PLANNING
APPLICATION SUBMITTED FOR CONTINUED CONSIDERATION |

There was submitted a report dated 23 March 2000 by the Head of Planning Services regarding an application by Mr & Mrs Beale for alteration and extension to the dwellinghouse at The Pines, Porterfield Road, Kilmacolm (IC/99/386), consideration of which had been continued from the meeting held on 1 March 2000 to allow the applicants to submit further information in support of their application and to consider the report currently being prepared by the Civic Trust of Scotland. |

The report recommended that planning permission be refused for a number of reasons. |
|
|
After discussion, Councillor McGhee moved that planning permission be refused for the reasons detailed in the report. As an amendment, Councillor Calvert moved that planning permission be granted subject to conditions considered appropriate by the Head of Planning Services including the condition that the details of tree protection measures shall be submitted to and approved by the Head of Planning Services prior to the commencement of works on site and thereafter implemented during the construction of the development hereby approved, in the interests of the visual amenity of the Kilmacolm conservation area and the setting of the Bishop's House. On a vote, 3 Members voted for the motion and 4 for the amendment which was declared carried. |

There were submitted reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:- |

(a)

Formation of Replacement Access, New Access Road, New Road Bridge
over River Kip and Pedestrian Bridge over A78: Kip Marina, Inverkip (IC/99/273) |
|
|
(Councillor Robertson left the meeting during consideration of this item of business). |
|
|
Decided: that planning permission be granted subject to the following conditions:- |
|
|
(1) that no scrub or trees be removed during the bird breeding season (March to June), in the interests of nature conservation; |
|
|
(2) that details of a landscaping scheme be submitted to and approved in writing by the Head of Planning Services prior to the commencement of development and thereafter implemented within the first planting season following completion of the works hereby approved, to ensure suitable planting proposals, including tree planting to compensate for tree loss and appropriate native planting at the existing marina entrance; |
|
|
(3) that the existing marina access off the A78 shall be closed to vehicular and pedestrian traffic simultaneously with the access hereby approved coming into operation, details of which shall be submitted to and be approved in writing by the Head of Planning Services in consultation with the Scottish Executive as trunk roads authority, in the interests of road safety and to ensure only one access/egress to the marina is operational at any one time; |
|
|
(4) that a visibility splay shall be provided and maintained on each side of the proposed access such that there shall be no obstruction to visibility from a driver’s eye height of l.05m - 2.0m, positioned at the set back distance (X) on the proposed access, to an object height of 0.26m - 1 .05m within the triangular areas defined below: |
|
|
(a) The set back distance, or X distance, shall be a line 4.5 metres long measured along the centreline of the proposed access road from the nearside edge of the trunk road carriageway; |
|
|
(b) The Y distance shall be a line 215 metres long, measured along the nearside edge of the trunk road carriageway from the centreline of the proposed access road in both directions; |
|
|
(c) Two straight lines connecting the terminations of the above lines; |
|
|
in the interests of road safety to ensure vehicles exiting the site have maximum visibility; |
|
|
(5) that details of safety measures, including the provision of a permanent safety barrier to protect the footbridge, shall be submitted to and approved in writing by the Head of Planning Services in consultation with the Scottish Executive as trunk roads authority, in the interests of road safety to avoid vehicles making contact with the footbridge structure; |
|
|
(6) that details of the means of intercepting surface water run-off from the footbridge ramps shall be submitted to and approved in writing by the Head of Planning Services, in the interests and amenity of road safety to avoid surface water gathering on the verge and public footpath and adjoining land; |

(7) that details of pedestrian guardrails to prevent pedestrians crossing the trunk road shall be submitted to the Head of Planning Services, in consultation with the Scottish Executiveas trunk roads authority, in the interests of road safety to encourage pedestrians to use the footbridge; |

(8) that details of bus lay-by facilities shall be submitted to the Head of Planning Services in consultation with the Scottish Executive as trunk roads authority and Strathclyde Passenger Transport and thereafter implemented as required prior to pedestrian guardrails being erected, to ensure adequate bus stop facilities are available to service the development and village; |
|
|
(9) that details of the materials to be used on the vehicle bridge; samples of the timber elements on the footbridge, including any stained finish; and the colour finish to the steelwork shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of development, in the interests of visual amenity to ensure an appropriate finish in this semi rural location; and |
|
|
(10) that details of improvements to the footpath between Main Street and the A78 verge shall be submitted to the Head of Planning Services in consultation with the Head of Transportation and Roads Service and thereafter implemented prior to the footbridge becoming operational, in the interests of road safety to ensure a suitable footpath surface leading to the footbridge. |

