The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

PLANNING APPLICATION SUBMITTED FOR CONTINUED CONSIDERATION

There was submitted a report dated 22 November 2000 by the Head of Planning Services regarding an application by Iceland Frozen Foods for the erection of a steel platform to house condensing units onto the rear elevation at Iceland Frozen Foods, 42 - 44 Church Street, Port Glasgow (IC/00/161R) consideration of which had been continued from the meeting held on 1 November 2000 to allow the Head of Planning Services to have further discussion with the applicant relative to the noise levels from the condenser units on the site.

 

 

Decided:  that planning permission be granted subject to the condition that plant noise emanating from 42 - 44 Church Street, Port Glasgow shall not exceed Noise Rating Curve 25 within any nearby residential property, in the interests of the amenity of nearby residents.

PLANNING APPLICATIONS

There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

(a)

Erection of a Detached Dwellinghouse:

Houston Road, Kilmacolm (IC/00/268R)

 

 

The report recommended that planning permission be granted subject to a number of conditions.

 

 

After discussion, Councillor McGhee moved that planning permission be granted in accordance with the recommendation of the report. As an amendment, Councillor Blair moved that  planning permission be refused,  on the grounds that the proposed siting of the dwellinghouse would adversely affect the amenity presently enjoyed by neighbouring proprietors. On a vote, 1 Member voted for the amendment and 5 for the motion which was declared carried.¿

 

 

Decided: that planning permission be granted subject to the following conditions:-

 

 

(1)  that no development shall commence until fully detailed tree protection measures have been submitted to and approved by the Head of Planning Services in writing.   The tree protection measures shall be implemented prior to the commencement of and maintained for the duration of the construction works;

 

 

(2)  that the approved scheme of landscaping shall be implemented in first planting season following completion of the house and any specimens that in the subsequent 5 years die, become diseased or are damaged shall be replaced in the next planting season with a similar specimen unless the Head of Planning Services gives his prior written consent to any variation that may be sought, conditions (1) and (2) being imposed to maintain a quality landscaping setting for the house in the conservation area; and

 

 

(3)  that the site shall be accessed by a crossover designed to Inverclyde Council's Roads Development Guide and all surface water shall be intercepted within the curtilage, in the interest of road safety on Houston Road. 

 

(b)

Removal of Planning Condition No. 3 of IC/99/72 and Installation of New Extract Flue to Rear Elevation:

The 'Kafay' 24 Dubbs Road, Port Glasgow (IC/00/271)

 

 

Decided: that planning permission be granted subject to the following conditions:-

 

 

(1)  that all wall mounts shall be anti-vibrational and that the ducting shall be damped to prevent vibration, to the satisfaction of the Head of Planning Services;

 

 

(2)  that any noise from the ventilation system shall be inaudible in any adjoining residential property;

 

 

(3)  that condition No. 3 in planning consent IC/99/72 shall remain until such time as the installation of the extract flue, hereby approved, is installed and operational; and

 

 

(4)  that the flue shall be operational during the hours of opening and at all times outwith operational hours during which food is being prepared, conditions (1), (2), (3) and (4) being imposed in the interests of the residential amenity of the immediate neighbours.

 

(c)

Change of Use from Retail/Storage to Registered Private Members Club:

36 Princes Street, Port Glasgow (IC/00/272)

 

 

The report recommended that planning permission be refused as the proposals would generate late night noise and activity outside the proposed entrance which lies directly opposite residential flats to the detriment of the quality of residential amenity that is currently enjoyed.

 

 

After discussion, Councillor McGhee moved that planning permission be refused as recommended in the report.  As an amendment, Councillor Blair moved that planning permission be granted subject to conditions to ensure noise attenuation and to control midweek opening hours. On a vote, 1 Member voted for the amendment and 6 for the  motion which was declared carried.

