Present:  Councillors Blair, Calvert (for Councillor Campbell), Hunter, McCormick,  Morrison (M) and Robertson (Y).

 

 

Chair:  Councillor McCormick  presided.

 

 

In attendance:  Depute Chief Executive, Miss M McKnight (for Director of Legal & Support Services), Head of Planning Services and Mr G Cooper (for Head of Transportation and Roads Service).

 

 

Apologies:  Councillors Campbell and McGhee.

 

 

With the exception of the decisions marked ‘C’ which are open for confirmation or otherwise, the following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

PLANNING APPLICATIONS SUBMITTED FOR CONTINUED CONSIDERATION

(a)

Erection of Dwellinghouse:

Rowantreehill Quarry, Houston Road, Kilmacolm (IC/00/115R)

 

 

There was submitted a report dated 20 September 2000 by the Head of Planning Services regarding an application by Manor Kingdom Ltd for the erection of a dwellinghouse at Rowantreehill Quarry, Houston Road, Kilmacolm (IC/00/115R), consideration of which had been continued from the meeting held on 6 September 2000 for a site visit.

The report recommended that planning permission be granted subject to a number of conditions.

After discussion, Councillor McCormick moved that planning permission be granted subject to the conditions detailed in the report.  As an amendment, Councillor Calvert moved that planning permission be refused as the proposed siting of the dwellinghouse would have an adverse effect on the amenity of nearby residents.  On a vote, 3 Members voted for the amendment and 3 for the motion.  There being equality in voting the Chairman exercised his casting vote in favour of the motion which was declared carried.  Those Members who had voted for the amendment then requested, in terms of the relevant Standing Order that the matter be referred to the Inverclyde Council for decision in terms of the amendment.

Decided: that planning permission be granted subject to the following conditions:-

(1) that no development shall commence until fully detailed tree protection measures have been submitted to and approved by the Head of Planning Services in writing.   The tree protection measures shall be implemented prior to the commencement of and maintained for the duration of the construction works;

 

 

(2) that the approved scheme of landscaping shall be implemented in the first planting season following completion of the house and any specimens that in the subsequent five years die,  become diseased or damaged shall be replaced  in the next planting season with a similar specimen unless the Head of Planning Services gives his prior written consent to any variation that may be sought,  conditions (1) and (2) being imposed to maintain a quality landscape setting for the house in the conservation area;ý  and

 

 

(3) that the site shall be accessed by a crossover designed to Inverclyde Council's Roads Development Guide and all surface water shall be intercepted within the curtilage,

in the interests of road safety on Houston Road.

 

(b)

Change of Use from Public Open Space to Private Garden Ground and Extension to Dwellinghouse:

4 Nursery Grove, Kilmacolm (IC/00/174)

 

 

There was submitted a report dated 21 September 2000 by the Head of Planning Services regarding an application by Mr and Mrs Buchanan for change of use from public open space to private garden ground and extension to dwellinghouse at 4 Nursery Grove, Kilmacolm (IC/00/174), consideration of which had been continued from the meeting held on 6 September 2000 for a site visit.

The report recommended that planning permission be refused as the proposal would result in the loss of public open space designated under planning permission IC/87/73 to the detriment of the quality of residential amenity that is currently enjoyed.

After discussion, Councillor McCormick moved that planning permission be refused for the reason detailed in the report.  As an amendment, Councillor Calvert moved that planning permission be granted.  On a vote 3 Members voted for the amendment and 3 for the motion. There being equality in voting the Chairman exercised his casting vote in favour of the motion which was declared carried.  Those Members who had voted in favour of the amendment then requested, in terms of the relevant Standing Order, that the matter be referred to the Inverclyde Council for decision in terms of the amendment.

Hydro House, West Glen Road, Kilmacolm (IC/00/92R)

 

 

There was submitted a report dated 25 September 2000 by the Head of Planning Services regarding an application by Manor Kingdom Ltd for the erection of 4 dwellinghouses at Hydro House, West Glen Road, Kilmacolm (IC/00/92R), consideration of which had been continued from the meeting held on 6 September 2000 for a site visit.

