Present:  Councillors Blair, Campbell, Hunter (for Calvert), McCormick, McGhee, Morrison (M) and Robertson (Y).

 

 

Chair:  Councillor McCormick presided.

PLANNING APPLICATIONS

There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

(a)

 

Erection of Dwellinghouse:

Lochwinnoch Road, Kilmacolm (IC/01/144)

 

 

The report recommended that planning permission be granted subject to a number of conditions.

 

 

(Councillor Robertson entered the meeting during consideration of this item of business).

 

 

Decided:  that consideration of the application be continued for a site visit to be arranged by the Director of Legal & Support Services in consultation with the Convener.

 

(b)

Erection of Dwellinghouse with Integral Garage:

The Hermitage, Burndale Lane, Kilmacolm (IC/01/76)

 

 

The report recommended that planning permission be refused for a number of reasons.

 

 

Decided:  that consideration of the application be continued to allow the Head of Planning Services to discuss the application further with the applicant.

 

(c)

Change of Use from Class 1 Shop to Class 2 Office:

17 Church Street, Port Glasgow (IC/01/175)

The report recommended that the application be notified to the Scottish Ministers in terms of the Town & Country Planning (Notification of Applications) (Scotland) Direction 1997 recommending that planning permission be granted.  

After discussion, Councillor McCormick  moved that the application be notified to the Scottish Ministers in terms of the Town & Country Planning (Notification of Applications) (Scotland) Direction 1997 recommending that planning permission be granted.   As an amendment, Councillor Morrison moved that planning permission be refused as the proposed change of use would be detrimental to the retail viability of Church Street.   On a vote, 3 Members voted for the amendment and 4 for the motion which was declared carried.

(d)

Change of Use from Retail Outlet with Storage to Public House:

14 - 16 Westburn Street, Greenock (IC/01/134)

 

 

The report recommended that planning permission be granted subject to a number of conditions.

 

 

After discussion, Councillor McCormick moved that planning permission be granted subject to the conditions detailed in the report.   As an amendment, Councillor McGhee moved that planning permission be refused as the cumulative effect of the proposed use together with other similar uses in the vicinity would be detrimental to the amenity currently enjoyed by residents in adjacent properties.   On a vote, 2 Members voted for the amendment and 4 for the motion which was declared carried.  

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1) that the development hereby permitted shall be commenced within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2) that details of the proposed ventilation systems be submitted to and approved in writing by the Head of Planning Services within 2 months of the date of this consent and thereafter the premises shall not start trading until the ventilation systems are operational in accordance with details approved by the Head of Planning Services, to protect local residents from nuisance resulting from the disposal of cooking odours; and

 

 

(3)  that noise from the ventilation systems and noise from within the premises shall be inaudible in any residential property, to protect local residents from nuisance resulting from the ventilation systems and noise from within the premises.

Installation of Satellite Dish:

The report recommended that planning permission be granted.

 

 

After discussion, Councillor McCormick moved that planning permission be granted.   As an amendment, Councillor Morrison moved that planning permission be refused as the proposed satellite dish, by virtue of its size and location, would have a detrimental impact on the visual amenity of adjacent residential properties.   On a vote, 1 Member voted for the motion and 6 for the amendment which was declared carried.

The report recommended that planning permission be refused for a number of reasons.

 

 

After discussion, Councillor McCormick moved that planning permission be refused for the reasons detailed in the report.   As an amendment, Councillor Blair moved that planning permission be granted.   On a vote, 2 Members voted for the motion and 5 for the amendment which was declared carried.

 

 

Decided: that planning permission be granted.

 

(h)

Change of Use of Store to Repair Garage and Depository with

Sub-Let Office Space  (in retrospect):

10 Robertson Street, Greenock (IC/01/157)

 

 

Decided:  that planning permission be refused for the following reasons:-

 

 

(1)  as the proposal is contrary to Local Plan Policy DCo(ii) which states:-

 

 

"Within the zone in the vicinity of Campbell Street, Ardgowan Square, Kelly Street and Brougham Street only development or change of use to residential or office will be permitted"; and

 

 

(2)  as the unauthorised use of the premises has introduced an intensive general industrial use to the detriment of the quality of residential amenity previously enjoyed in Robertson Street.

 

(i)

Erection of 18 Flats:

South Street, Greenock (IC/01/155)

 

 

The report recommended that planning permission be granted subject to a number of conditions.

 

 

Decided:  that consideration of the application be continued for a site visit to be arranged by the Director of Legal & Support Services in consultation with the Convener.

 

(j)

Erection of Extension:

Decided:  that planning permission be granted.

 

(k)

Erection of Dwellinghouse (in outline):

Manor Crescent, Gourock (IC/01/182)

 

 

 

Decided:  that planning permission be refused as the site is of insufficient area to accommodate a dwellinghouse and associated ground in accord with the established building pattern in the locality.

 

(l)

Change of Use from Retail Unit (Class 1) to Coffee Shop (Class 3) (in retrospect):

66 - 68 Kempock Street, Gourock (IC/01/159)

 

 

Decided: that planning permission be granted subject to the following conditions:-

 

 

(1)  that the use hereby permitted shall not operate before the hours of 9.00 am or after 6.00 pm Monday to Saturday and not before 12.30 pm or after 5.00 pm on Sundays,  to protect occupants of adjacent housing from noise/disturbance late in the evening; and

 

 

(2)  that no deep fat  fryers and/or oil fryers shall be installed within the premises, to protect local residents from nuisance resulting from the disposal of cooking odours.

