PLANNING APPLICATIONS

There were submitted reports by the Head of Planning and Transportation on the following applications, together with letters of objection and support where submitted, which were dealt with as follows:-

 

 

(a)

Alterations to Form Roof Terrace:

2 Cloch Brae, Gourock (IC/06/441)

 

 

 

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)          that the development hereby permitted shall be commenced within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and

 

 

(2)          that prior to the commencement of work on site, details of screening to the side of the balcony be submitted to and approved by the Head of Planning and Transportation, the screen must then be erected prior to the use of the balcony and maintained in position at all times during the lifetime of the balcony, to ensure that there is no overlooking from the decking, leading to unacceptable loss of privacy to neighbouring property.

 

 

 

 

(b)

Proposed Groundworks, Erection of 2.4 metre High Palisade Fence and

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)          that the development to which this permission relates must be begun within 5 years from the date of this permission, to comply with Section 58 of the Town & Country Planning (Scotland) Act 1997;

 

 

(2)          that top soil excavated to form the level platform shall be retained on site and used to cover the embankment created by infilling operations, to ensure that the embankment revegetates with indigenous planting;

(3)          that no development shall commence until fully detailed boundary treatments have been submitted to and approved in writing by the Head of Planning & Transportation, to ensure the provision of a quality boundary treatment;

(4)          that no development shall commence until details of the infill material to be imported have been submitted to and approved in writing by the Head of Planning & Transportation in consultation with SEPA: infilling thereafter shall proceed using the approved material unless the Head of Planning & Transportation gives his prior written approval to any alternatives, to prevent harm from pollution; and

 

 

(5)          that the industrial yard space hereby approved shall not be brought into use until the approved boundary treatment has been completed, to ensure that any unsightly items in the yard are screened from view.

 

 

(c)

Removal of Condition No 4 of Planning Permission IC/06/134R:

The report recommended that planning permission be refused as the non-compliance of condition number 4 of Planning Permission IC/06/134R could result in the free use of the exits to the rear courtyard area bringing additional late night noise and activity into Robertson Street, to the disturbance and detriment of local residents.  

After discussion, Councillor Stewart moved that planning permission be granted for a period of six months from the date of installation of the exit door.   As an amendment, Councillor McKenzie moved that planning permission be refused for the reason detailed in the report.   On a vote, 1 Member voted for the amendment and 6 for the motion which was declared carried.

 

 

Decided:  that planning permission be granted for a period of six months from the date of installation of the exit door.

(i) that the application be referred to the Scottish Ministers under the terms of the Town and Country Planning (Notification of Planning Applications) (Scotland) Amendment Direction 1997, recommending that planning permission be granted; and

 

 

(ii) that authorisation be given for the Head of Legal and Administration to promote the necessary footpath diversion order.

Erection of New Community Centre Facility to include Demolition of

Former School Building, Refurbishment of Existing Village Centre Building,

Works to Car Park, Landscape and Neighbouring Roads and Demolition of

Old Primary School Building:

Councillor Fyfe declared an interest in this matter as a Member of the Board of Kilmacolm New Community Centre Ltd and left the meeting.

 

 

Decided:

 

 

(i) that the application be referred to the Scottish Ministers, under the terms of the Town and Country Planning (Notification of Planning Applications) (Scotland) Amendment Direction 1997 recommending that planning permission be granted subject to the following conditions:-

 

 

(1)          that the development hereby permitted shall be commenced within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)          that prior to the commencement of work on site, full details and samples of all materials to be used on the elevations and roofs of the buildings, including windows and doors, shall be submitted to and approved by the Head of Planning and Transportation and the development shall then proceed utilising the approved materials, to ensure the proposed materials are acceptable in the interests of the visual amenity of the streetscape;

 

 

(3)          that prior to the commencement of work on site full details of all hard and soft landscape works, including a programme for the completion and subsequent maintenance of soft landscape, shall be submitted to and approved in writing by the Head of Planning and Transportation, the landscaping work will then proceed as approved, to ensure an appropriate hard and soft landscaping scheme for the proposed development;

 

 

(4)          that prior to the commencement of works on site, full details of the process to dismantle, store and re-erect the bellcote gable in the location shown on approved drawing number 2015 – AL (0) 201 must be submitted and approved by the Head of Planning and Transportation, to ensure that the original feature of the old school building is retained and stored appropriately for reconstruction on site;

 

 

(5)          that prior to the commencement of works on site, full details of the process to dismantle, store and re-use stone from the Old Primary School Building in the areas of the new building marked ‘12’ on approved drawing names Figures 2, 3, 4 and 5 must be submitted to and approved by the Head of Planning and Transportation, to ensure that material from the demolition of the old school building is reused in the development hereby permitted, in the interests of sustainability;

