclyde Local Plan; and |
|
|
(2) as the proposal cannot be justified under the terms of policy H8 as it would involve the loss of existing landscape features of value on the site. |

PLANNING APPEAL – RAMADA JARVIS HOTEL, |

|
|
|
There was submitted
a report by the Head of Planning and Transportation advising that following the
decision of the Committee at the meeting held on 1 March 2006 to refuse
planning permission for the redevelopment of (1) the site of the Ramada
Jarvis Hotel and (2) the adjacent tennis courts at Cloch Road, Gourock for
residential use (IC/05/340 and IC/05/436) and the subsequent appeals by the
applicant to the Scottish Ministers against those refusals, the Reporter
appointed by the Scottish Ministers had issued his decisions which were to
grant planning permission for development of both sites and dismiss the
appeal for the appellant’s claim for the award of costs against the Council. |

a report by the Head of Planning and Transportation recommending the making
of a Footpath Closure Order for a section of the pavement at 134 Cathcart
Street, Greenock to allow the construction of a disabled access ramp. |

Decided:
that it be remitted to the Head of Legal and Administration to
commence the footpath closure procedure for a section of the pavement at |
|
|
|

PROPOSED TRAFFIC REGULATION ORDER – |

|
|
There was submitted
a report by the Corporate Director Regeneration and Resources recommending
the making of a Traffic Regulation Order to introduce a part time 20 mph
speed restriction on sections of Dunlop Street, Cornhaddock Street,
Drumfrochar Road, Broomhill Street and Murdieston Street, Greenock. |
|

Decided: that
The Inverclyde Council be recommended to make a Resolution under the Road
Traffic Regulation (Scotland) Act 1984 in relation to a Traffic Regulation
Order to introduce a part time 20 mph speed restriction on sections of Dunlop
Street, Cornhaddock Street, Drumfrochar Road, Broomhill Street and Murdieston
Street, Greenock and thereafter that it be remitted to the Head of
Environmental Services and Head of Legal and Administration to arrange for
implementation of the Order. |
