PLANNING
APPLICATION SUBMITTED FOR CONTINUED CONSIDERATION |

|
There was submitted a report dated 16 March 2001 by the Head of Planning Services regarding an application by Quality Gas Services Ltd for change of use from garage showroom to retail plumbing and heating showroom at 10 Eldon Street, Greenock (IC/01/22), consideration of which had been continued from the meeting held on 7 March 2001 to allow the Head of Planning Services, in consultation with the Head of Transportation & Roads Service, to have discussions with the applicant relative to the proposed parking layout. |

The report recommended that planning permission be refused as the proposal is contrary to Local Plan policy DCo(iv) which states "within the remainder of the West End only development or change of use to residential will be permitted" in that the proposal is for a use which is not compatible with the surrounding amenity. |
|
|
Councillor Blair declared an interest in this matter and took no part in its consideration or decision. |
|
|
After discussion, Councillor McCormick moved that planning permission be refused for the reason detailed in the report. As an amendment, Councillor Morrison (M) moved that planning permission be granted subject to the following conditions: (1) that prior to the commencement of the use hereby permitted the car parking layout as shown on the approved Drawing 2101.04A shall be implemented to the satisfaction of the Head of Planning Services; (2) that access to the site shall be by means of a footway crossover with a minimum width of six metres with the rest of the frontage being defined by a structure not exceeding one metre in height, details of the above shall be submitted to and approved by the Head of Planning Services in writing and thereafter implemented prior to the commencement of the use hereby permitted, conditions (1) and (2) being imposed in the interests of road safety on Eldon Street; and (3) that prior to any excavations on the forecourt a Risk Assessment in relation to the former petrol tanks shall be carried out and submitted to and approved by the DHead of Planning Services in writing, in the interests of public safety on Eldon Street and in adjoining residential properties. |

On a vote, 1 Member voted for the motion and 3 for the amendment which was declared carried. |
|
|
Decided: that planning permission be granted subject to the following conditions:- |
|
|

There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:- |

Decided: that planning permission be refused as the proposed balcony by virtue of its size and proximity to adjacent properties, would have a detrimental effect on the privacy of adjacent neighbours. |

from Retail Shop to Hot Food Take-Away: 18 East Crawford
Street, Greenock (IC/01/50) |

Decided: that planning permission be refused for the following reasons:- |
|
|
(1) as the proposed mechanical extract ventilation system discharging at ground floor level at the rear of the property would create odour nuisance for the flats directly above and adjoining the property to the severe detriment of the quality of residential amenity that is currently enjoyed; and |
|
|
(2) as the proposed use would have a detrimental impact on the established amenity of nearby residents by virtue of potential generation of noise, disturbance and nuisance. |

The report recommended that planning permission be refused as the proposal would be to the detriment of the quality of visual amenity that is currently enjoyed from the top of Clune Brae over the Firth of Clyde. |
|
|
Councillor Blair declared an interest in this matter and took no part in its consideration or decision. |
|
|
After discussion, Councillor Morrison (M) moved that planning permission be refused for the reason detailed in the report. As an amendment, Councillor Hunter moved that planning permission be granted subject to the following conditions: (1) that the maximum area for the display of cars for sale shall be 246 square metres as shown on approved drawing 390.01 with no more than 12 cars for sale being displayed at any one time; and (2) that the car parking layout shown on approved drawing 390.01 shall be implemented prior to the commencement of the use hereby permitted and shall thereafter be retained and maintained at all times to the satisfaction of the Head of Planning Services. |

On a vote, 1 Member voted for the amendment and 4 for the motion which was declared carried. |
|
|
Decided: that planning permission be refused as the proposal would be to the detriment of the quality of visual amenity that is currently enjoyed from the top of Clune Brae over the Firth of Clyde. |

There was submitted a report dated 21 March 2001 by the Head of Planning Services on an application for the display of an illuminated advertising hoarding at Bruce Street/Inverkip Street, Greenock (CA/00/47). |
|
|
Decided: that advertisement consent be refused for the following reasons:- |
|
|
(1) as the proposed hoarding would introduce a dominant and incongruous element to the junction of Bruce Street and Inverkip Street to the detriment of the quality of visual amenity that is currently enjoyed; and |
|
|
(2) as the proposed hoarding would threaten the structural integrity of the parapet wall adjoining Bruce Street to the detriment of road safety. |

There was submitted a report dated 21 March 2001 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 1 November 2000 to refuse an application for the erection of 4 dwellinghouses at Hydro House, West Glen Road, Kilmacolm (IC/00/92R), an appeal against the refusal of planning permission had been made to the Scottish Ministers. The report advised that the appeal would be determined by written submission. |

Decided: |
|
|
(1) that the appeal to the Scottish Ministers against the refusal of planning permission be noted; and |
|
|
(2) that the Director of Legal & Support Services request the Scottish Executive to determine the appeal by way of a Public Local Inquiry.

There was submitted a report by the Director of Legal & Support Services recommending the making of a Traffic Regulation Order to restrict the entire length of Golf Drive, Port Glasgow to one way only in an anti clockwise direction (generally southwards). |

Decided: that The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order to restrict the entire length of Golf Drive, Port Glasgow to one way only in an anti clockwise direction (generally southwards) and thereafter that it be remitted to the Head of Transportation & Roads Service and the Director of Legal & Support Services to arrange for implementation of the Order. |

There was submitted a report by the Director of Legal & Support Services recommending the making of a Traffic Regulation Order to restrict parking within designated parking places at various locations in Gourock, Greenock, Port Glasgow and Kilmacolm to disabled persons displaying a badge under the appropriate regulations only. |
