confirmation or otherwise, the following paragraphs are submitted for
information only, having been dealt with under the powers delegated to the Sub-Committee. |

PLANNING APPLICATIONS |

|
There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:- |
|
(a) |
Formation of New All-Weather Hockey Field, Together with New and Relocated
Floodlighting: Gryffe Road, Kilmacolm (IC/00/121) |
|
|
Councillor Calvert was
present and with consent spoke on the matter. Decided: that planning permission be granted subject to following conditions:- (1) that the floodlights hereby approved shall not be used after 9.00 pm on any day; |
|
|
(2) that the floodlighting hereby approved shall be angled onto the hockey field in such a manner that beams of light do not extend beyond the perimeter fence. In this regard the lighting design shall be submitted, for approval by the Head of Planning Services, including (i) provision for aiming angles for fittings (rotation and azimuth) with fittings to be marked accordingly for future maintenance, and (ii) details of baffles to restrict spill lighting. The floodlighting hereby approved shall thereafter be implemented and maintained in accordance with the approved scheme, conditions (1) and (2) being imposed to ensure residents surrounding the site do not suffer an unacceptable loss of amenity from floodlighting; |

(3) that a native woodland planting scheme for the area of land to the south of the proposed hockey field and outlined in blue on the approved plan SP./01 shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of work on site and thereafter implemented within the first planting season following the completion of the hockey field, to provide a native woodland edge to the development and the village in this location and to compensate for the loss of existing woodland on the site; |

(4) that the hockey field shall be for the sole use of the St Columba's School staff and pupils and their match opponents, to ensure nearby residents do not suffer an unacceptable loss of amenity, particularly from the use of the hockey field late in the evenings, and that residents close to both the site and other school facilities do not suffer an unacceptable loss of amenity as a result of increased traffic;Y |

(5) that notwithstanding the detail on the plan herewith approved, the perimeter lighting columns shall be no higher than 12 metres; and |
|
|
(6) that notwithstanding the detail on the plan herewith approved, the weldmesh fence along the boundaries with Gryffe Road and the houses at Rannoch and Rossall shall be 1.8 metres in height, conditions (5) and (6) being imposed in the interest of the established visual amenity of the locality. |

(b) |
Proposed Use of Retail Unit as Hot Food Take-Away: 14 Princes Street, Port Glasgow (IC/00/154) |
|
|
The report recommended that planning permission be granted subject to a number of conditions. After discussion, Councillor Morrison moved that planning permission be refused as (1) the proposal would adversely affect the commercial viability of Port Glasgow Town Centre; and (2) the proposal would be detrimental to the amenity of the residents of nearby premises. As an amendment, Councillor McGhee moved that planning permission be granted subject to the conditions detailed in the report. On a vote, 3 Members voted for the motion and 4 for the amendment which was declared carried. Those Members who had voted in favour of the motion then requested, in terms of the relevant Standing Order, that the matter be referred to The Inverclyde Council for decision in terms of the motion. |

Decided: that planning permission be granted subject to the following conditions:- (1) that the premises shall not operate outwith the hours of 9.00 am and midnight Monday to Saturday and 12.00 noon to 11.00 pm on Sundays, to restrict the potential impact of noise and disturbance on residents in the town centre; and |

(2) that no development shall commence until details of the proposed ventilation system have been submitted to and approved by the Head of Planning Services in consultation with the Chief Environmental Services Officer, to prevent potential odour nuisance. |

(c) |
Continuation of Use of Waste Transfer Site: 40 Upper Cartsburn Street, Greenock (IC/00/156) |
|
|
Decided: that planning permission be granted subject to the following conditions:- (1) that the hours of operation shall be restricted to 08.00 hours to 17.00 hours Mondays to Fridays and 08.00 hours to 12.30 hours on Saturdays, to ensure the effective management of site works; |
|
|
(2) that wheel cleaning facilities shall be fully operational at all times during working hours and all vehicles exiting the site will be required to use the cleaning facilities, in the interests of road safety; |
|
|
(3) that the materials to be sorted and transferred from the site shall not include toxic materials or domestic waste, to ensure the effective management of site works; |

(4) that the existing boundary fencing shall be maintained in a reasonable condition, in the interests of visual amenity; and |

(5) that all foul and surface water drainage from the site shall be connected to the Local Authority sewer, in the interests of road safety. |

(d) |
Recladding of Street Elevations and Change of Use of Private Roadway
to Sales Cars Forecourt Display: 12 East Blackhall Street, Greenock (IC/00/125) |
|
|
Decided: (1) that the Director of Legal & Support Services be authorised to instigate the Road Closure Order relative to that part of East Blackhall Street incorporated within the proposed development; and (2) that, on confirmation of the necessary Road Closure Order under Section 207 of the Town and Country Planning (Scotland) Act 1997, planning permission be granted subject to the condition that details shall be submitted to and approved by the Head of Planning Services prior to the commencement of work on site of the method, within the site, of delivery and unloading of vehicles for sale, in the interests of public safety on Carnock Street. |
|
(e) |
Alterations and Fitting-Out Works to Change Use of Offices to
Counselling Centre: 2A Newton Street, Greenock (IC/00/101) |