(6)          that prior to the commencement of work on site, full details of the provision and location of cycle parking shall be submitted to and approved by the Head of Planning and Transportation, the cycle parking provision must be completed prior to the occupation and use of the new community centre hereby permitted, to ensure appropriate provision for cyclists;

(7)          that prior to the commencement of work on site, a scheme to maintain an appropriate level of parking provision within Kilmacolm Village Centre during the lifetime of the construction work for the development hereby permitted, shall be submitted to and approved by the Head of Planning and Transportation in consultation with the Head of Environmental Services, to ensure that appropriate parking is maintained during construction works within Kilmacolm Village Centre;

 

 

(8)          that prior to the commencement of work on site, a written scheme of investigation in respect of archaeological works must be submitted to and approved by the Head of Planning and Transportation, in consultation with the West of Scotland Archaeology Service. Thereafter, the developer shall ensure that the programme of archaeological works is fully implemented and that all recording and recovery of archaeological resources within the application site is undertaken to the satisfaction of the Head of Planning and Transportation, in consultation with the West of Scotland Archaeology Service, to ensure the recording and recovery of any archaeological resources within the application site;

 

 

(9)          that prior to the development hereby approved becoming operational, all alterations to the car park, including the lining of car parking spaces, junction  improvements, necessary signage and surfacing works, shall be completed to the satisfaction of the Head of Planning and Transportation in consultation with the Head of Environmental  Services, to ensure that the car park is fully operational on the commencement of the community centre use;

 

 

(10)        that no works shall commence on site until notice of the proposal has been given to the Royal Commission on the Ancient and Historical Monuments of Scotland, John Sinclair House, 16 Bernard Terrace, Edinburgh, EH8 9NX and either the Royal Commission have been given reasonable access to the building for at least 3 months following the granting of consent and the giving of notice to the Commission, or they have stated in writing that they have completed their record of the building, or that they do not wish to record it, to give the RCAHMS the opportunity to record the Old Primary School Building prior to the commencement of works; and

 

 

(11)        that the developer shall secure the implementation of an archaeological watching brief, to be carried out by an archaeological organisation acceptable to the Head of Planning and Transportation during all ground disturbance. The retained archaeological organisation shall be afforded access at all reasonable times to any archaeological organisation acceptable to the planning authority, and shall allow them to observe work in progress and record items of interest and finds. A method statement for the watching brief will be submitted by the applicant, agreed by the West of Scotland Archaeological Service, and approved by the Head of Planning and Transportation prior to the commencement of the watching brief. The name of the archaeological organisation retained by the developer shall be given to the Head of Planning and Transportation and to the West of Scotland Archaeological Service in writing not less than 14 days before development commences, to ensure the recording and recovery of any archaeological resources within the application site; and

 

 

(ii) that the application for listed building consent be referred to the Scottish Ministers advising that the Council is minded to grant consent subject to the following conditions:-

 

 

(1)          that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 16 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997;

(2)          that no works shall commence on site until notice of the proposal has been given to the Royal Commission on the Ancient and Historical Monuments of Scotland, John Sinclair House, 16 Bernard Terrace, Edinburgh, EH8 9NX and either the Royal Commission have been given reasonable access to the building for at least 3 months following the granting of consent and the giving of notice to the Commission, or they have stated in writing that they have completed their record of the building, or that they do not wish to record it, to give the RCAHMS the opportunity to record the Old Primary School Building prior to the commencement of works;

Erection of Dwellinghouse within Grounds (in outline):

Dorema, Bridge of Weir Road, Kilmacolm (IC/06/458)

 

 

 

Decided:  that planning permission be refused for the following reasons:-

 

 

(1)          as it is contrary to Planning Practice Advice Note (PPAN) 1 in that it does not have direct road frontage and disrupts the established building pattern;

 

 

(2)          as it is contrary to PPAN 2 in that the plot size is smaller than that in the vicinity and the plot coverage is greater;

 

 

(3)          as it is contrary to PPAN 3 in that it would result in an increased density in the immediate area; and

 

 

(4)          as it would result in unacceptable residential amenity due to an inappropriate residential setting, reduced daylight and sunlight for the plot and privacy implications due to a significant level of overlooking by adjacent buildings.

