PLANNING APPLICATIONS

294

 

There were submitted reports by the Head of Planning Services on the following applications, together with letters of objection and support where submitted, which were dealt with as follows:-

 

(a)

Proposed Erection of Side Conservatory:

16 Laurel Way, Bridge of Weir (IC/06/057)

 

 

Decided:  that planning permission be refused for the following reasons:- 

 

 

(1)      as the proposal fails to safeguard the character and amenity at the locality and as such is contrary to Policy H1 of the Inverclyde Local Plan 2005;

 

 

(2)      as the proposal, due to its visual impact on the streetscape and building is contrary to Policy H15 (b) and (c) in the Inverclyde Local Plan 2005; and

 

 

(3)      as the proposal, due to the publicly visible setting, is contrary to the advice contained within PPAN No 7.

 

(b)

Erection of Dwellinghouse:

Plot 1, "Avenel", Knockbuckle Road, Kilmacolm (IC/06/034)

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)      that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)      that samples of all facing materials to be used shall be submitted to and approved in writing by the Head of Planning Services prior to their use on the dwellinghouse hereby permitted, to ensure continuity in development of the site;

 

 

(3)      that in the eventuality the dwellinghouse hereby permitted is the first of the dwellinghouses within the grounds of “Avenel” to be constructed, the terms of condition 17 of planning permission IC/04/218 shall be fulfilled, to secure the previously approved replanting and to protect the amenity of adjacent properties;

(4)  that full details of the position and appearance of the boundary fencing shall be submitted to and approved in writing by the Head of Planning Services prior to it being erected; and½

(5)  that gutters and down pipes shall be cast iron, conditions (4) and (5) being imposed to ensure continuity in development of the site.

 

(c)

Change of Use of Restaurant (Class 3) to Lounge Bar:

4-6 Crawford Street, Port Glasgow (IC/06/040)

 

 

The report recommended that planning permission be refused as the proposal, having been considered with reference to Policy R10(g) of the Inverclyde Local Plan, is unacceptable by reason of potential to generate additional noise, disturbance and nuisance to the detriment of adjacent residential property.

 

 

Councillor Nimmo declared a personal interest in this matter and left the meeting.

 

 

After discussion, Councillor Hunter moved that planning permission be granted subject to appropriate conditions.   As an amendment, Councillor Forbes moved that planning permission be refused for the reason detailed in the report.   On a vote, 1 Member voted for the motion and 3 for the amendment which was declared carried.

 

 

Decided:  that planning permission be refused as the proposal, having been considered with reference to Policy R10(g) of the Inverclyde Local Plan, is unacceptable by reason of potential to generate additional noise, disturbance and nuisance to the detriment of adjacent residential property.

(d)

Proposed Erection of 92 2 & 3 Storey Houses:

Former Scott Lithgow Shipyard, Port Glasgow (IC/05/433)

 

 

Decided: that, after the lodging with the Council of a bond to cover the cost of implementation of landscaping works, reserved matters be approved subject to the following conditions:-

 

 

(1)      that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)      that no development shall commence until evidence has been submitted to the Head of Planning Services that written agreement has been reached between the applicant and Scottish Water regarding the provision of water and drainage services for the 92 houses, to ensure the provision of drainage and water services;

 

 

(3)      that no development shall commence until samples of all external materials have been submitted to and approved by the Head of Planning Services in writing, development thereafter shall proceed utilising the agreed materials unless the Head of Planning Services gives his prior written approval to any alternatives, to ensure a choice of materials sympathetic to this part of Port Glasgow;

 

 

(4)      that  no development shall commence until fully detailed landscaping proposals and a bond to cover the cost of their implementation have been submitted to and approved by the Head of Planning Services in writing; and

(5)      that the approved scheme of landscaping shall be implemented in the first planting season following completion of the 92 houses and any specimens that in the subsequent five years die, become diseased or are damaged shall be replaced in the next planting season with a similar specimen unless the Head of Planning Services gives his prior written approval to any alternatives, conditions (4) and (5) being imposed to ensure the provision of a quality landscape setting.

Change of Use of Shop to Dental Surgery Together with Alterations:

13 Union Street, Greenock and

Painting of Gable Walls (in retrospect):

11 and 13 Union Street, Greenock (IC/05/388R)

 

 

Decided:  that planning permission be granted.

 

(f)

Installation of Replacement Windows:

65c Union Street, Greenock (IC/06/028)

 

 

Decided:  that planning permission be refused as the style and design of replacement windows would result in the further degradation of the architectural integrity of the building to the detriment of the character of the Greenock West End Conservation Area, as such the proposal is contrary to Policies HR11 and HR12 of the Inverclyde Local Plan, the Council’s Planning Practice Advice Note Number 11 on Replacement Windows and the advice and guidance contained within Historic Scotland’s Memorandum of Guidance on Listed Buildings and Conservation Areas. 

 

 

(g)

Change of Use of Sunbed Salon to Hot Food Take Away:

172B Dunlop Street, Greenock (IC/06/060)

 

 

The report recommended that planning permission be granted subject to a number of conditions.

 

 

Decided:  that planning permission be refused for the following reasons:- 

 

 

(1)      as the proposal, having been considered with reference to Policy R10(g) of the Inverclyde Local Plan 2005, is unacceptable by reason of the potential to generate additional noise, disturbance and nuisance to the detriment of adjacent residential properties; and

 

 

(2)      as the proposed use could potentially result in the overprovision of hot food take away premises in the vicinity to the detriment of adjacent residential premises.

 

(h)

Alterations and Extension to Dwellinghouse:

22 Carnoustie Avenue, Gourock (IC/06/026)

 

 

The report recommended that planning permission be granted.

 

 

Decided:  that, in view of an amendment to the plans resulting in the requirement to undertake neighbour renotification and to allow neighbours to view the plans and make comments, consideration of the application be continued.

 

(i)

Change of Use from Retail Shop to Use as Cafe and Craft Workshop:

68-70 Royal Street, Gourock (IC/06/051)

 

 

 

The report recommended that planning permission be granted subject to a number of conditions.

 

 

Decided:  that consideration of the application be continued.

PLANNING APPEAL - FINNOCKBOG ROAD, INVERKIP

295

 

There was submitted a report by the Head of Planning Services advising that following the decision of the Committee at the meeting held on 6 April 2005 to refuse planning permission for the erection of a dwellinghouse (in outline) between ñ"Seafield" and "Tall Trees", Finnockbog Road, Inverkip (IC/05/033) and the subsequent appeal by the applicant to the Scottish Ministers against that refusal, the Reporter appointed by the Scottish Ministers had issued his decision which was to dismiss the appeal.
