The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

PLANNING APPLICATION SUBMITTED FOR CONTINUED CONSIDERATION

There was submitted a report dated 24 April 2001 by the Head of Planning Services regarding an application by A & T Properties for residential development to form 18 flats and associated car parking at the Clyde Lower Reaches Club, Nelson Street, Greenock (IC/00/235R), consideration of which had been continued from the meeting held on 10 January 2001 to allow the applicant to investigate the purchase of the adjacent landscaped area for the provision of car parking.

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1) that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)  that details and samples of the proposed curtain walling shall be submitted to the Head of Planning Services and approved in writing prior to work commencing on site;

 

 

(3)  that details of the design and opening mechanism of the new timber windows shall be submitted to the Head of Planning Services and approved in writing prior to work commencing on site;

 

 

(4)  that details of the new entrance door on the rear elevation and associated bridge link to the car park shall be submitted to the Head of Planning Services and approved in writing prior to work commencing on site;

 

 

(5)  that the details of the design and construction of the proposed bin stores shall be submitted to the Head of Planning Services and approved in writing prior to work commencing on site, conditions (2) - (5) being imposed in the interests of the visual amenity of the immediate area; 

 

 

(6)  that details of the design and operating mechanism of the access barrier to the car park shall be submitted to the Head of Planning Services and approved in writing prior to work commencing on site;

 

 

(7)  that the 17 car parking spaces indicated on drawing number 300/05 shall be formed prior to the occupation of the 18 flats herein approved and retained thereafter for the exclusive use of the occupants of the flats, conditions (6) and (7) being imposed to ensure that the car park is solely used for residents' parking; and

 

 

(8)  that the access to the car park shall take the form of a footway crossover, to ensure safe vehicular access to and from the car park.

There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

(a)

Change of Use from Travel Agent to Coffee Shop:

1 Drumpellier Place, Lochwinnoch Road, Kilmacolm (IC/01/73)

 

 

(Councillor Blair entered the meeting during consideration of this item of business).

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1987;

 

 

(2)  that the use hereby permitted shall not operate between the hours of 6.00 pm and 9.00 am Monday to Saturday and not before 11.00 am or after 4.00 pm on Sundays, to protect occupants of nearby housing from noise/disturbance late in the evening;

 

 

(3)  that the use hereby permitted shall not start trading until ventilation systems are operational in accordance with details approved in writing by the Head of Planning Services; and

 

 

(4)  that the existing extractor fans located within the existing windows on the elevation to Elphinstone Court be removed prior to the use hereby permitted commencing, conditions (3) and (4) being imposed to protect local residents from nuisance resulting due to the disposal of cooking odours.

 

(b)

Change of Use of Disused Farm Buildings to 2 Dwellinghouses:

Dykefoot Farm, Kilmacolm (IC/01/12R)

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within five years of the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and

 

 

(2)  that the first 10m of the farm access track adjoining the public road shall be surfaced in impervious material, prior to either of the two house conversions being occupied, to the satisfaction of the Head of Planning Services in consultation with the Head of Transportation and Roads Service, in the interests of road safety.

Erection of Dwellinghouse (In Outline):

The report recommended that planning permission be refused for a number of reasons.

 

 

After discussion, Councillor Morrison moved that planning permission be granted subject to reserved matters conditions relative to access, design of the dwellinghouse and landscaping.   As an amendment, Councillor McGhee moved that planning permission be refused for the reasons detailed in the report.   On a vote, 2 Members voted for the motion and 5 for the  amendment which was declared carried.

 

 

Decided:  that planning permission be refused for the following reasons:-

 

 

(1)  as the proposals would result in the loss of open amenity ground associated with planning permissions approved in respect of the site to the detriment of the setting and layout of the development; and

 

 

(2)  as the site may not be developed to incorporate private garden ground to the detriment of the visual amenity of the locality and residential amenity of the occupants.

 

(d)

Erection of Dog Kennels:

Old Filter Station House, Dougliehill Road, Port Glasgow  (IC/01/68)

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and

 

 

(2)  that the dog kennels shall not be brought into operation until 6 off street parking spaces have been formed, an access has been formed into the site, constructed in accordance with the Council's Roads Development Guide and the existing pillar at the site entrance removed or reduced in height to 1 metre to allow safe sightlines, all to the satisfaction of the Head of Planning Services in consultation with the Head of Transportation and Roads Service, in the interests of road safety on Dougliehill Road.

 

(e)

Change of Use from Class 1 (Retail) to Class 3 (Hot Food) and Hot Food Take-Away:

 

 

Units 16 and 17, Clyde Square, Greenock (IC/01/64)

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within five years from the date of this permission,  to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and 

 

 

(2)  that the premises shall not start trading until ventilation systems are submitted to and approved in writing by the Head of Planning Services and thereafter implemented in accordance with the approved system, to protect local residents and visitors to the Oak Mall from nuisance resulting from the disposal of cooking odours.

Change of Use of Flat to Flat and Childminding Premises:

First Floor, 9 Robertson Street, Greenock (IC/01/78)

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and 

 

 

(2)  that the childminding business be limited to 2 children, to maintain the quality of residential amenity existing within the tenement at 9 Robertson Street, Greenock.

 

(g)

Erection of 4 Lock Up Garages:

51 Union Street, Greenock (IC/01/23R)

 

 

Decided:  that planning permission be refused as the constraints of the site dictate that the proposed garages would be built directly behind the footway, resulting in vehicles being parked across the carriageway of Forsyth Street and/or the pavement while drivers open/close the garage doors to the detriment of pedestrian and vehicular safety.

