PLANNING APPLICATIONS

There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

(a)

Erection of Garage:

Rear of 28 East Crawford Street (fronting Border Street), Greenock (IC/01/210)

 

 

Decided:  that planning permission be refused as the monopitched design and common brick finish would combine to create a building of poor architectural quality to the detriment of the visual amenity in Border Street.

 

(b)

Change of Use of General Industrial Building to Taxi Call Centre and Associated Service Workshop:

6 MacDougall Street, Greenock (IC/01/150)

 

 

Decided:  that planning permission be refused for the following reasons:-

 

 

(1)  as the proposed development would result in increasing the number and type of vehicles entering and leaving the traffic stream at a point where visibility is restricted thus creating interference with the safety and free flow of traffic on the trunk road; and

 

 

(2) as the proposed development would result in an intensification of right turning manoeuvres causing increased interference with the safety and free flow of the traffic on the trunk road.

Demolition of Grade B Listed Church and Erection of 15 Flats:

(c)

Wellpark Church, Lynedoch Street, Greenock (LB/01/11 & IC/01/215)

 

 

Decided:

(a)  that the listed building application be referred to Historic Scotland advising of the Council’s intention to grant listed building consent subject to the condition that no demolition works shall take place until signed contracts in respect of the programme of works to ensure the commitment to erect 15 flats following demolition have been submitted to and approved in respect of the timescales by the Head of Planning Services in writing, to ensure that the listed church is replaced with a quality design following completion of the demolition works; and

 

 

(b)  that planning permission be granted subject to the following conditions:-

 

 

(1) that the development to which this permission relates must be begun within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2) that no development shall commence until full details of the incorporation of stone features from the existing church on the site into the 15 flats and details of the proposed bin stores have been submitted to and approved by the Head of Planning Services in consultation with Historic Scotland, to ensure the sensitive incorporation of the stone features into the new build flats and in the interests of visual amenity;

 

 

(3)  that development shall not commence until samples of materials to be used on external surfaces of the flats and in construction of the hardstanding and boundary treatment have been submitted to and approved by the Head of Planning Services in writing, development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing with the Head of Planning Services, to ensure that the finishing materials are sympathetic to those used in adjoining properties in Lynedoch Street;

 

 

(4)  that none of the flats shall be occupied until the parking layout detailed on docquetted drawing (PL)01A has been completed;

 

 

(5) that the access driveway shall be constructed in impervious material and all surface water shall be intercepted within the site, conditions (4) & (5) being imposed to prevent obstructive parking and in the interests of road safety on Lynedoch Street;

 

 

(6) that no development shall commence until fully detailed landscaping proposals have been submitted to and approved by the Head of Planning Services in writing; and

 

 

(7) that the approved scheme of landscaping shall be implemented in the first planting season following occupation of the flats and any specimens that in the subsequent 5 years die, become diseased or are damaged shall be replaced in the next planting season unless the Head of Planning Services gives his prior written consent to any variation that may be sought, conditions (6) & (7) being imposed to ensure the provision and sustainability of a quality landscape scheme for the development.

 

(d)

Construction of Restaurant and Associated Car Parking:

Waterfront Development, Custom House Quay, Greenock (IC/01/47)

 

 

 

Decided:  that planning permission be refused for the following reasons:-

(1)  as the proposals would be detrimental to the visual amenity of the Waterfront Retail Park and the setting of the Waterfront Leisure Complex; and

(2)  as the number of car parking spaces proposed for the development is inadequate and as the proposed parking spaces in the service yard would prejudice pedestrian safety.

 

(e)

Change of Use of Bank to Public House, Formation of Beer Garden and Internal Alterations and Refurbishment:

11 William Street, Greenock (IC/01/226 & LB/01/15)

 

 

Councillor Blair declared an interest in this matter and took no part in its consideration or decision.

 

 

Decided: 

(a) that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)  that details of the proposed ventilation system be submitted to and approved in writing by the Head of Planning Services within 2 months of the date of this consent and thereafter the premises shall not start trading until the ventilation system is operational in accordance with details approved by the Head of Planning Services, to protect local residents from nuisance resulting from the disposal of cooking odours;

 

 

(3)  that noise from the ventilation system and noise from within the premises shall be inaudible in any residential property, to protect local residents from nuisance resulting from noise from the ventilation system and noise from within the premises;

 

 

(4)  that the beer garden shall not be used after 9.00pm daily, to protect local residents from noise nuisance from the beer garden;

 

 

(5)  that beer lorries will unload in Cathcart Square outwith peak traffic periods 8.00am - 6.00pm, to prevent congestion and obstruction on William Street during peak traffic periods; and

 

 

(b)  that the listed building application be referred to Historic Scotland with a recommendation that listed building consent be issued subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

(f)

Change of Use of Part of Basement to Office:

92 Newark Street, Greenock (IC/01/273)

 

 

Decided:  that planning permission be refused for the following reasons:-

 

 

(1)  as the proposal is contrary to Local Plan Policy DCo(iv) which states:-

 

 

“Within the remainder of the West End, only development or change of use to residential will be permitted"; and

 

 

(2)  as the introduction of non residential uses into this part of Greenock’s West End  would be to the detriment of the quality of residential amenity from noise and activity.

 

(g)

Variation to Condition 1 Attached to Planning Permission (IC/01/109):

Alt-na-Craig House, Lyle Road, Greenock (IC/01/263)

 

 

Decided:  that planning permission be refused as to delay provision of the kitchen and laundry extract flues approved under planning permission IC/01/109 would have a detrimental impact upon the enjoyment of adjoining residential properties.

 

(h)

Erection of Balcony:

11 Edinburgh Drive, Gourock (IC/01/259)

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and

 

 

(2)  that prior to the use of the balcony, the end screens (as shown on the approved plan) with obscure glass panels shall be erected and thereafter retained at all times, to the satisfaction of the Head of Planning Services, to ensure that the privacy of the adjacent properties is protected.

 

(i)

Erection of Dwellinghouse:

ADVERTISEMENT APPEALS

There was submitted a report dated 11 September 2001 by the Head of Planning Services advising that following the decisions of the Sub-Committee at the meeting held on 1 August 2001 to refuse applications for the display of illuminated advertising hoardings at Union Street, Greenock (CA/01/17), Brougham Street, Greenock (CA/01/18), Clarence Street, Greenock (CA/01/19), Port Glasgow Road, Greenock (CA/01/20), East Hamilton Street, Greenock (CA/01/16) and Main Street, Greenock (CA/01/21), appeals against the refusal of advertisment consent had been made to the Scottish Ministers.

PROPOSED TRAFFIC REGULATION ORDER - SHORE STREET, GOUROCK

There was submitted a report dated 12 September 2001 by the Director of Legal & Support Services recommending the making of a Traffic Regulation Order to introduce no waiting and no loading at any time restrictions in Shore Street, Gourock in the vicinity of the new pedestrian refuge island at Eastern View.   

 

 

Decided: that The Inverclyde Council be recommended to make a Resolution under the  Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order to introduce no waiting and no loading at any time restrictions in Shore Street, Gourock in the vicinity of the new pedestrian refuge island at Eastern View and thereafter that it be remitted to the Head of Transportation & Roads Service and the Director of Legal & Support Services to arrange for implementation of the Order.