 

 

Decided:  that planning permission be refused as the proposals would generate late night noise and activity outside the proposed entrance which lies directly opposite residential flats to the detriment of the quality of residential amenity that is currently enjoyed.æ

 

(d)

Change of Use from Furniture Showroom to Bar/Diner, Cafe Bar and Restaurant:

205 Dalrymple Street, Greenock (IC/00/254)

 

 

Councillor Blair declared an interest in this matter and took no part in its consideration or decision.

 

 

The report recommended that planning permission be granted subject to a number of conditions.

 

 

After discussion, Councillor McGhee moved that planning permission be granted as recommended in the report. As an amendment Councillor Morrison moved that planning permission be refused in the interests of preserving the amenity of the area and to preserve a balance of current uses of the properties in the area.  On a vote, 1 Member voted for the amendment and 5 for the motion which was declared carried.

 

 

Decided:  that planning permission be granted subject to the following conditions:-

 

 

(1)  that the premises shall not open to the public until the mechanical extract ventilation system hereby approved has been installed to the satisfaction of the Head of Planning Services in consultation with the Head of  Environmental & Consumer Services;

 

 

(2)  that the extract ventilation system shall be maintained in perpetuity to the satisfaction of the Head of Planning Services in consultation with the Head of Environmental & Consumer Services, conditions (1) and (2) being imposed to prevent odour nuisance in nearby residential and other properties; and

 

 

(3)  that the premises shall not open to the public until a controlled sound system, the controls of which shall be locked in a tamper proof box, has been installed at a sound level which shall not be audible from within adjacent residential properties all to the satisfaction of the Head of Planning Services in consultation with the Head of Environmental & Consumer Services, to prevent noise nuisance in nearby residential and other properties. 

 

(e)

Erection of a 2 Bedroom New Build Private Dwellinghouse Comprising 2 Storeys with Roof Garden:

Wallace Road, Wemyss Bay (IC/00/250)

 

 

Councillor Blair declared an interest in this matter and took  no part in its consideration or decision.

 

 

Decided: that planning permission be granted subject to the following conditions:-

 

 

(1)  that no development shall commence until samples of all external materials have been submitted to and approved by the Head of Planning Services in writing, to ensure the selection of materials consistent with the built form of the area and in the interests of visual amenity;

 

 

(2)  that no tree felling or surgery shall  be carried out in the bird breeding season running between March and June inclusive in any year, in the interests of the protection of birds;

 

 

(3)  that no trees or shrubs shall be removed from the site until full details of the proposed removals have been submitted to and approved by the Head of Planning Services in writing, to minimise the amount of clear felling and in the interests of visual amenity;

 

 

(4)  that no development shall commence until fully detailed tree protection measures, in accordance with BS 5837: 1991 Guide for Trees in Relation to Construction; NHBC Standard, Chapter 4.2 "Building Neon Trees" (updated 1992) are submitted to and approved by the Head of Planning Services in writing.   The tree protection measures shall be maintained for the duration of the site works, to maximise the retention of trees and in the interests of visual amenity;

 

 

(5)  that prior to the start of any work on site the applicant shall commission a qualified surveyor to carry out a bat survey.   In the event that bats are found on site the applicants shall contact Scottish Natural Heritage for advice on release or relocation and shall act in accordance with the advice, in the interests of the protection of bats; and

 

 

(6)  that all surface water run off shall be intercepted within the site, details of which shall be submitted to and approved by the Head of Planning Services prior to the commencement of work on site, to prevent water run off onto Wallace Road to the detriment of road safety.

PLANNING APPEAL

There was submitted a report dated 21 November 2000 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 1 November 2000 to refuse an application for the change of use of a shop to an amusement arcade with first floor office together with alterations to the shop front at 29 West Blackhall Street, Greenock (IC/00/205), an appeal against the refusal of planning permission had been made to the Scottish Ministers.

There was submitted a report dated 21 November 2000 by the Head of Planning Services on an application by Waterfront Retail Park for the erection of an 8m high externally illuminated free standing directory sign and the westmost corner of the KFC Drive Thru' Unit at the Waterfront Retail Park, Greenock.  (CA/00/45)

 

 

Decided: that consideration of the application be continued for further discussions with the applicants.
