PLANNING APPLICATION SUBMITTED FOR CONTINUED CONSIDERATION |

|
|
|
There was submitted a report by the Head of Planning Services on an application by Mr G Smith for the formation of a rear extension to the dwellinghouse to form a garage and balcony and the erection of a new boundary wall (amendment to planning permission IC/04/401R) at 29 Bentinck Street, Greenock (IC/06/367), consideration of which had been continued to the meeting held on 6 December 2006 to allow Members to undertake an informal site visit. |

|
Decided: that planning permission be granted subject to the following conditions:- |
|
|
(1) that the development to which this
permission relates must be begun within five years from the date of this
permission, to comply with Section 58 of the Town and Country Planning ( |
|
|
(2) that prior to the commencement of work on site, full details of the gates and railings hereby permitted be submitted to and approved by the Head of Planning Services, the construction of the development must then proceed using the approved details; and |
|
|
(3) that prior to the commencement of work on site, full details of the design and colour of the privacy screen for the balcony area hereby permitted be submitted to and approved by the Head of Planning Services, the construction of the privacy screen must then proceed using the approved design and colour with the screen being maintained in this colour at all times thereafter, conditions (2) and (3) being imposed to ensure that the gates, railings and screening used in the construction of the development are acceptable in terms of the existing house and wider conservation area. |

There were submitted reports by the Head of Planning Services on the following applications, together with letters of objection and support where submitted, which were dealt with as follows:- |

Proposed
Erection of Conservatory and Timber Decking: |

Decided: that planning permission be granted subject to the following conditions:- |
|

(1) that the development to which this
development relates must be begun within five years from the date of this
permission, to comply with Section 58 of the Town & Country Planning ( |

(2) that no development shall commence until a sample facing brick has been submitted to and approved in writing by the Head of Planning Services, development thereafter shall proceed utilising the approved materials unless the Head of Planning Services gives his prior written approval to any alternative, to ensure a continuity of materials in the recently completed residential development; and |
|
|
(3) that within 28 days of the date hereof, the applicant shall submit for the written approval of the Head of Planning Services details of screen planting to be provided between the timber deck and Laurel Way, the planting scheme to be completed within 28 days following approval by the Head of Planning Services, in the interests of the privacy of neighbouring properties. |

Decided: that planning permission be granted subject to the following conditions:- |
|
|
(1) that the development to which this
permission relates must be begun within 5 years from the date of this
permission, to comply with Section 58 of the Town & Country Planning ( |
|
|
(2) that no development shall commence until samples of all external materials have been submitted to and approved by the Head of Planning Services in writing, development thereafter shall proceed utilising the approved materials unless the Head of Planning Services gives his prior written approval to any alternatives, to ensure a continuity of materials in this part of Greenock; |
|
|
(3) that no development shall commence until fully detailed landscaping proposals have been submitted to and approved in writing by the Head of Planning Services; |
|
|
(4) that the approved scheme of planting shall be implemented in the first planting season following completion of the 22 houses and any specimens that in the subsequent 5 years die, become diseased or are damaged shall be replaced in the next planting season with a similar specimen unless the Head of Planning Services gives his prior written approval to any alternatives, conditions (3) and (4) being imposed to ensure the provision of a quality landscape setting for the development; and |

(5) that none of the houses shall be
occupied until the road and parking layout hereby approved have been
completed, to prevent obstructive parking on |
|
|
|
|
(c) |
Erection
of Two Storey Rear Extension to Dwellinghouse: |

|
|
|
Decided: that planning permission be granted. |
|
|
|
|
(d) |
Installation
of Replacement Windows on Front Elevation (in retrospect): |

|
|
|
|
Decided: that planning permission be refused as the style and design of the replacement windows unacceptably alter the appearance of the building to the detriment of its architectural integrity and the character of the Greenock West End Conservation Area and as such the proposal is contrary to policies HR11 and HR12 of the Inverclyde Local Plan, the Council’s Planning Practice Advice Note Number 11 on Replacement Windows and the advice and guidance contained within Historic Scotland’s Memorandum of Guidance on Listed Buildings and Conservation Areas. |

The report recommended that planning permission be refused for a number of reasons. |
|
|
The Head of Planning and Transportation referred to a letter from the applicant’s architect, copies of which were circulated, requesting that consideration of the application be continued to allow the opportunity to explore modifications to the proposals which may satisfy the requirements of both planning and building standards legislation. |
|

There was submitted a report by the Head of Planning Services advising that following the decision of the Committee at the meeting held on 6 September 2006 to refuse planning permission for the change of use of offices to flats and the formation of dormer extensions and velux rooflight at 11 William Street, Greenock (IC/06/230), an appeal against the refusal of planning permission had been made to the Scottish Ministers. |

There was submitted a report by the Head of Planning Services advising that following the submission of an appeal against the Council’s decision to grant planning permission for the installation of replacement windows at 7D Kempock Street, Gourock subject to a condition which requires that the windows be painted to match the original windows (IC/06/087), the Scottish Executive Inquiry Reporters’ Unit had advised that the appeal had been dismissed due to the appellant’s failure to provide missing documentation within the prescribed period. |
