Erection
of Boundary and Screen Fencing: Point
Place, Main Street, Inverkip (IC/06/196) |

Decided: that planning permission be granted subject to the following conditions:- |
|
|
(1) that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and |
|
|
(2) that prior to the commencement of work on site details of the exact colour of the staining of the fence be submitted to and approved by the Head of Planning Services; the fence must then be maintained in that colour at all times thereafter, to ensure that the colour of the fence is appropriate in terms of the adjacent building and wider conservation area. |

Non-Compliance

The report recommended that planning permission be refused as the absence of a designated route within the site from the pedestrian access gate to the customer entrance to the building could create pedestrian and vehicle conflict to the detriment of public safety. |
|
|
Decided: that consideration of the application be continued to allow the Head of Planning Services to have further discussion with the applicant on the provision of a designated pedestrian route within the site from the pedestrian gate to the customer entrance to the building. |

(i) that planning permission be granted; and |
|

(1) that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 16 of the Planning (Listed Building and Conservation Areas) (Scotland) Act 1997; and |

(2) that the flue on the front elevation of the building hereby permitted must be painted in a colour to match the stonework of the building with both the colour and type of paint being submitted to and approved by the Head of Planning Services prior to this work being carried out; this work must be carried out within three months of this permission and the flue must be maintained in this colour and paint type at all times thereafter, to ensure the flue is finished in an appropriate colour to minimise its impact on the listed building. |

Decided: that planning permission be granted subject to the following conditions:- |

(1) that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; |

(2) that development shall not begin until full details of the proposed roof tile, wall finish, windows and brick base course together with full details of the boundary fence have been submitted to and approved in writing by the Head of Planning Services and the development carried out thereafter using the materials approved, to ensure the proposal is acceptable in the interests of visual amenity; and |
|
|
(3) that the house shall not be occupied until the off-street parking spaces shown on Drawing No. SAS/1309/01 are formed, in the interests of road safety and to ensure the satisfactory completion of the development. |

be provided outside the premises, the details of which shall be agreed in
writing by the Head of Planning Services and following installation shall
remain on a permanent basis during the lifetime of the use, to make adequate
provision for the disposal of litter in the vicinity of the takeway unit. |

APPEAL - 7D KEMPOCK PLACE, GOUROCK |

There was submitted a report by the Head of Planning Services advising that following the granting of planning permission in May 2006 for the installation of replacement windows at 7D Kempock Place, Gourock subject to a condition requiring the painting of the windows to match the original windows (IC/06/087), an appeal against the condition had been made to the Scottish Ministers. |

There was submitted a report by the Head of Planning Services advising that following the decision of the Committee at the meeting held on 11 January 2006 to refuse planning permission for the erection of timber decking (in retrospect) at Cottage 9, Quarriers Village (IC/05/408), an appeal against the refusal of planning permission and the service of an Enforcement Notice requiring the removal of the timber decking had been made to the Scottish Ministers. |

There was submitted a report dated 30 June 2006 by the Head of Planning Services advising that following the decision of the Committee at the meeting held on 7 December 2005 to refuse outline planning permission for the erection of a house (in retrospect) within the grounds of Dalliefour, Barclaven Road, Kilmacolm (IC/05/375) and the subsequent appeal by the applicant to the Scottish Ministers against that refusal, the Reporter appointed by the Scottish Ministers had issued his decision which was to dismiss the appeal. |

There was submitted a report dated 30 June 2006 by the Head of Planning Services advising that following the service of the Tree Enforcement Notice requiring the planting of 33 trees throughout the site at Leven Road, Wemyss Bay and the subsequent appeal by the applicant to the Scottish Ministers against the service of the Enforcement Notice, the Reporter appointed by the Scottish Ministers had issued his decision which was to dismiss the appeal and require the appellant to implement the Council’s tree planting scheme by 17 September 2006. |

Decided: that The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order to restrict parking within designated parking places at various locations within Gourock, Greenock and Port Glasgow to disabled persons displaying a badge under the appropriate regulations only and thereafter that it be remitted to the Head of Transportation & Roads Service and the Solicitor to the Council to arrange for implementation of the Order. |

There was submitted a report dated 22 June 2006 by the Solicitor to the Council recommending the making of a Traffic Regulation Order to assist access for persons with mobility disabilities by the creation of a disabled person’s parking bay outside the Community Resource Centre at 9 John Wood Street, Port Glasgow. |

Decided: that The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order to create a disabled person’s parking bay outside the Community Resource Centre at 9 John Wood Street, Port Glasgow and thereafter that it be remitted to the Head of Transportation & Roads Service and the Solicitor to the Council to arrange for implementation of the Order. |
