Chair:  Councillor McGhee presided.

 

 

In attendance:  Depute Chief Executive, Miss M McKnight (for Director of Legal & Support Services), Head of Planning Services and Mr A Bruce (for Head of Transportation & Roads Service).

With the exception of the decisions marked 'C' which are open for confirmation or otherwise, the following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

PLANNING APPLICATIONS SUBMITTED FOR CONTINUED CONSIDERATION

(a)

 

 

 

Erection of 18 flats:

South Street, Greenock (IC/01/155R)

 

There was submitted a report dated 27 August 2001 by the Head of Planning Services regarding an application by W  H Kirkwood Ltd for the erection of 18 flats at South Street, Greenock (IC/01/155R), consideration of which had been continued from the meeting held on 1 August 2001 for a site visit.

 

 

The report recommended that planning permission be granted subject to a number of conditions.

After discussion, Councillor McGhee moved that planning permission be granted subject to the conditions detailed in the report.   As an amendment, Councillor Blair moved that planning permission be refused as the proposals would have an adverse impact on road safety by reason of increased pedestrian and vehicular traffic in an already congested area.   On a vote, 3 Members voted for the amendment and 3 for the motion.   There being equality in voting the Convener exercised his casting vote in favour of the motion which was declared carried.    Those Members who had voted for the amendment then requested in terms of the relevant Standing Order that the matter be referred to The Inverclyde Council for decision in terms of the amendment.  

Decided:  that planning permission be granted subject to the following  conditions:-

(1)  that the development to which this permission relates must be begun within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

(2)  that development shall not commence until samples of materials to be used on external surfaces of the buildings and in the construction of hard standings/fences have been submitted to and approved in writing by the Head of Planning Services; development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing with the Head of Planning Services, to ensure that the selected materials are compatible with thosÛe in the surrounding area;

(3)  that no development shall commence until full details of the proposed bin store designs have been submitted to and approved in writing by the Head of Planning Services, to ensure that the bin store designs are compatible with the flats;

 

 

(4)  that none of the flats shall be occupied until the access improvements, traffic calming and off street parking detailed on drawing no. 002 have been completed to the satisfaction of the Head of Planning Services, in the interests of road safety on the access to the flats and on South Street and to prevent obstructive parking on South Street;

 

 

(5)  that the approved scheme of landscaping shall be completed within the first planting season following completion of the flats and any specimens that in the subsequent five years die, become diseased or are damaged shall be replaced in the next planting season unless the Head of Planning Services gives his prior written consent to any variation that may be sought; and

 

 

(6)  that no development shall commence until fully detailed tree protection measures have been submitted to and approved by the Head of Planning Services; the tree protection measures shall be maintained in place for the duration of the works, conditions (5) and (6) being imposed to ensure that the site is maintained within a quality landscape setting.

 

(b)

Erection of Dwellinghouse:

Lochwinnoch Road, Kilmacolm (IC/01/144)

 

 

There was submitted a report dated 17 August 2001 by the Head of Planning Services regarding an application by Mr & Mrs Cree for the erection of a dwellinghouse at Lochwinnoch Road, Kilmacolm (IC/01/144), consideration of which had been continued from the meeting held on 1 August 2001 for a site visit.

 

 

The report recommended that planning permission be granted subject to a number of conditions.

 

 

After discussion, Councillor McGhee moved that planning permission be granted subject to the conditions detailed in the report.   As an amendment, Councillor Calvert moved that planning permission be refused as the proposals would have a detrimental impact on road safety with particular regard to nearby schools.   On a vote, 1 Member voted for the amendment and 5 for the motion which was declared carried.

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)  that development shall not begin until samples of materials to be used on external surfaces and in the construction of hard standings/walls/fences have been submitted to and approved in writing by the Head of Planning Services; development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing by the Head of Planning Services, to ensure that the finishing materials are sympathetic to the built form of the surrounding area;

(c)

Erection of Dwellinghouse and Integral Garage:

The Hermitage, Burndale Lane, Kilmacolm (IC/01/76R)

 

 

There was submitted a report dated 27 August 2001 by the Head of Planning Services regarding an application by Mr & Mrs Dunsmore for the erection of a dwellinghouse and integral garage at the Hermitage, Burndale Lane, Kilmacolm (IC/01/76R), consideration of which had been continued from the meeting held on 1 August 2001 for further discussions with the applicant.