Decided: that planning permission be granted. |
|
(f) |
Relocation of Plant, Formation of Toxic Waste Compound, Earthworks
and Relocation of Site Boundary Fence: Larkfield Industrial Estate, Earnhill
Road, Greenock (IC/00/159) |
|
|
The report recommended that planning permission be granted subject to the condition that prior to work commencing on site details of grass seed to be used on the regraded earth berm and timescale for planting shall be submitted to and approved in writing by the Head of Planning Services and implemented thereafter in accordance with the approved programme, in the interests of the visual amenity of the adjacent greenbelt land. |

|
Decided: that consideration of the application be continued to allow the Head of Planning Services to enter into discussions with the Scottish Environment Protection Agency relative to the application. |

(g) |
Erection of 17
Flats: Manor Crescent,
Gourock (IC/00/126) |
|
|
Decided: that planning permission be granted subject to the following conditions:- |

(1) that samples of the roof tiles, external render and reconstituted stone be submitted to and approved in writing by the Head of Planning Services prior to the commencement of development, to ensure the external finish to the block of flats is in keeping with the nearby residential properties;& |

(2) that a hard and soft landscaping scheme for the site be submitted to and approved in writing by the Head of Planning Services prior to the commencement of development and thereafter all hard landscaping be completed prior to the occupation of any residence within the development and soft landscaping within the first planting season following completion of the remainder of the development, to ensure appropriate landscaping within the site and an acceptable external environment for residents; |

|
(3) that a window and door specification be submitted to and approved in writing by the Head of Planning Services prior to commencement of development, to ensure the external finish to the block of flats is in keeping with the nearby residential properties; |
|
|
(4) that the parking spaces shall be formed and made available for the use of residents and visitors prior to the occupation of any residence within the development, to ensure adequate car parking is available for residents and to avoid on street parking; |
|
|
(5) that a visibility splay of 2.5m ´ 35.0m ´ 1.05m height be provided and thereafter maintained to the satisfaction of the Head of Planning Services in consultation with the Head of Transportation and Roads Service, to ensure vehicles entering and exiting the site have maximum view of any passing vehicles or pedestrians; |
|
|
(6) that access to the development be via a footway crossover in accordance with the Council's Roads Development Guide to the satisfaction of the Head of Planning Services in consultation with the Head of Transportation and Roads Service; and |
|
|
(7) that the existing footpath fronting the development be reconstructed to a standard appropriate for a housing development, details of which shall be submitted to the Head of Planning Services in consultation with the Head of Transportation and Roads Service and thereafter implemented prior to the occupation of any residence within the development, conditions (6) and (7) being imposed to ensure a safe footpath finish is achieved along the site frontage. |

(h) |
Use of External Pavement Area as Seating Area: Bluebird Cafe, 11 Cardwell Road, Gourock (IC/00/145) |
|

The report recommended that planning permission be refused for a number of reasons. After discussion, Councillor Blair moved that planning permission be granted subject to the following conditions:- (1) that details of the siting, design and external appearance of walls to separate the seating area from the public footway shall be submitted to and approved by the Head of Planning Services and implemented prior to the use commencing, in order to prevent the seating area encroaching onto the public footway and causing an obstruction; (2) that the hours of operation for the external seating area shall be restricted to 09.30 hours to 21.00 hours Monday to Saturday and 10.00 hours to 21.00 hours on Sundays, in the interests of the amenity of nearby residents; and (3) that litter bins shall be provided within the seating areas for the use of the patrons, their design and positioning shall be agreed in writing by the Head of Planning Services and shall be in situ during the hours of operation, to prevent potential litter nuisance. As an amendment, Councillor McCormick moved that planning permission be refused for the reasons detailed in the report. On a vote, 2 Members voted for the amendment and 5 for the motion which was declared carried. |