 

(h)

Erection of Garage and Boundary Fencing (Partially in Retrospect):

142 Newton Street, Greenock (IC/01/85)

 

 

Decided:  that planning permission be granted.

 

(i)

Erection of 2 Dwellinghouses:

177 Eldon Street, Greenock (IC/01/19R)

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)  that no permission is granted for the tree removal detailed on docquetted plan 00/34/04  and that prior to the commencement of work on site a revised tree survey shall be undertaken and a detailed landscaping plan shall be submitted to include

 

 

(i)  indication of existing trees and shrubs to be removed, those to be retained and, in the case of damage, proposals for their restoration;

 

 

(ii)  location of new trees and shrubs;

 

 

(iii) schedule of plants to comprise species, plant sizes and proposed numbers/densities;

 

 

(iv) programme for completion and subsequent maintenance;

 

 

Development shall not commence until such time as a landscaping plan is approved in writing by the Head of Planning Services;

 

 

(3)  that all landscaping works shall be carried out in accordance with a scheme approved in writing by the Head of Planning Services;

(4)  that any trees or shrubs on the site which, in the opinion of the Head of Planning Services, are dying, severely damaged or diseased within five years of planting shall be replaced by trees or shrubs of a similar specification to those originally planted, conditions (2) - (4) being imposed to maintain the contribution of the existing site to the landscape quality of the area;

(5)  that no development shall commence until details of boundary treatments within the site together with details of driveway surfacing have been submitted to and approved by the Head of Planning Services in writing, to ensure that the quality of internal boundary treatments and driveway surfacing is sympathetic to the quality of visual amenity in the Greenock West End Conservation Area; and

 

 

(6)  that no development shall commence until details of the proposed fenestration,  including all windows, doors and rooflights, have been submitted to the Head of Planning Services and approved in writing, to ensure detailed finishes appropriate for the Greenock West End Conservation Area.

 

(j)

Erection of Extension to Dwellinghouse and Garage:

36 Oxford Avenue, Gourock (IC/01/86)

 

 

Councillor Blair declared an interest in this matter and took no part in its consideration or decision.

 

 

Decided:  that planning permission be granted. 

 

(k)

Change of Use from Nursing Home to 6 Flats and Erection of 8 New Flats:

Langhouse, Langhouse Road, Inverkip (IC/00/310R & LB/00/20R)

 

 

Councillor Blair declared an interest in this matter and took no part in its consideration or decision.

 

 

Decided:

 

 

(a)  that listed building consent be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 16 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997; 

 

 

(2)  that details of all slates, leadwork, downpipes, gutters, stonework, windows and external doors to be replaced/repaired shall be submitted to and approved by the Head of Planning Services in respect of design and material, prior to the commencement of work on site, for the avoidance of doubt all works shall replicate those as original; and  

 

 

(3)  that details of all proposed new internal works, including alterations to walls, ceilings and doors shall be submitted to and approved in writing by the Head of Planning Services in respect of design, materials, colour and texture prior to the commencement of work on site, for the avoidance of doubt all existing cornices, ceiling roses, ceiling heights and original doors shall be retained: conditions (2) and (3) being imposed  in the interests of the architectural integrity of the grade B listed building; and

 

 

(b)  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development to which this permission relates must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)  that the eight new building flats shall not be occupied until the conversion of the grade B listed Langhouse into six flats has been completed in accordance with the docquetteddrawing, to ensure the reuse of the listed building and to justify the eight new build flats in the greenbelt; 

 

 

(3)  that none of the flats shall be occupied until the parking layout shown and roads improvements detailed on the docquetted drawings have been completed, to allow the approved development to be safely accessed and to prevent obstructive parking on Langhouse Road; and 

 

 

(4)  that no developments shall commence until samples of all external materials have been submitted to and approved by the Head of Planning Services in writing, to ensure that the selected materials are sympathetic to the grade B listed Langhouse.

 

(l)

Erection of 10 New Build Flats and Conversion of Outbuildings to 2 Dwellinghouses:

Bogside Farm, Millhouse Road, Inverkip (IC/00/314)

 

 

The report recommended that, subject to the application being referred to the Scottish Ministers in terms of the Town and Country Planning (Notification of Applications) (Scotland) Direction 1997, planning permission be granted subject to a number of  conditions.

 

 

The Convener orally advised the Sub-Committee that the report had been withdrawn and would be submitted to the next meeting for consideration.

 

 

Decided:  that the withdrawal of the report be noted.

 

(m)

Increase in Size of Rear Balcony (In Retrospect):

15 Primrose Avenue, Inverkip (IC/01/55)

 

 

Decided:  that planning permission be granted subject to the condition that the screen trellis detailed in the docquetted drawing shall be erected within 28 days of the date of this permission and thereafter maintained in perpetuity, to preclude the overlooking of adjoining property and in the interests of residential amenity.

PLANNING APPEAL

There was submitted a report dated 17 April 2001 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 7 March 2001 to refuse an application for change of use from retail to hot food take-away and the erection of a flue at 2 Grosvenor Road, Greenock (IC/00/308), an appeal against the refusal of planning permission had been made to the Scottish Ministers.

There was submitted a report dated 17 April 2001 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 6 December 2000 to refuse an application for change of use from retail/storage to registered private members club at 36 Princes Street, Port Glasgow (IC/00/272), and the subsequent appeal by the applicant to the Scottish Ministers against that refusal, the Reporter appointed by the Scottish Ministers had issued his decision which was to dismiss the appeal.