 

 

(k)

Change of use of Children’s Home to Residential Use and the

Erection of Dwellinghouses:

Balrossie, Blacksholm Road, Kilmacolm (IC/06/315R & LB/06/022R)

 

 

 

Decided:

 

 

(i) that  the planning application be referred to the Scottish Ministers in terms of the Town and Country Planning (Notification of Applications) (Scotland) Direction 1995 recommending that planning permission be granted subject to the following conditions:-

(1)          that the development hereby permitted shall be commenced within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

(2)          that before the development hereby permitted starts, full details and samples of all materials to be used on the elevations and roofs of the buildings, including windows,  and also the proposed boundary treatments shall be submitted to and approved by the Head of Planning and Transportation, to ensure the proposed materials are acceptable in the interests of visual amenity;

 

 

(3)          that before the development hereby permitted starts, a full tree survey in accordance with British Standards Institute Trees in Relation to Construction, currently BS 5837 - 2005, shall be submitted to the Head of Planning and Transportation;

 

 

(4)          that before the development hereby permitted starts, full details of hard and soft landscape works, including road, footpaths and all shared hard surfaces, shall be submitted to and approved in writing by the Head of Planning and Transportation, details of the work shall include:

 

 

(i)           existing and finished ground levels in relation to a fixed datum;   

 

 

(ii)          existing landscaping features to be retained, and in the case of damage, restored;

 

 

(iii)          a programme for the completion and subsequent maintenance of soft landscape works;

 

 

(5)  that no existing trees or shrubs be lopped, topped, felled, removed or disturbed in any way without the prior written consent of the Head of Planning and Transportation;

 

 

(6)          that any planting implemented as part of the approved scheme which in the opinion of the Head of Planning and Transportation is dying, severely damaged or diseased within five years of planting, shall be replaced by species of a similar specification to those originally planted;

 

 

(7)          that existing trees both within the development site and in the vicinity of the boundary of the site which are not to be felled or lopped as part of the proposals, are to be protected in line with British Standards Recommendations for Trees in Relation to Construction, currently BS 5837: 2005 and no development shall take place until details of tree protection measures have been submitted to and approved in writing by the Head of Planning and Transportation, conditions (3) - (7) being imposed to ensure the provision and retention of adequate landscape;

 

 

(8)          that no tree felling, lopping or scrub clearance shall take place within the main bird breeding season, March to June inclusive, to ensure species protection and to comply with the requirements of the Conservation (Scotland) Act 2004 and the Wildlife and Countryside Act 1981;

 

 

(9)          that before the development hereby permitted starts a suitably qualified surveyor approved by the Head of Planning and Transportation in consultation with Scottish Natural Heritage, shall survey the site for the presence of bat roosts in the summer months. A report from this survey shall be submitted to the Head of Planning and Transportation for consideration in consultation with Scottish Natural Heritage, and any species protection measures required shall be implemented to the satisfaction of the Head of Planning and Transportation in consultation with Scottish Natural Heritage, to comply with the Nature Conservation Act (Scotland) 2004 and the Wildlife and Countryside Act 1981 (as amended);

 

 

(10)        that before the development hereby permitted starts, an ecological survey shall take place and a management plan be produced and submitted to the Head of Planning and Transportation for consideration, in consultation with Scottish Natural Heritage, details of the works shall include:

 

 

(i) botanical and protected species surveys with mitigation for protected species if required; and

(ii)          a management plan for the grounds at Balrossie detailing species to be used within habitation enhancement works and maintenance programme, to enhance the flora and fauna and contribute to the aims of the Inverclyde, Renfrewshire and East Renfrewshire Local Biodiversity Action Plan;

(11)        that before construction works begin on the development hereby permitted, a phasing plan, incorporating the details of the comprehensive refurbishment of existing buildings, shall  be submitted to and approved by the Head of Planning and Transportation, the development shall thereafter be required to proceed in compliance with the approved phasing plan. For the avoidance of doubt, the plan shall require the phased completion of the restoration of existing buildings in accordance with the approved plans prior to the phased completion and occupation of the new build houses, to ensure the appropriate phased development of this site in conjunction with the comprehensive external refurbishment of  the existing property at Balrossie, which comprises a Grade B Listed Building, in the interests of securing the heritage value of the site;

 

 

(12)     that the road (outlined in green on the approved plan) serving the development will require to be to adoptable standard and will require a Construction Consent, to ensure the provision of adequate vehicular access facilities;                                        

 

 

(13)        that before the development hereby permitted starts a full network survey to demonstrate that the existing foul drainage network is suitable for the development shall be submitted to the Head of Planning and Transportation for consideration in consultation with the Scottish Environment  Protection Agency (SEPA) and any measures required shall be implemented to the satisfaction of the Head of Planning and Transportation in consultation with SEPA, to ensure the provision of appropriate foul drainage facility for the development;