Construction of New Access Road,
Extension of Existing Marina Basin and Construction of 195 Dwellings with
Associated Roadways, Parking and Landscaping Areas: Kip Marina, Inverkip (IC/00/139) |
|
|
Decided: that, subject to the amendment of the existing Section 75 Agreement relating to outline planning permission IC/97/130 regulating the provision of the footbridge over the A78, the various road improvements and the closure of the existing marina entrance, planning permission be granted subject to the following conditions:- |
|
|
(1) that the length of dwellinghouse driveways shall accord with the Council's Roads Development Guide, to ensure compliance with the Council's Roads Development Guide; |
|
|
(2) that throughout construction, pedestrian access through the site to the foreshore shall be maintained for public use, the details of which shall be submitted to and approved in writing by the Head of Planning Services prior to commencement of development; |
|
|
(3) that details of the coastal walkway to the north of the Bank House flats leading to the foreshore, which shall permit disabled access, shall be submitted to and approved in writing by the Head of Planning Services prior to commencement of development and thereafter be implemented and maintained and made available for public use at all times, conditions (2) and (3) being imposed to ensure public access to the foreshore is maintained; |
|
|
(4) that no trees shall be felled without the prior written approval of the Head of Planning Services; |
|
|
(5) that details of measures to be adopted for the protection of all trees to be retained shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of development and thereafter implemented to the satisfaction of the Head of Planning Services, conditions (4) and (5) being imposed to ensure existing tree features on the site worthy of retention are retained; |
|
|
(6) that a landscaping scheme for the site, which will include all soft and hard landscaping, street lighting, street furniture, boundary treatments and phasing/timing of implementation, shall be submitted to and approved in writing by the Head of Planning Services. Following implementation, any trees, plants or shrubs which die within 5 years shall be replaced in the following planting season to the satisfaction of the Head of Planning Services, to ensure a suitable landscape setting for the development and appropriate integration with the surrounding environment; |
|
|
(7) that a works method statement for the formation of the marina basin extension shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of development, to enable the planning authority to assess the arrangements for the storage and after use of excavated materials on the site; |
|
|
(8) that details of the marina edge treatment shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of development, to ensure an appropriate finish to the marina edge fronting the development; |
|
|
(9) that details of the external finishes to the dwellinghouses and flatted blocks in each phase of development, as shown on plan no. P/01, which is hereby approved in respect only of phasing, shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of development of the relevant phase, to ensure appropriate finishes to dwellinghouses and flatted blocks; and |
|
|
(10) that notwithstanding the provisions of Classes 1, 3, 5 and 6 of Part 1, Classes 7 and 9 of Part 2 and Class 68 of Part 21 of Schedule 1 of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992, as amended, an application for planning permission will be required in respect of: |
|
|
(i) the enlargement, improvement or other alterations of a dwellinghouse, |
|
|
(ii) the provision within the curtilage of a dwellinghouse of any building or enclosure, swimming or other pool required for purposes incidental to the enjoyment of the dwellinghouse, or alteration of such a building or enclosure, |
|
|
(iii) the erection or provision within the curtilage of a dwellinghouse of a container for the storage of oil or liquid petroleum gas, |
|
|
(iv) the installation or alteration of a satellite antenna on a dwellinghouse or within the curtilage of a dwellinghouse, |
|
|
(v) the erection, construction or alteration of a gate, fence, wall or other means of enclosure, |
|
|
(vi) the painting of the exterior of any building or works, and |
|
|
(vii) the installation or alteration on any building or other structure other than a dwellinghouse of a microwave antenna and any structure intended for the support of a microwave antenna |
|
|
to enable the planning authority to retain control over works otherwise permitted thereby ensuring the setting of the landscaping of Ardgowan House, the marina and rural environment in general is protected from unsympathetic development. |

There was submitted a report dated 2 June 2000 by the Director of Legal and Support Services recommending the making of a Traffic Regulation Order to restrict the entire length of Davidson Drive to one way only (northwestbound) and to prohibit left turn manoeuvres from the unnamed access road to the garages at Eastern View into Broomberry Drive, Gourock. |

Decided: that The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order to restrict the entire length of Davidson Drive to one way only (northwestbound) and to prohibit left turn manoeuvres from the unnamed access road to the garages at Eastern View into Broomberry Drive, Gourock and thereafter that it be remitted to the Head of Transportation and Roads Service and the Director of Legal and Support Services to arrange for implementation of the Order.¿ |

There was submitted a report dated 14 July 2000 by the Director of Legal and Support Services recommending the making of a Traffic Regulation Order to introduce no waiting at any time and no loading at any time restrictions on Campbell Street and Brougham Street, Greenock and to revoke two lengths of the existing Order "No Waiting Between 7.00 am - 6.00 pm (Monday - Saturday)" which will be superseded by the new Order. |

Decided: (1) that The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order to introduce no waiting and no loading at any time restrictions on Campbell Street and Brougham Street, Greenock and to revoke two lengths of the existing Order "No Waiting Between 7.00 am - 6.00 pm (Monday - Saturday)" which will be superseded by the new Order and thereafter that it be remitted to the Head of Transportation and Roads Service and the Director of Legal and Support Services to arrange for implementation of the Order; and (2) that it be remitted to the Head of Transportation and Roads Service to investigate the possible promotion of a Traffic Regulation Order to restrict lower Campbell Street to one way only onto Brougham Street, Greenock. |
