The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Committee. |

PLANNING APPLICATIONS |

|
|
|
|
There were submitted reports by the Head of Planning and Transportation on the following applications, together with letter of objection and support where submitted, which were dealt with as follows:- |
|
|
|
|
(a) |
Erection
of Rear Extension to Dwellinghouse: |
|
|
|
|
|
Decided: that planning permission be granted. |
|
|
|
|
(b) |
(1) Erection of Dwellinghouse: (2) Bridge Strengthening Works and Formation of
Access Road to
Serve Two Houses: |
|
|
|
|
|
Decided: |
|
|
(i) that planning permission be granted for the proposed bridge strengthening works, access road and turning head (IC/06/145); and |
|
|
(ii) that planning permission be granted for the proposed house (IC/06/127R) subject to the following conditions:- |
|
|
(1) that
the development to which this permission relates must be begun within 5 years
from the date of this permission, to comply with Section 58 of the Town &
Country Planning ( |
|
|
(2) that no development shall commence until samples of all external materials have been submitted to and approved in writing by the Head of Planning and Transportation and development thereafter shall proceed utilising the approved materials unless the Head of Planning and Transportation gives his prior written approval to any alternatives, to ensure a continuity of materials in this part of Greenock; and |
|
|
(3) that
the attenuation
pond hereby approved shall be formed prior to the house being occupied and
thereafter maintained in perpetuity, to prevent harm from flooding. |

Alterations
and Extension to Dwellinghouse: |

|
|
Decided: that planning permission be granted subject
to the following conditions:- |
|
|
(1) that the development to which this
permission relates must be begun within five years from the date of this
permission, to comply with Section 58 of the Town and Country Planning
(Scotland) Act 1997; and |
|
|
(2) that prior to the
occupation and use of the extension hereby permitted, the two off street car
parking spaces shown on approved drawing number 002 must be created and
available for use to the satisfaction of the Head of Planning and
Transportation, to ensure adequate car parking provision is in place for the
dwellinghouse as extended. |
|
|
|
|
(d) |
Replacement
of Wooden Sash and Case Windows with Double Glazed, Double
Swing Wooden Windows (in retrospect): |
|
|
|
|
|
Decided: |
|
|
(i) that planning application IC/06/414 be granted subject to the following conditions:- |
|
|
1. (1) that this permission shall endure solely for the benefit of the applicant, this permission is personal to the applicant to enable the Head of Planning and Transportation to retain long term control over the windows; |
|
|
(2) that windows to a sash and case specification, to be approved in writing by the Head of Planning and Transportation, shall be installed within 6 months of the cessation of occupation of the premises by the applicant, to ensure longer term preservation of the character of the building; and |
|
|
3. (3) that the applicant, or others acting on his behalf, shall advise the Head of Planning and Transportation of the date on which he ceases to occupy the application site, to ensure the enforceability of condition (2) above; and |
|
|
(ii) that listed building application LB/06/031 be referred to Historic Scotland intimating the Council’s intention to grant listed building consent, subject to the following conditions:- |
|
|
(1) that this permission shall endure solely for the benefit of the applicant, this permission is personal to the applicant to enable the Head of Planning and Transportation to retain long term control over the windows; |
|
|
(2) that windows to a sash and case specification, to be approved in writing by the Head of Planning and Transportation shall be installed within 6 months of the cessation of occupation of the premises by the applicant, to ensure longer term preservation of the character of the building; and |
|
|
(3) that the applicant, or others acting on his behalf, shall advise the Head of Planning and Transportation of the date on which he ceases to occupy the application site, to enable the enforceability of condition (2) above. |

(e) |
Erection
of One and a Half Storey Dwellinghouse Within Garden Ground (in
outline): Millhouse
Cottage, |
|
|
|
|
|
Decided: that planning permission be refused for the following reasons:- |
|
|
(1) as the proposal is a departure from policies DS8, DS10, DS11, HR1 and H4 of the Inverclyde Local Plan and Strategic Policies 1, 5, 7 and 9 of the Glasgow and the Clyde Valley Joint Structure Plan as the application site is located within the green belt and Clyde Muirshiel Regional Park and the applicant has provided no justification under these policies for supporting a departure; |
|
|
(2) as the proposal cannot be supported as a departure under Strategic Policy 10 of the Structure Plan; |
|
|
(3) as the proposal is a departure from policy H14 of the Local Plan in that it would alter the pattern of development in the vicinity; and |
|
|
(4) as the proposal is in conflict with the guidance provided by Scottish Planning Policy 21. |
|
|
|
|
(f) |
Alterations
and Extension to Dwellinghouse: |
|
|
|
|
|
The report recommended that planning permission be refused as the
proposed extension by virtue of its location and size would result in the
extended dwelling severely reducing the open aspects of the streetscape and
dominating the streetscape when viewed from the junction with Greenock Road, as
such the proposal is not in accordance with the guidance contained within
Policy H15 of the Inverclyde Local Plan. |

After discussion, Councillor Forbes moved that planning permission be refused for the reason detailed in the report. As an amendment, Councillor Hunter moved that planning permission be granted subject to appropriate conditions. On a vote, 2 Members voted for the amendment and 3 for the motion which was declared carried. |
|
|
Decided: that planning permission be
refused as the proposed extension by virtue of its location and size would

APPEAL – 65C |

|
|
|
|
There was submitted a report by the Head of Planning and Transportation advising that following the decision of the Committee at the meeting held on 5 April 2006 to refuse planning permission for installation of replacement windows at 65C Union Street, Greenock (IC/06/028) and the subsequent appeal by the applicant to the Scottish Ministers against that refusal, the Reporter appointed by the Scottish Ministers had issued his decision which was to dismiss the appeal. |