Decided: that planning permission be granted. |

Change of Use from Convent to Private Dwellinghouse and Private Day
Care Nursery: 23 Madeira Street, Greenock (IC/00/17) |

Decided: that planning permission be granted subject to the condition that details of the design of the proposed boundary fence between the property and 13 Newark Street be submitted to and approved in writing by the Head of Planning Services prior to its erection and commencement of the use, to ensure that the fence is of an appropriate height and design for the Greenock West End Conservation Area. |

Decided: that planning permission be granted subject to the following conditions:- |
|
|
(1) that details of the design and external appearance of all the proposed windows shall be submitted to and approved by the Head of Planning Services in writing prior to the commencement of the development; |
|
|
(2) that details of the design and external appearance of the proposed bin store, retaining walls, external stairs and associated handrail/balustrade shall be submitted to and approved by the Head of Planning Services in writing prior to the commencement of the development, conditions (1) and (2) being imposed in the interests of the visual amenity of the building; |

(3) that the 9 car parking spaces and external stairs indicated on drawing no. 340.03 shall be formed prior to the use herein approved commencing and retained thereafter for the exclusive use of the office accommodation, to ensure that adequate off-street car parking is made available for the office accommodation; and |

(4) that access to the car park shall take the form of a footway crossover, in the interests of road safety. |

Erection of 80 Dwellinghouses: Former Tough Ropeworks Site, Drumfrochar Road, Greenock (IC/99/380) |

Decided: that planning permission be granted subject to the following conditions:- |
|
|
(1) that the approved landscaping scheme and play area shall be completed in the first planting season following completion of the 80 houses and any specimens that in the subsequent 5 years, die, become diseased or are damaged shall be replaced in the next planting season with a similar specimen unless the Head of Planning Services gives his prior written consent to any variation that may be sought, to ensure the provision of the quality landscape scheme and play area to the benefit of residential amenity; |
|
|
(2) that 1.8m high close boarded timber fencing to the rear gardens facing the railway line and double glazing to all houses shall be provided as per the recommendations in paragraph 6.2 of the Railway Noise and Vibration Survey, to prevent noise nuisance to the houses and gardens from the adjoining railway line; |
|
|
(3) that any accumulations of putrescible materials isolated during the site preparation works shall be removed prior to the start of any house building; and |
|
|
(4) that a minimum layer of 300mm of subsoil and topsoil shall be laid across all garden, landscaped and play areas as per paragraph 5.4 of the Environmental Report, conditions (3) and (4) being imposed to protect the public from any harmful effects from the previous use of the site as an unauthorised tip. |

The report recommended that planning permission be granted subject to a number of conditions. |

Decided: that consideration of the application be continued for a site visit to be arranged by the Director of Legal & Support Services in consultation with the Convener. |

Decided: that planning permission be granted. |

Refurbishment and Conversion of Existing Fire Station to Form

Decided: that planning permission be granted subject to the following conditions:- |
|
|
(1) that no development shall commence until samples of all external materials have been submitted to and approved by the Head of Planning Services in writing, in the interests of visual amenity; and |
|
|
(2) that no development shall commence until full details of the proposed stonework restoration have been submitted to and approved by the Head of Planning Services, to ensure that the stonework at this prominent building in the conservation area is not damaged. |

Decided: that The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order to revoke waiting restrictions currently in force on Albert Road, Gourock and thereafter that it be remitted to the Head of Transportation & Roads Service and the Director of Legal & Support Services to arrange for implementation of the Order. |

Decided: that The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order to revoke waiting restrictions currently in force on Bath Street, Gourock and thereafter that it be remitted to the Head of Transportation & Roads Service and the Director of Legal & Support Services to arrange for implementation of the Order. |

There was submitted a report dated 23 March 2000 by the Director of Legal & Support Services recommending the making of a Traffic Regulation Order to accompany the provision of parking places for the disabled which will restrict parking within designated parking places to disabled persons displaying a badge under the appropriate regulations only and will enable the Police to enforce such restrictions at various locations at Port Glasgow, Greenock and Gourock.Ñ |

Decided: that The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order in respect of On-Street Parking Places (Without Charges) Order No.1 2000 and thereafter that it be remitted to the Head of Transportation & Roads Service and the Director of Legal & Support Services to arrange for implementation of the Order. |