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)  that development shall not begin until samples of materials to be used on external surfaces of the building have been submitted to and approved in writing by the Head of Planning Services, to ensure that the new dwellinghouse complements the external appearance of the existing dwellinghouse and thereby maintains the visual quality of the area;

 

 

(3)  that the existing trees shown on drawing no. 3A on the site shall not be lopped, topped or removed or disturbed in any way without the prior written consent of the Head of Planning Services; and

 

 

(4)  that development on the site shall not begin until trees marked for retention on drawing no. 3A have been protected by suitable fencing;  details of this fencing shall be submitted for the consideration of the Head of Planning Services and no work shall begin until the written approval of the Head of Planning Services has been given, conditions (3) and (4) being imposed to maintain the contribution of existing trees to the landscape quality of the area.

After discussion, Councillor McGhee moved that planning permission be granted.   As an amendment Councillor Morrison moved that planning permission be refused as the proposals would have a detrimental effect on the level of privacy and amenity presently enjoyed by properties to the north of the site.   On a vote, 3 Members voted for the amendment and 3 for the motion.   There being equality in voting the Convener exercised his casting vote in favour of the motion which was declared carried.   Those Members who had voted for the amendment then requested, in terms of the relevant Standing Order that the matter be referred to The Inverclyde Council for decision in terms of the amendment.  Decided:  that planning permission be granted.

The report recommended that planning permission be granted subject to a number of conditions.

 

 

Councillor Hunter was present and with consent spoke on the matter.

 

 

After discussion, Councillor McGhee moved that planning permission be granted subject to the conditions detailed in the report.   As an amendment, Councillor Morrison moved that planning permission be refused as the proposal would have an adverse impact on the amenity and privacy of adjacent residents by reason of scale and design.  On a vote 2 Members voted for the motion and 3 for the amendment which was declared carried.

 

 

Decided:  that planning permission be refused as the proposal would have an adverse impact on the amenity and privacy of adjacent residents by reason of scale and design.   

 

 

 

 

(c)

Extension to Belleaire Nursing Home:

Decided:  that planning permission be refused for the following reasons:

 

 

(1)  as the proximity of the proposed nursing home extension to the properties at Dungourney Drive would be to the detriment of the quality of residential amenity that is currently enjoyed; and

 

 

(2)  as the proposed development forward of Belleaire would impact upon the landscape setting for the building's quality frontage to the detriment of the quality of visual amenity that is currently enjoyed.

 

(d)

Alterations and Change of Use to form Basement Flat (in retrospect):

After discussion, Councillor McGhee moved that planning permission be granted.   As an amendment, Councillor Morrison moved that planning permission be refused as (1) the proposals are contrary to Local Plan Policy DCo(vii) in that off street parking cannot be provided and (2) the residential amenity of adjacent proprietors within the area would be adversely affected by the proposals.   On a vote, 3 Members voted for the amendment and 3 for the motion.   There being equality in voting the Convener exercised his casting vote in favour of the motion which was declared carried.   Those Members who had voted for the amendment then requested in terms of the relevant Standing Order that the matter be referred to The Inverclyde Council for decision  in terms of the amendment.

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)  that development shall not begin until samples of materials to be used on external surfaces and in the construction of hardstandings/walls/fences have been submitted to and approved in writing by the Head of Planning Services; development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing with the Head of Planning Services, to ensure that the finishing materials are sympathetic to the built form of the surrounding area;

 

 

(3)  that prior to the flats being occupied the parking layout detailed on Drawing HD247/(01) shall be completed; and

 

 

(4)  that prior to the flats being occupied a footway crossover, designed in accordance with the Council's Roads Development Guide, shall be provided at the access onto Mount Pleasant Street, the driveway shall be surfaced in impervious material and all surface water shall be intercepted within the site, conditions (3) and (4) being imposed in the interests of road safety on Mount Pleasant Street.

