Present:  Councillors  Blair,  Campbell,  Hunter, McCormick, McGhee and Morrison (M).

 

 

Chair:  Councillor McGhee  presided.

 

 

In attendance:  Depute Chief Executive, Miss M McKnight (for Director of Legal & Support Services), Head of Planning Services and Mr A Bruce (for Head of Transportation & Roads Service).

 

 

With the exception of the decision marked "C" which is open for confirmation or otherwise the following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

PLANNING APPLICATION SUBMITTED FOR CONTINUED CONSIDERATION

There was submitted a report dated 21 February 2001 by the Head of Planning Services regarding an application by M Fulton and G McLaughlin for change of use from retail to hot food take away and the erection of a flue at 2 Grosvenor Road, Greenock (IC/00/308), which had been referred back to the Sub-Committee for consideration de novo by The Inverclyde Council at the meeting held on 15 February 2001.

 

 

The report recommended that planning permission be refused as the proposed use would have a detrimental impact on the established amenity of the nearby residential properties by virtue of the potential generation of noise disturbance and nuisance.

 

 

After discussion, Councillor McGhee moved that planning permission be refused for the reason detailed in the report.  As an amendment, Councillor Morrison (M) moved that planning permission be granted subject to the following conditions: (1) that the development shall be commenced within 5 years from the date of this permission; (2) that development shall not begin until samples of materials to be used on all external surfaces of the building have been submitted to and approved in writing by the planning authority and development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing with the planning authority; (3) that development shall not begin until details of an extract ventilation system have been submitted to and approved in writing by the planning authority and development shall thereafter be carried out using the approved system or such alternatives as may be agreed in writing with the planning authority; and (4) that the premises shall close at 11 pm. 

 

 

On a vote, 3 Members voted for the motion and 3 for the amendment.   There being equality in voting, the Convener exercised his casting vote in favour of the motion which was declared carried.

 

 

Decided:  that planning permission be refused as the proposed use would have a detrimental impact on the established amenity of the nearby residential properties by virtue of the potential generation of noise disturbance and nuisance.

There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

(a)

Alterations and Extension to Dwellinghouse:

The Ridge, Barclaven Road, Kilmacolm (IC/01/6)

 

 

(Councillor Hunter left the meeting during consideration of this item of business).  

 

 

Decided:  that planning permission be granted subject to the condition that the development hereby permitted shall be commenced within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997.

 

(b)

Change of use from Health Suite to provide Extension to Licensed Bar:

210 Dalrymple Street, Greenock (IC/01/17)

 

 

Councillor Blair declared an interest in this matter and took no part in its consideration or decision.

 

 

(Councillor Hunter returned to the meeting during consideration of this item of business).

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development hereby permitted shall be commenced within 5 years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and

 

 

(2)   that development shall not begin until a scheme of acoustic insulation for all windows and doors has been submitted to and approved in writing by the Head of Planning Services and the development shall not be brought into use until the measures approved operate to the satisfaction of the Head of Planning Services, to protect local residents from noise nuisance associated with live and recorded music.

 

(c)

Change of use of Vacant Offices to Day Nursery and Erection of Fence and Gate:

The Coachhouse/Old Stables, Patrick Street, Greenock (IC/01/4)

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the development hereby permitted shall be commenced within 5 years of the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997; and

 

 

(2)  that the use hereby permitted shall not operate between 5.30 pm and 8.00 am Monday to Friday and at any time on Saturday and Sunday, to protect occupants of nearby housing from noise and disturbance in the evenings and early morning and at the weekends.

Change of use from Garage Showroom to Retail Plumbing and Heating Showroom:

The report recommended that planning permission be refused as the proposal is contrary to Local Plan policy DCo(iv) which states "within the remainder of the West End only development or change of use to residential use will be permitted" in that the proposal is for a use which is not compatible with the surrounding residential amenity.

 

 

Councillor Blair declared an interest in this matter and took no part in its consideration or decision.