 

 

The report recommended that planning permission be granted subject to a number of conditions.

 

 

After discussion, Councillor Morrison moved that planning permission be refused (1) as the proposal would have an adverse effect on the amenity of the area; (2) as the proposal would have an adverse effect on the environment of this sensitive site including flora and fauna and (3) in view of concerns relating to the draining of the reservoir and associated works.  As an amendment, Councillor McCormick moved that consideration of the application be continued to allow the Head of Planning Services to consult with the applicant on the Sub-Committee’s concerns relative to the draining of the reservoir and infilling operations.  On a vote, 1 Member voted for the motion and 5 for the amendment which was declared carried.Ö

 

 

Decided:  that consideration of the application be continued to allow the Head of Planning Services to consult with the applicant on the Sub-Committee’s concerns relative to the draining of the reservoir and infilling operations.

PLANNING APPLICATIONS

There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

(a)

Alterations and Upgrading of Dwellinghouse and

Demolition and Rebuilding of Garage with Accommodation Above:

Mansefield, Manse Street, Kilmacolm (IC/00/181)

 

 

Decided: that planning permission be granted subject to the condition that the proposed outbuilding shall be used solely for purposes incidental to  use of the dwellinghouse, in the interests of the residential amenity of Mansefield.

 

(b)

Erection of 4 Dwellinghouses:

Whitelea Road, Kilmacolm (IC/00/153)

 

 

Decided: that planning permission be granted subject to the following conditions:-

 

 

(1) that no development shall take place until details of improvements to Whitelea Road fronting the application site have been submitted to and approved in writing by the Head of Planning Services in consultation with the Head of Transportation and Roads Service;

 

 

(2) that the improvement to Whitelea Road as approved under condition (1) shall be brought up to base course level in accordance with the approved details prior to works commencing on site, and thereafter completed to the approved adoptable standard prior to the last dwellinghouse on site being occupied, conditions (1) and (2) being imposed to ensure an appropriate road surface to serve the development;

 

 

(3) that no development shall take place until details of  a vehicular access from the existing lockup garage at "Edencroft" onto Whitelea Road have been  submitted to and approved in writing by the Head of  Planning Services in consultation with the Head of Transportation and Roads Service and thereafter implemented concurrently with the improvements to base course level on Whitelea Road referred to in condition (1), to ensure the occupiers of "Edencroft" have acceptable alternative access onto Whitelea Road as a result of the road improvements;

(4) that samples of all external finishes shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of development, to ensure appropriate finishes to the dwellinghouse and surface treatments within the site compatible with surrounding development; )

(5) that notwithstanding the details shown on plan No 6A hereby approved, details of boundary treatments along the road frontage with Whitelea Road shall be submitted to and approved in writing by the Head of Planning Services and thereafter implemented prior to the last dwellinghouse being occupied, to ensure an appropriate quality of boundary treatment along the road frontage; and  

(6) that prior to the commencement of the construction of any dwellinghouses on the site the developer shall submit details of existing and proposed ground levels and associated works.   Thereafter any upfilling on the site shall be carried out in accordance with the approved details, to establish acceptable finished ground levels on the site.

 

(c)

Erection of 18m Telecommunications Monopole Tower with Accompanying Electrical Equipment:

Former Langlands Park School, Glasgow Road, Port Glasgow (IC/00/113R)

 

 

Decided: that planning permission be granted.

 

(d)

Erection of Steel Platform to house 4 Condenser Units:

42 - 44 Church Street, Port Glasgow  (IC/00/161)

 

 

The report recommended that planning permission be granted subject to the condition that the condenser units installed shall not exceed Noise Rating Curve 25, in the interests of the amenity of nearby residents.

 

 

Decided:  that consideration of the application be continued to allow the Head of Planning Services to have further discussion with the applicant relative to the noise levels from the condenser units on the site.

 

(e)

Alterations and Change of Use to form Hot Food Takeaway:

50 - 52 Sinclair Street, Greenock (IC/00/233)

 

 

Decided: that planning permission be refused as the proposed use would have a detrimental impact on the established amenity of nearby residential properties by virtue of the potential generation of noise, disturbance and nuisance.

