PLANNING AND TRAFFIC MANAGEMENT SUB-COMMITTEE

Present:- Councillors Morrison (M), McGhee, Robertson (Y), McCormick, Hunter and Campbell, Councillor McGhee, Convener, in the Chair.

 

In attendance:-  Mr C Clelland (for the Director of Legal and Support Services), the Director of Central Services, the Head of Planning Services and Mr G Cooper (for the Head of Transportation and Roads Service).

 

Apologies for absence were intimated on behalf of Councillors Mulholland and Blair.

 

The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

 

1295      PLANNING APPLICATIONS                                                                                                             1295

                                                                                                                                                                                    

SUBMITTED:  Reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

    (a)      Change of Use from Class 1 to Class 2 (Retail to Financial, Professional and Other Services):                          

              75-85 Cathcart Street, Greenock (NI/99/7)                                                                                                   

 

DECIDED:  That it be noted that, as no objections have been received under the Town and Country Planning (Development by Planning Authorities) (Scotland) Regulations 1981, planning permission is deemed to have been granted.

 

    (b)      Formation of Hardstanding, Erection of Fencing and Garden Shed:                                                                 

              12 Cornhaddock Street, Greenock (IC/99/379)                                                                                             

 

DECIDED:   That planning permission be refused as the proposed driveway access, by virtue of its position in Cornhaddock Street, will not be visible to traffic approaching in a westerly direction for a distance of 70 metres and as such the proposed driveway presents a danger to road safety.

 

    (c)      Change of Use and Alterations to Form 9 Flats and Formation of Car Park:                                                    

              32 Inverkip Street/Salmon Street, Greenock (IC/99/333R)                                                                             

 

DECIDED:  That planning permission be granted subject to the following conditions:-

(1)  That details of the design and external appearance of all the proposed windows and external doors shall be submitted to and approved by the Head of Planning Services in writing prior to the commencement of the development.  For the avoidance of doubt all windows shall be double glazed to a noise sensitive standard and the window indicated in green on drawing no. 314.04A shall be fitted with Acoustic Double Glazing, all to the satisfaction of the Head of Planning Services in consultation with the Chief Environmental Services Officer, prior to the occupation of the 9 flats, in the interests of the visual amenity of the immediate area, and to ensure that the proposed flats are adequately sound proofed from the adjacent premises;


(2)  That details of the design and external appearance of the proposed bin store, retaining walls, external stairs and associated handrail/balustrade shall be submitted to and approved by the Head of Planning Services in writing prior to the commencement of the development, in the interests of the visual amenity of the immediate area;

(3)  That the 9 car parking spaces and external stairs indicated on drawing no. 314.06 shall be formed prior to the occupation of the 9 flats herein approved and retained thereafter for the exclusive use of the occupants of the 9 flats, to ensure that adequate off-street car parking is made available to the future residents;

(4)  That access to the car park shall take the form of a footway crossover, in the interests of road safety; and

(5)  That the existing openings between the premises and 30 Inverkip Street shall be sealed up to the satisfaction of the Head of Planning Services in consultation with the Chief Environmental Services Officer, prior to the occupation of the 9 flats, to ensure that the proposed flats are adequately sound proofed from the adjacent premises.

 

    (d)      Extension of Existing Bulk Liquid Oxygen Installation:

DECIDED:  That planning permission be granted.

 

    (e)      Erection of Dwellinghouse:                                                                                                                             

              Hillside Road, Gourock (IC/99/332)                                                                                                              

 

DECIDED:  That planning permission be refused for the following reasons:-

(1)  As the proposal is contrary to policies DCm and DCn of the Inverclyde Local Plan and the terms of the Memorandum of Guidance on Listed Buildings and Conservation Areas as it will result in a development, the siting, density, design and layout of which will be out of keeping with the general character of the area and will adversely affect the setting of the listed building at 114/115 Albert Road and adjoining properties in Albert Road; and

(2)  As the restricted area and steep nature of the site will result in overdevelopment and a lack of functional garden ground for use by the residents of the house.

SUBMITTED:  Reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

    (a)      Erection of 2 Illuminated Advertising Hoardings:                                                                                             

              Drumfrochar Road, Greenock (CA/99/55)                                                                                                     

 

DECIDED:  That advertisement consent be refused as the proposals would introduce a significant degree of advertisement clutter to the severe detriment of the quality of established visual amenity.

 


    (b)      Erection of Advertising Hoarding (in retrospect):                                                                                             

              128 Eldon Street, Greenock (CA/99/53)                                                                                                        

 

DECIDED:  That advertisement consent be refused as the proposals are contrary to policy DCr of the Inverclyde Local Plan and the Memorandum of Guidance on Listed Buildings and Conservation Areas as they will result in the introduction of the hoarding sign on the gable of a road side building within the predominantly residential area and detract from the appearance of the conservation area.

 

1297      PLANNING APPEAL:  128 ELDON STREET, GREENOCK                                                             1297

                                                                                                                                                                                    

SUBMITTED:  Report dated 7 December 1999 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 3 November 1999 to refuse an application for planning permission to amend the opening hours of the shop premises at 128 Eldon Street, Greenock (IC/99/280), notification had been received that the applicant had appealed to the First Minister against that refusal.

1298      PLANNING APPEAL:  12 CORNHADDOCK STREET, GREENOCK                                              1298

                                                                                                                                                                                    

SUBMITTED:  Report dated 13 December 1999 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 6 October 1999 to refuse an application for the formation of a hardstanding and the erection of fencing and a garden shed at 12 Cornhaddock Street, Greenock (IC/99/264), notification had been received that the applicant had appealed to the First Minister against that refusal.

1299      ENFORCEMENT NOTICE APPEAL:  22D ESPLANADE, GREENOCK                                          1299

                                                                                                                                                                                    

SUBMITTED:  Report dated 21 December 1999 by the Head of Planning Services advising that following the service of an Enforcement Notice requiring the replacement of unauthorised windows with those which have the benefit of planning permission at 22D Esplanade, Greenock and the subsequent appeal by the applicant to the Scottish Executive against the service of the Enforcement Notice, the Reporter appointed by the First Minister had issued his decision which was to dismiss the appeal but to vary the terms of the Enforcement Notice to amend the time for compliance to 1 July 2001.

SUBMITTED:  Report dated 7 December 1999 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 4 August 1999 to refuse an application for consent to display 2 internally illuminated display panels at Cardwell Road, Gourock (CA/99/27), and the subsequent appeal by the applicant to the First Minister against that refusal, the Reporter appointed by the First Minister had issued his decision which was to dismiss the appeal and uphold the Sub-Committee’s decision to refuse advertisement consent.