 

 

Decided:  that consideration of the application be continued to allow the Head of Planning Services, in consultation with the Head of Transportation and Roads Service, to have discussions with the applicant relative to the proposed parking layout.

 

(e)

Erection of 8 Dwellinghouses:

Thom Street/Old Inverkip Road, Greenock (IC/00/318)

 

 

The report recommended that the application be referred to the Scottish Ministers recommending that planning permission be granted subject to a number of conditions.

 

 

The Head of Planning Services orally advised the Sub-Committee that it had been necessary for the applicant to reissue neighbour notification and that, as the 14 day period for objections expired at midnight that night, the recommendation required to be amended accordingly.

 

 

After discussion, Councillor McGhee moved that, subject to no objections being received in response to the neighbour notification, the application be referred to the Scottish Ministers recommending that planning permission be granted subject to the conditions detailed in the report.   As an amendment, Councillor Blair moved that planning permission be refused for the following reasons: (1) as the proposal would constitute overdevelopment on a corner site; (2) as the proposal would lead to undesirable traffic levels which would have an adverse effect on road safety; and (3) as the proposal is contrary to Local Plan policy Ld which reserves the site for a development of open space, primarily for passive and informal recreation.

 

 

On a vote, 3 Members voted for the motion and 3 for the amendment.   There being equality in voting, the Convener exercised his casting vote in favour of the motion which was declared carried.   Those Members who had voted in favour of the amendment then requested, in terms of the relevant Standing Order, that the matter be referred to The Inverclyde Council for decision in terms of the amendment.

 

C

Decided:  that, subject to no objections being received in response to the neighbour notification, the application be referred to the Scottish Ministers recommending that planning permission be granted subject to the following conditions:-

(1)  that the development to which this permission relates  must be begun within five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;

 

 

(2)  that development shall not begin until samples of materials to be used on surfaces of the building have been submitted to and approved in writing by the Head of Planning Services, and development shall thereafter be carried out using the approved materials or such alternatives as may be agreed in writing with the Head of Planning Services, to ensure that the materials selected are in character with the built form of «‚Thom Street/Old Inverkip Road;

 

 

(3)  that development shall not begin until details of the scheme of hard and soft landscaping works have been submitted to and approved in writing by the Head of Planning Services, the details of the scheme shall include:

 

 

(i)          existing landscape features to be retained and, in the case of damage, restored,

 

 

(ii)         location and design, including materials, of walls, fences and gates,     

 

 

(iii)         soft and hard landscaping work,

 

 

(iv)        programme for completion and maintenance,

 

 

to ensure a quality landscape setting for the development;

 

(4) that access to the driveways shall be taken via footway crossovers constructed in accordance with the Council's Road Development Guide, driveway gradients shall not exceed 10% and the first 2 metres of the driveways shall be surfaced in impervious material; and

 

 

(5)  that a scheme for the resurfacing of the footpath fronting the development between plots 1 and 7 and the relocation of the bus stop fronting the site shall be submitted to and approved in writing by the Head of Planning Services and the agreed scheme shall be implemented before any of the houses are occupied, conditions (4) and (5) being imposed to allow for the safe passage of pedestrians on the public highway and to avoid conflict with vehicular traffic using the driveways of the proposed houses.

There was submitted a report dated 15 February 2001 by the Head of Planning Services advising that following the decision of The Inverclyde Council at the meeting held on 24 August 2000 to refuse an application for planning permission for the proposed use of a retail unit as a hot food take-away at 14 Princes Street, Port Glasgow (IC/00/154), an appeal against the refusal of planning permission had been made to the Scottish Ministers.

There was submitted a report dated 14 February 2001 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 4 October 2000 to refuse an application for alterations and change of use to form a hot food take-away at 50-52 Sinclair Street, Greenock (IC/00/233), an appeal against the refusal of planning permission had been made to the Scottish Ministers.