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development hereby permitted shall be commenced within 5 years of the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and

 

 

(2)  that development shall not begin until details of the proposed fencing, as indicated on the approved plan, have been submitted to and approved in writing by the Head of Planning Services, development shall thereafter be carried out using the approved details or such alternatives as may be approved by the Head of Planning Services, to ensure that the fencing provides effective screening of the proposed conservatory from adjacent properties.

(1)  that the advertisements displayed shall be maintained in a clean and tidy condition to the reasonable satisfaction of the Head of Planning Services;

 

 

(2)  that the sign shall be maintained in a safe condition to the reasonable satisfaction of the Head of Planning Services;

 

 

(3)  that should this advertisement be required under the Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984  to be removed the removal thereof shall be carried out to the reasonable satisfaction of the Head of Planning Services;

Decided:  that advertisement consent be refused as the proposed display panels would contribute to advertisement clutter and be detrimental to the visual amenity of the Retail Park and Waterfront generally.

Display of a Freestanding Illuminated Advertising Hoarding:

Port Glasgow Road, Greenock (CA/01/20)

 

 

Decided:  that advertisement consent be refused as the proposed hoarding, when added to the large number of existing hoardings on both sides of the A8 between Port Glasgow and Greenock, would create advertisement clutter to the detriment of the quality of the visual amenity that the Council is committed to improving through the A8 Road Corridor Environmental Improvement programme.

 

(d)

Display of a Freestanding Illuminated Advertising Hoarding:

East Hamilton Street, Greenock (CA/01/16)

 

 

Decided:  that advertisement consent be refused for the following reasons:-

 

 

(1)  as the proposed hoarding, when added to the large number of existing hoardings on both sides of the A8 between Port Glasgow and Greenock, would create advertisement clutter to the detriment of the quality of the visual amenity that the Council is committed to improving through the A8 Road Corridor Environmental Improvement programme;

 

 

(2)  as the proposal is contrary to policy DCn(iii) of the Inverclyde Local Plan which states "New development adjacent to a listed building must not affect its character and therefore careful consideration will be given to the scale and appearance of any proposal...." in that the proposed hoarding will adversely impact on the setting of the Titan Crane when viewed from the west; and ’

 

 

(3)  as the proposal is contrary to paragraph 10.1.0 of Historic Scotland's Memorandum of  Guidance on Listed Buildings and Conservation Areas which states "At all times the listed building should remain the focus of its setting.   Attention must never be distracted by the presence of any new development whether it be within or outwith the curtilage." in that the proposed hoarding will adversely impact on the setting of the Titan Crane when viewed from the west.

Display of 2 Freestanding Illuminated Advertising Hoardings:

Main Street, Greenock (CA/01/21)

 

 

Decided:  that advertisement consent be refused as the proposed hoardings, when added to the large number of existing hoardings on both sides of the A8 between Port Glasgow and Greenock, would create advertisement clutter to the detriment of the quality of the visual amenity that the Council is committed to improving through the A8 Road Corridor Environmental Improvement programme.

 

(f)

Display of 2 Freestanding Illuminated Advertising Hoardings:

Clarence Street, Greenock (CA/01/19)

 

 

Decided:  that advertisement consent be refused as the proposed hoardings would have a detrimental impact on the visual amenity of the location by virtue of their size and location.

 

(g)

Display of 2 Freestanding Illuminated Advertising Hoardings:

Brougham Street, Greenock (CA/01/18)

 

 

Decided:  that advertisement consent be refused for the following reasons:-

 

 

(1)  as the proposed hoardings, when added to the adjacent bridge sign, would create advertisement clutter to the detriment of the quality of the established visual amenity; and

 

 

(2)  as the proposed hoardings, by virtue of their location directly to the front of an area of established trees, would be to the detriment of the quality of the established visual amenity.

 

(h)

Display of 4 Freestanding Illuminated Advertising Hoardings:

Union Street, Greenock (CA/01/17)

 

 

Decided:  that advertisement consent be refused as the proposed hoardings would introduce a dominant and incongruous element to the established streetscape to the detriment of the visual quality of the location, including the adjacent Greenock West End Conservation Area and the listed buildings at 21, 27, 29 and 34 - 40 Union Street and St Andrews Church.

PLANNING APPEAL

There was submitted a report dated 17 July 2001 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 4 October 2000 to refuse an application for alterations and change of use to form a hot fooÿd take-away at 50 - 52 Sinclair Street, Greenock (IC/00/233), and the subsequent appeal by the applicant to the Scottish Ministers against that refusal, the Reporter appointed by the Scottish Ministers had issued his decision which was to uphold the appeal and grant planning permission subject to conditions.

There was submitted a report dated 17 July 2001 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 7 March 2001 to refuse an application for change of use from retail to hot food take-away and the erection of a flue at 2 Grosvenor Road, Greenock (IC/00/308), and the subsequent appeal by the applicant to the Scottish Ministers against that refusal, the Reporter appointed by the Scottish Ministers had issued his decision which was to uphold the appeal and grant planning permission subject to conditions.

There was submitted a report dated 6 June 2001 by the Director of Legal & Support Services recommending the making of a Traffic Regulation Order to prohibit goods vehicles exceeding 7.5 tonnes mgw (except for access) on Victoria Road from its junction with Moorfield Road to its termination at Ashton Road.

 

 

Decided:  that The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order to prohibit goods vehicles exceeding 7.5 tonnes mgw (except for access) on Victoria Road from its junction with Moorfield Road to its termination at Ashton Road and thereafter that it be remitted to the Head of Transportation & Roads Service and the Director of Legal & Support Services to arrange for implementation of the Order.