 

(f)

Erection of 24 Flats and 6 Townhouses:

Trafalgar Street/Mearns Street, Greenock (IC/00/208R)

 

 

Councillor Blair declared an interest in this matter and took no part in its consideration or decision.

 

 

Decided: that planning permission be granted subject to the following conditions:-

 

 

(1) that none of the houses and flats shall be occupied until the parking layout shown on docquetted drawing 1348/PL1RevB has been completed, to prevent the requirement to park on Mearns Street and Trafalgar Street and in the interests of road safety; and

(2) that samples of facing bricks, roof tiles and render shall be submitted to and approved by the Head of Planning Services in writing prior to the commencement of development on site, to ensure a consistency of materials in the redevelopment of the Mearns Street, Roxburgh Street/Trafalgar Street area.

 

(g)

Erection of Extension:

88 Forsyth Street, Greenock (IC/00/223)

 

 

Decided:  that planning permission be granted subject to the condition that samples of the external materials be submitted to and approved in writing by the Head of Planning Services prior to work commencing on site, to ensure that the extension matches the external appearance of the existing building and thereby maintains the visual quality of the area.

 

(h)

Erection of Dwellinghouse:

Plot 3 Oakleigh Drive/Madeira Lane, Greenock (IC/00/209)

 

 

Decided: that planning permission be granted subject to the following conditions:-

 

 

(1) that the roof shall be finished in natural slate, to ensure a continuity of roof finishes within the site at 89 Eldon Street in the West End of Greenock Outstanding Conservation Area;

(2) that no development shall commence until full details of all boundary treatment, driveway surfacing and window designs have been submitted to and approved by the Head of Planning Services in writing, to ensure a continuity of design and materials within the site at 89 Eldon Street;

(3) that the driveway and garage shall be formed prior to the house being occupied; and

(4) that prior to the house being occupied the access onto Madeira Lane shall be completed to the satisfaction of the Head of Planning Services in writing, conditions (3) and (4) being imposed in the interests of road safety of Oakleigh Drive.

 

(i)

Erection of Dwellinghouse:

23 Eldon Street, Greenock  (IC/00/221)

 

 

The report recommended that planning permission be refused as the proposal would create backland development contrary to the spirit of Policy DCp in the Inverclyde Local Plan to the detriment of the quality of amenity that is currently enjoyed in the area.

 

 

Decided:  that the application be withdrawn from the agenda.

 

(j)

Erection of Dwellinghouse:

Hillside Road, Gourock (IC/00/204)

 

 

Councillor Blair declared an interest in this matter and took no part in its consideration or decision.

 

 

Decided: that planning permission be refused for the following reasons:-

 

 

(1) as the proposal is contrary to Policy DCm of the Inverclyde Local Plan as it will result in a development  the design of which will be out of keeping with the general character of the area; and ›

(2) as the site is of insufficient area to accommodate a dwellinghouse and associated ground in accord with the established building pattern in this locality.

 

(k)

Extension to Dwellinghouse:

10 Culzean Drive, Gourock (IC/00/230)

 

 

Decided: that planning permission be granted.

PLANNING APPEAL

856

 

There was submitted a report dated 18 September 2000 by the Head of Planning Services advising that following the public local inquiry to determine the application for mixed use development in outline at East Glen and Scott Lithgow Yards (Part), Port Glasgow (IC/98/299), the Scottish Executive had advised that the Scottish Ministers accepted the Reporter's recommendation to grant outline planning permission subject to conditions and subject to additional conditions sought by the Council at the Inquiry.

ADVERTISEMENT APPEAL

There was submitted a report dated 25 September 2000 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 6 October 1999 to refuse an application for the erection of an advertising hoarding at 58 Maple Road, Greenock (CA/99/42), and the subsequent appeal by the applicant to the First Minister against that refusal, the Reporter appointed by the First Minister had issued his decision which was to dismiss the appeal.
