PLANNING APPLICATIONS

There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

(a)

Erection of Dwellinghouse:

Glenmosston Road, Kilmacolm (IC/02/268)

 

 

Decided: that consideration of the application be continued for further discussion with the applicant.

 

(b)

Erection of Dwellinghouse:

Plot 6, Turnberry Avenue, Gourock (IC/02/277)

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)  that samples of the roof tiles, external render, facing brick and external cladding shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of development, to ensure compliance with the Approved Design Brief and visual continuity within the site;

 

 

(3)  that no trees shall be felled without the prior approval of the Head of Planning Services, to ensure that the site is covered by a Tree Preservation Order and to minimise tree loss;

(4)  that the planting proposals detailed on the site plan hereby approved with the exception of planting approved under planning permission IC/99/342 shall be implemented no later than the first planting season following occupation of the dwellinghouse, to ensure continuity of planting throughout the site;

(5)  that all site surface run off shall be intercepted within the site and access taken via a crossover constructed in accordance with the Approved Roads Development Guide, to comply with the Approved Roads Development Guide, and

 

 

(6)  that any boundary fencing shall be erected in accordance with the agreed detail referred to in the Approved Design Brief, to ensure compliance with the Approved Design Brief and visual continuity within the site.

 

(c)

Erection of Extension Including Formation of Raised Patio to Rear of Dwellinghouse:

5 Blair Gardens, Gourock (IC/02/288)

 

 

Decided:  that planning permission be granted.

 

(d)

Erection of Dwellinghouse (in outline):

Adjacent to 181 Inverkip Road, Greenock (IC/02/272)

 

 

Councillor Rebecchi was present and with consent spoke on the matter.

 

 

Decided:  that planning permission be refused for the following reasons:-

 

 

(1)  as the proposed development would result in increased interference with the safety and flow of traffic on the trunk road due to the proximity of the access to the adjacent bus stop and pedestrian refuge to the detriment of safety and the flow of traffic; and

 

 

(2)  as the erection of a house at this location would be incompatible with the character and amenity of the immediate area and consequently at conflict with Policy H8 in the Inverclyde Local Plan: First Review, Final Draft.

 

(e)

Change of Use of Store House to Private Gymnasium (in retrospect):

10 Robertson Street, Greenock (IC/02/278)

 

 

Decided:  that planning permission be granted.

 

(f)

Erection of Dwellinghouse (in outline):

48 Kelly Street, Greenock (IC/02/176)

 

 

Councillor Blair declared an interest in this matter and took no part in its consideration or decision.

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that this permission is granted under the provisions of the Town and Country Planning (General Development Procedure) (Scotland) Order 1992 on an outline application and the further approval of the Council or of the First Minister on appeal shall be required with respect to the undermentioned matters hereby reserved before any development is commenced:-

 

 

(a) the design and external appearance of the proposed development;

 

 

(b) details of the access arrangements;

 

 

(c) details of landscaping of the site;

(2)  that in the case of the reserved matters specified above application for approval must be made before:

(i) the expiration of 3 years from the date of grant of outline permission; or

 

 

(ii) the expiration of 6 months from the date on which an earlier application for such approval was refused; or

 

 

(iii) the expiration of 6 months from the date on which an appeal against such refusal was dismissed whichever is the latest:

provided only one such application may be made in the case after the expiration of the three year period mentioned in sub-paragraph (i) above;

 

 

(3)  that the development to which this permission relates must be begun not later than the expiration of 5 years from the date of this permission or within 2 years from the final approval of reserved matters, whichever is later, conditions (1), (2) and (3) being imposed to comply with Section 59 of the Town and Country Planning (Scotland) Act 1997;

 

 

(4)  that the density of development shall not exceed 80 habitable rooms per acre, to accord with policy DCo(vi) in the Inverclyde Local Plan;

 

 

(5)  that the house shall not exceed 1½ storeys in height and shall be sited within the plot in accordance with docquetted drawing no.06301, to ensure a scale subservient to Greenbank House and a siting sympathetic to its setting; and

 

 

(6)  that off street parking shall be provided in accordance with the Council’s Roads Development Guide, to prevent parking from the development overflowing onto Kelly Street.

