PLANNING APPLICATION SUBMITTED FOR CONTINUED CONSIDERATION

There was submitted a report dated 28 May 2001 by the Head of Planning Services regarding an application by Mr J Miller for the erection of 10 new build flats and conversion of outbuildings to 2 dwellinghouses at Bogside Farm, Millhouse Road, Inverkip (IC/00/314), consideration of which had been continued from the meeting held on 2 May 2001 to allow the applicant to investigate the issue of ownership of land required to carry out improvement works to Millhouse Road.

 

 

The report recommended that planning permission be granted subject to a number of conditions.

 

 

Decided:  that consideration of the application be continued further pending clarification of land ownership issues.

There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

(a)

Erection of 24 Flats:

Seaside Heights, Undercliff Road, Wemyss Bay (IC/01/90)

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development hereby permitted shall be commenced within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

(2)  that development shall not begin until samples of all materials to be used on external surfaces of the building have been submitted to and approved by the Head of Planning Services in writing, development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing with the Head of Planning Services, to ensure that the selected materials are sympathetic to the buil§.t form of the area surrounding the site; and

(3)  that none of the flats shall be occupied until the parking layout detailed in docquetted drawing AL(0)03A has been completed, to prevent obstructive parking on Undercliff Road and in the interests of road safety.

 

(b)

Extension to Dwellinghouse:

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within 5 years of the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and

 

 

(2)  that prior to the commencement of work on site a revised site plan indicating two off road parking spaces shall be submitted and the spaces shall be provided prior to the occupation of the extension hereby approved, to ensure that adequate off-street parking is provided to serve the extended dwelling.

 

(c)

Change of Use of Shop (Class 1) to Mortgage Shop (Class 2):

Decided:  that planning permission be granted.

 

(d)

Amendment to Planning Consent  IC/99/67 to include Erection of

 Kitchen Extract Flue and Laundry Extract Flue:

Alt-na-Craig House, Lyle Road, Greenock (IC/01/109)

 

 

Decided:  that planning permission be granted subject to following conditions:-

 

 

(1) that the kitchen extract flue and laundry extract flue shall be erected and fully operational within 2 months of the date hereof, to obviate odour and noise nuisance to adjoining residential properties;

 

 

(2)  that the two flues shall be internally damped and have  antivibration mounting, details of same being submitted for the prior written approval of the Head of Planning Services in consultation with the Head of Environmental and Consumer Services, to obviate noise nuisance; and 

 

 

(3)  that the two flues shall be painted to match the colours of the residential home within 2 months of the date hereof.   Colour samples shall be submitted to and approved by the Head of Planning Services prior to the commencement of painting, to minimise the visual impact of the two extract flues.

(e)

Formation of Family Area at Trafalgar Street and Extension of

Existing Patio at Roxburgh Street:

Decided:  that planning permission be refused as the proposed development would introduce noise and activity to the detriment to the quality of residential amenity that is currently enjoyed and contrary to Policy Hn of the Inverclyde Local Plan, which opposes development detrimental to maintaining the predominantly residential character.

 

 

(f)

Repairs, Alterations and Extension to Rear of Property:

Abbeyfield House, 9 Ardgowan Square, Greenock (IC/00/93R & LB/01/4)

 

 

Decided:  that planning permission and listed building consent be granted subject to the following conditions:-

 

 

(1)  that the development hereby permitted shall be commenced within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997 and Section 16 of the Planning (Listed Buildings and  Conservation Areas) (Scotland) Act 1997; 

 

 

(2)  that  development shall not begin until samples of materials to be used on all external finishes have been submitted to and approved in writing by the Head of Planning Services,   development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing with the Head of Planning Services;

 

 

(3) that development on site shall not begin until details of the design and opening mechanism of the new timber windows have been submitted to and approved in writing by the Head of Planning Services, development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing with the Head of Planning Services, conditions (2) and (3) being imposed to ensure that the external finishes are appropriate within the Conservation Area;

 

 

(4)  that development on site shall not begin until trees to be retained have been protected by suitable fencing,  details of this fencing shall be submitted for the consideration of the Head of Planning Services and work shall not begin until the written approval of the Head of Planning Services has been given, to ensure that trees to be retained are adequately protected during the construction period; and

 

 

(5)  that no trees or shrubs shall be removed during the bird breeding season of March to June inclusive, to protect breeding birds.

 

(g)

Residential Development Incorporating Special Needs Housing:

Old Inverkip Road, Greenock (IC/01/130)

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development hereby permitted shall be commenced within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)  that access to individual parking spaces and the car parking court shall take the form of a footway crossover, to enable vehicles to enter and leave the road in a safe manner;

(3)  that prior to the occupation of the final dwellinghouse the footway to the frontage of the development be reconstructed and incorporate street lighting in accordance with the Council's Roads Development Guide, to assist in safe pedestrian movement;

(4)  that the gradient of the individual parking spaces shall not exceed 1 in 10, with the first 2 metres being surfaced in an impervious material, to enable the safe use of off street car parking spaces;

 

 

(5)  that development  shall not begin until samples of materials to be used on the external surfaces of the buildings and in the construction of the ramps, individual parking spaces and the car parking court have been submitted to and approved by the Head of Planning Services, development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing by the Head of Planning Services; 

 

 