 

 

(14)        that before the development hereby permitted starts full details of a Sustainable Urban Drainage System for the development shall be submitted to the Head of Planning and Transportation for consideration, in consultation with the Scottish Environment Protection Agency (SEPA) and any measures required shall be implemented to the satisfaction of the Head of Planning and Transportation in consultation with the Scottish Environment Protection Agency (SEPA), to demonstrate that the site can be drained in accordance with the Sustainable Urban Drainage Systems Design Manual for Scotland and Northern Ireland;

 

 

(15)        that before the development hereby permitted starts, a fully detailed survey to establish that the existing water supply is sufficient to provide for the proposed development shall be submitted to Scottish Water for consideration and any measures required by the developer shall be carried out to the satisfaction of Scottish Water, to ensure that the development can be adequately supplied in terms of the provision of a water supply;

 

 

(16)        that notwithstanding the provisions of Classes 1,2, 3, 4, 5 and 6 of Part 1, and Classes 7 and 9 of Part 2, of Schedule 1 of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992, as amended, an application for planning permission will be required in respect of all development specified as being permitted development by the aforementioned Classes, to enable the planning authority to retain control over works otherwise permitted ensuring the setting of Balrossie is protected from unsympathetic development;

 

 

(17)        that no permission is granted for the play area indicated on the approved plan JKA2006-14LAY49C, in the interests of residential amenity in this rural setting; and

 

 

(18)        that before the development hereby permitted starts, full engineering details of the works shown on Drawing No JKA 2006 -14 LAY 50 in relation to the improvements on Blacksholm Road, and Drawing No. JKA 2006 – 14 LAY 49C in so far as these relate to junction improvements at the main access to the site from Blacksholm Road shall be submitted to the Head of Planning and Transportation for consideration in consultation with the Head of Environmental Services and all such works shall be fully implemented to the satisfaction of the Head of Planning and Transportation in consultation with the Head of Environmental Services before the development hereby permitted starts on site, to assist in the safe passage of vehicles and pedestrians along Blacksholm Road; and

 

 

(ii)          that the application for listed building consent be referred to Historic Scotland in terms of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 recommending that consent be granted subject to the following conditions:-

 

 

(1)          that the development hereby permitted shall be commenced within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)          that before the development hereby permitted starts, full details and samples of all materials to be used on the elevations and roofs of the buildings, including windows, together with full details of the proposed methods of repair and finishes to their exteriors and all ancillary structures included within the designation of the listed building, shall be submitted to and approved by the Head of Planning and Transportation, to ensure that the proposed materials are acceptable in the interests of visual amenity and to ensure the appropriate restoration of the existing property at Balrossie, which comprises a Grade B listed building;

 

 

(3)          that before construction works begin on the development hereby permitted, a phasing plan incorporating the details of the comprehensive external refurbishment relating to the existing buildings at Balrossie be submitted for the consideration of the Head of Planning and Transportation, and before the first of the new residential units hereby permitted is occupied, these works shall be completed, to ensure the appropriate phased development of this site in conjunction with the comprehensive external refurbishment of the existing property at Balrossie, which comprises a Grade B listed building, in the interests of securing the heritage value of the site;

PROPOSED TRAFFIC REGULATION ORDER – ON-STREET PARKING PLACES

There was submitted a report by the Corporate Director Regeneration and Resources recommending the making of a Traffic Regulation Order to restrict parking within designated parking places at various locations within Kilmacolm, Port Glasgow, Greenock and Gourock to disabled persons displaying a badge under the appropriate Regulations only.

 

 

Decided:  that The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation (Scotland) Act 1984 in relation to a Traffic Regulation Order to restrict parking within designated parking places at various locations within Kilmacolm, Port Glasgow, Greenock and Gourock to disabled persons displaying a badge under the appropriate Regulations only and thereafter that it be remitted to the Head of Environmental Services and Head of Legal and Administration to arrange for implementation of the Order.

DRAFT REGIONAL TRANSPORT STRATEGY RESPONSE

There was submitted a report by the Corporate Director Environment and Community Protection seeking approval for the response to the Draft Regional Transport Strategy prepared by Strathclyde Partnership for Transport for the area covered by the former Strathclyde Region, a copy of which was appended to the report.

 

 

Decided:  that the Committee approve the response to the Draft Regional Transport Strategy appended to the report and that it be remitted to the Head of Planning and Transportation to request that, in relation to the reintroduction of the rail line to Bridge of Weir, consideration be given to extension of the line to Kilmacolm.