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and

 

 

(2)  that the deliveries door should open inwards, to prevent the delivery doors opening onto the public footway.

(a) that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission  relates must be begun within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)  that details of the design and external appearance of all the proposed windows, rooflights and doors be submitted to and approved by the Head of Planning Services prior to the commencement of the development;

 

 

(3)  that samples of the proposed roof slate, facing brick for bin stores, cast iron gutters and drainpipes be submitted to and approved by the Head of Planning Services in writing prior to the commencement of the development;

 

 

(4)  that details of the proposed masonry paint system in respect of the masonry bonds on quoins shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of the development;

 

 

(5)  that a survey report on the condition of the masonry on the building and associated walls and the proposed method of stone repairs and repointing shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of the development, conditions (2) - (5) being imposed to ensure that the external works proposed are appropriate for the listed building and thereby maintain the visual quality of the area;

 

 

(6)  that the 14 car parking spaces indicated on drawing no. 787/07 shall be formed prior to the occupation of any of the 14 flats hereby approved and retained thereafter for the exclusive use of the occupants of the flats, to prevent car parking occurring on Glen Avenue and to ensure that the car park is solely used for resident parking;

 

 

(7)  that access to the car park shall take the form of a footway crossover, to ensure safe vehicular access to and from the car park;

 

 

(8)  that development shall not begin until details of the scheme of hard and soft landscaping works have been submitted to and approved in writing by the Head of Planning Services: details of the scheme shall include:-

 

 

(i)  soft and hard landscaping works

 

 

(ii) the design, height and finish of the proposed railings, handrail and car park

to ensure that the grounds surrounding the building and the proposed car park are finished to a satisfactory level to enhance the visual quality of the area;

 

 

(9)  that details of the infill treatment to the former double door in the east elevation shall not be as shown on the approved drawing no. 787/03B, but shall be the subject of alternative treatment, details of which shall be submitted to and approved by the Head of Planning Services in consultation with Historic Scotland's Building Inspectorate, to ensure that the external works proposed are appropriate for the listed building and thereby maintain the visual quality of the area; and

 

 

(10)  that the 3 obelisks shall remain within the amenity/garden ground, to preserve historical features within the former burial ground; and

(b) That the listed building application be referred to Historic Scotland with a recommendation that listed building consent be issued subject to the following conditions:-

(2)  that the 12 car parking spaces indicated on the proposed site plan drawing no. P/WD2 shall be formed prior to the occupation of the annex hereby approved, to prevent car parking on Torr Road;

 

 

(3)  that development shall not begin until samples of materials to be used on external surfaces of the building have been submitted to and approved in writing by the Head of Planning Services; Ä

 

 

(4)  that details of the design of the external doors and windows shall be submitted to and approved by the Head of Planning Services prior to work commencing on site, conditions (3) and (4) being imposed to ensure that the annex complements the external appearance of the existing building and thereby maintains the visual quality of the area;

PLANNING APPEAL

There was submitted a report dated 22 August 2001 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 4 April 2001 to refuse planning permission for the erection of a balcony at 11 Edinburgh Drive, Gourock (IC/01/57) and the subsequent appeal by the applicant to the Scottish Ministers against that refusal, the Reporter appointed by the Scottish Ministers had issued his decision which was to dismiss the appeal.

There was submitted a report dated 20 August 2001 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 4 April 2001 to refuse an application for an illuminated advertising hoarding at Bruce Street/Inverkip Street, Greenock (CA/00/47) and the subsequent appeal by the applicant to the Scottish Ministers against that refusal, the Reporter appointed by the Scottish Ministers had issued his decision which was to dismiss the appeal.

There was submitted a report dated 15 August 2001 by the Director of Legal & Support Services recommending the making of a Traffic Regulation Order to introduce no waiting, no loading at any time restrictions on Dunlop Street, Greenock in the vicinity of Notre Dame High School.

 

 

Decided:  that The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order to introduce no waiting, no loading at any time restrictions on Dunlop Street, Greenock in the vicinity of øNotre Dame High School and thereafter that it be remitted to the Head of Transportation & Roads Service and the Director of Legal & Support Services to arrange for implementation of the Order.