(6)  that details of the height and design of all boundary walls, fences and ramps shall be submitted to and approved in writing by the Head of Planning Services prior to work commencing, development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing by the Head of Planning Services, conditions (5) and (6) being imposed to ensure the development of a site of appropriate visual quality;

 

 

(7)  that development shall not begin until details of the scheme of soft landscaping works have been submitted to and approved in writing by the Head of Planning Services.   Details of the scheme of soft landscaping works shall include:

 

 

(i)    location of new trees, shrubs, hedges and grassed areas;

 

 

(ii)   schedule of plants to comprise species, plant sizes and proposed numbers/density;

 

 

(iii)  programme for completion and subsequent maintenance;

 

 

(8)  that all hard and soft landscaping works shall be carried out in accordance with the scheme approved in writing by the Head of Planning Services; and

 

 

(9)   that any soft landscaping which, in the opinion of the Head of Planning Services, is dying, severely damaged or diseased within 5 years of planting shall be replaced by landscaping of a similar specification to that already planted, conditions (7) - (9) being imposed to ensure that landscaping makes a positive contribution to the landscape quality of the area.

 

(h)

Variation of Condition 6 attached to Planning Permission IC/97/289 and

Erection of Sculpture Maquette:

Rue End Street/Cathcart Street, Greenock (IC/01/94 & IC/01/95)

 

 

Decided: 

 

 

(a)  that planning application IC/01/94 for the variation of condition 6 attached to planning permission IC/97/289 be granted; and

 

 

(b)  that planning application IC/01/95 for the erection of sculpture be granted subject to the following conditions:-

 

 

(1)  that notwithstanding the information shown on docquetted drawing A204/Sculpture 1 no development shall commence until a revised scheme of landscaping has been submitted to and approved by the Head of Planning Services in consultation with the Head of Grounds, Transportation and Cleansing;

(2)  that the approved scheme of landscaping shall be implemented within the first planting season following erection of the sculpture and any specimens that in the subsequent 5 years die, become diseased or are damaged shall be replaced in the next planting season unless the Head of Planning Services gives his prior written consent to any variation that may be sought, conditions (1) and (2) being imposed to ensure the provision of an appropriate setting for the sculpture; and

(3)  that the sculpture shall be erected within 6 months of the date hereof, to ensure the provision of a piece of public art in association with the Dellingburn Street Safeway Store as originally required by condition 6 of planning permission IC/97/289.

 

(i)

Erection of Health and Fitness Centre:

James Watt Dock, Greenock (IC/01/75)

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development hereby permitted shall be commenced within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;  

 

 

(2)  that development shall not begin until samples of all external materials have been submitted to and approved by the Head of Planning Services in writing, development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing by the Head of Planning Services, to ensure that the selected materials are sympathetic to the redevelopment of the James Watt Dock; 

 

 

(3)  that no development shall commence until details of the riverside walkway have been submitted to and approved by the Head of Planning Services.   The approved walkway shall be implemented prior to the fitness centre being opened  to the public, to comply with Policy Lo in the Local Plan; and

 

 

(4)  that the fitness centre shall not be opened to the public until the parking layout detailed on docquetted drawing GREE/CAD-10 has been completed, to ensure appropriate parking provision prior to the commencement of the use.

 

(j)

Installation of Telecommunications Tower, Associated Equipment Cabin and Compound:

Larkfield Industrial Estate, Earnhill Road, Greenock (IC/01/116)

 

 

Decided:  that planning permission be granted.

 

(k)

Change of Use from Football Ground and Vacant Site to form Serviced Plot for Class 4, 5 and 6 Use:

Kelburn, Port Glasgow (NI/01/3)

 

 

Decided:

 

 

(a)  that the application be notified to the Scottish Ministers in terms of the Town and Country Planning (Notification of Applications) (Scotland) Direction 1997 recommending that planning permission be granted;

 

 

(b)  that on completion of the serviced plot, the marketing/development brief shall include the following:

 

 

(i)    that the development shall be the subject of a sustainable urban drainage scheme;

 

 

(ii)   that the maximum floor area shall be 1022 m2, with a maximum parking requirement of 220 vehicles, any development in excess shall require to be the subject of a Traffic Impact Analysis; and

 

 

(c)  that negotiations continue with Port Glasgow Juniors Football Club and Sportscotland to afford the football club all reasonable opportunities to relocate within Port Glasgow.

 

(l)

Installation of Replacement Windows:

Decided:  that planning permission be granted.

 

(m)

Erection of Extension to Dwellinghouse:

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development hereby permitted shall be commenced within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and 

 

 

(2)  that  development shall not begin until samples of roof materials have been submitted to and approved in writing by the Head of Planning Services,   development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing by the Head of Planning Services, to ensure the roof materials match the existing roof.

There was submitted a report dated 9 May 2001 by the Director of Legal & Support Services advising that following the decision of the Sub-Committee at the meeting held on 4 April 2001 to request the Scottish Executive to determine the appeal against the refusal of planning permission for the erection of 4 dwellinghouses at Hydro House, West Glen Road, Kilmacolm (IC/00/92R) by way of a Public Local Inquiry (1) the Scottish Executive had now confirmed that an Inquiry was to be held and (2) requesting that a Member of the Sub-Committee be appointed to appear as a witness in support of the decision to refuse planning permission.

 

 

Decided:  that the Convener notify the Director of Legal & Support Services of the Member to appear as a witness at the Public Local Inquiry.