 

(g)

Erection of 50 metre Anemometer Mast for Temporary Period of 24 months:

Burnhead Moor, East of Corlic Hill, Greenock (IC/02/281)

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)   that the development to which this permission relates must be begun within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)  that the mast hereby authorised shall be removed 24 months after being erected and that any works required for the reinstatement of the land will be carried out to the satisfaction of the Head of Planning Services within 2 months of the mast being removed, in view of the temporary nature of the proposed mast;

 

 

(3)   that as far as possible the construction work shall take place outside the main bird breeding season and that should this not be possible then the area, including routes required for access, should be surveyed for the presence of breeding birds by a suitably experienced surveyor, in the interests of protecting birds during the breeding season;

 

 

(4)   that the finished colour and texture of the mast and supporting wires be non-reflective and appropriate to the landscape to allow it to be visually as inconspicuous as possible, to minimise the visual impact of the mast; and

 

 

(5)   that any areas disturbed to create access tracks, cabling routes and other structures required to construct and maintain this facility should be restored with excavated material stored in layers to allow the top soils and vegetation to be replaced, to protect flora and fauna from damage resulting from construction work.

 

(h)

Installation of Slimline Street Works Monopole with Tri-Sector Antenna

and Equipment Cabinet:

Woodhall Terrace, Port Glasgow (IC/02/243R)

 

 

The report recommended that planning permission be granted subject to a number of conditions.

 

 

Decided:  that consideration of the application be continued.

ADVERTISEMENT APPLICATIONS

There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

(a)

Display of Freestanding Signboard:

St John's Road, Gourock (CA/02/023)

 

 

Decided:  that advertisement consent be refused for the following reasons:-

 

 

(1)  as the proposal is contrary to policy DCr(iii) which states:-

 

 

"No advance directional signs will be permitted unless the location of the premises concerned cannot be otherwise indicated with safety or reasonable clarity to passing traffic";

 

 

(2)   as the proposed sign would be detrimental to the visual amenity of an established area of amenity landscaping and of the area in general and would act as a precedent for similar developments; and

 

 

(3)   as the proposed sign would have an adverse effect upon the setting of the adjoining listed building and, as such, would be contrary to Government Policy and Guidance as contained within Historic Scotland's Memorandum of Guidance on Listed Buildings and Conservation Areas.

 

(b)

Display of Freestanding Banners (in retrospect):

Safeway Store, Rue End Street, Greenock (CA/02/017)

 

 

The report recommended that advertisement consent be refused as (1) the three freestanding banners have generated advertisement clutter detrimental to the regime of authorised signage at the supermarket and to the quality of visual amenity of this prominent location; and  (2) the three freestanding banners are of poor design quality and, as such, have a detrimental impact on the visual amenity of this prominent location.

 

 

The Head of Planning Services referred to a letter dated 5 November 2002 from the applicant's agents which had been circulated to the Sub-Committee indicating that they wished to withdraw the application.

 

 

Decided:  that the withdrawal of the application be noted.

ADVERTISEMENT APPEAL

There was submitted a report dated 10 October 2002 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 2 October 2002 to refuse an application for an advertisement hoarding display in Baker Street, Greenock (CA/02/019), an appeal against the refusal of advertisement consent had been made to the Scottish Ministers.

PROPOSED TRAFFIC REGULATION ORDER - ON-STREET PARKING PLACES (WITHOUT CHARGES) ORDER NO. 2 2002

There was submitted a report dated 24 October 2002 by the Director of Legal & Support Services recommending the making of a Traffic Regulation Order to restrict parking within designated parking places at various locations in Gourock, Greenock, Port Glasgow and Kilmacolm to disabled persons displaying a badge under the appropriate regulations only.   Mr Bruce advised that the parking place at 11 Killearn Road, Greenock was now no longer required.

 

 

Decided:  that The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order to restrict parking within designated parking places at various locations within Gourock, Greenock, Port Glasgow and Kilmacolm, subject to deletion of the parking place at 11 Killearn Road, Greenock, to disabled persons displaying a badge under the appropriate regulations only and thereafter that it be remitted to the Head of Transportation and Roads Service and the Director of Legal and Support Services to arrange for implementation of the Order.

 

 

The Convener being of the opinion that the undernoted item was relevant, competent and urgent moved its consideration to allow the Sub-Committee to be informed of an imminent display at the earliest opportunity.   This was unanimously agreed in terms of the relevant Standing Order.

PORT GLASGOW TOWN CENTRE - DEVELOPMENT BY J J GALLAGHER LTD

Mr McLaren, Planning Services, advised the Sub-Committee of an imminent public display to be held in Port Glasgow library on 11 - 18 November 2002 inclusive on the Traffic Regulation Orders which require to be made prior to the implementation of the realignment of the A8 trunk road as a result of the development in Port Glasgow town centre by J J Gallagher Ltd.  It was noted that arrangements were being made to advertise the display in the local press and by posters in various locations throughout Inverclyde.
