otherwise, the following paragraphs are submitted for information only,
having been dealt with under the powers delegated to the Sub-Committee. |

PLANNING
APPLICATIONS |

|
There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:- |

(a) |
New Location/Design
for Conservatory and New Elevated Timber Deck (Amendment to
Planning Permission (IC/00/12)): Plot 2, Hazelmere
Road, Kilmacolm (IC/02/332) |
|
|
Decided: that planning permission be granted subject to the following conditions:- |
|
|
(1) that the development hereby permitted should be commenced within 5 years from the date of this permission, to comply with Section 58 (1) of the Town and Country Planning (Scotland) Act 1997; and |
|
|
(2) that all surface water generated by the development shall be intercepted within the application site, to protect the amenity of established adjacent dwellinghouses. |

(b) |
Change of Use from
Agricultural Building to Martial Arts Academy (in retrospect): Parkhill Farm, Old
Greenock Road, Port Glasgow (IC/02/367) |

|
Decided: that planning permission be granted subject to the following conditions:- |
|
|
(1) that the development hereby permitted shall be commenced within five years from the date of this permission to comply with Section 58 (1) of the Town & Country Planning (Scotland ) Act 1997; and |
|
|
(2) that the first 5 metres of the access, as measured from the road boundary, be constructed in an impervious material within 28 days of the date of this permission, to prevent deleterious material being carried onto the highway. |

Change of Use of
Class 1 (Retail Shop) to Class 2 (Office): 13 - 15 Church
Street, Port Glasgow (IC/02/358) |

Decided: that the application be referred to the Scottish Ministers in accordance with the Town and Country Planning (Notification of Applications) Direction 1997 recommending that planning permission be granted.

(d) |
Erection of 72 Dwellinghouses: Levan Farm, Gourock
(IC/02/212) The report recommended that reserved matters be approved on completion of the necessary landscaping and play area bond subject to the condition that the approved scheme of landscaping and play area shall be completed in the first planting season following completion of the 72 houses and any specimens that in the subsequent 5 years die, become diseased or are damaged shall be replaced in the next planting season with a similar specimen unless the Head of Planning Services gives his prior written approval to any variation that may be sought, to ensure the provision of a quality landscape setting for the development. |

The Head of Planning Services advised the Sub-Committee that the 11 townhouses had been deleted from the current proposal and that, accordingly, the application now related to 61 two storey dwellinghouses. He indicated that the new proposals in respect of the area on which the 11 townhouses would have been built would require to be the subject of a further application for approval of reserved matters in due course. |

Councillor Hunter was present and with consent spoke on the matter. |
|
|
After discussion, Councillor McCormick moved that reserved matters be approved on completion of the necessary landscaping and play area bond subject to the condition detailed in the report, the condition being amended to reflect that the application now related to 61 two storey dwellinghouses. As an amendment, Councillor Blair moved that consideration of the application be continued pending (1) the outcome of discussions regarding an alternative access route; (2) more detail from the applicant regarding the design of the housing to replace the townhouses deleted from the current application; and (3) further details of the extent and quality of landscaping to be provided within the development site to improve the amenity thereof. On a vote, 3 Members voted for the amendment and 3 for the motion. There being equality in voting, the Chairman exercised his casting vote in favour of the motion which was declared carried. Those Members who had voted in favour of the amendment then requested in terms of the relevant Standing Order that the matter be referred to The Inverclyde Council for decision in terms of the amendment. |

There was submitted a report dated 20 January 2003 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 2 October 2002 to refuse outline planning permission for the erection of 2 houses at Lewis Road, Greenock (IC/02/267), an appeal against the refusal of planning permission had been made to the Scottish Ministers. |

There was submitted a report dated 27 January 2003 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 2 October 2002 to refuse (i) the erection of 49 flatted dwellings with associated car parking and landscaping, and (ii) the formation of car parking and amenity ground at The Meadows, Greenock Road, Wemyss Bay (IC/02/063R and IC/02/240) appeals against the refusal of planning permission had been made to the Scottish Ministers. |

There was submitted a report dated 27 January 2003 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 7 August 2002 to refuse the change of use of ground floor flat and basement into 2 flats at 53 Union Street, Greenock (IC/02/147) and the subsequent appeal by the applicant to the Scottish Ministers against that refusal, the Reporter appointed by the Scottish Ministers had issued his decision which was to uphold the appeal. |
