PLANNING AND TRAFFIC MANAGEMENT SUB-COMMITTEE

 

WEDNESDAY, 1 DECEMBER 1999 - 3.00 pm

 

Present:- Councillors Morrison (M), McGhee, Robertson (Y), McCormick, Blair, Hunter and Campbell, Councillor McGhee, Convener, in the Chair.

 

In attendance:-  The Depute Chief Executive, Mr C Clelland (for the Director of Legal and Support Services), the Director of Central Services, the Head of Planning Services and Mr G Cooper (for the Head of Transportation and Roads Service).

 

An apology for absence was intimated on behalf of Councillor Mulholland.

 

The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

 

1191      PLANNING APPLICATIONS                                                                                                             1191

                                                                                                                                                                                    

SUBMITTED:  Reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

    (a)      Erection of Dwellinghouse (in outline):                                                                                                             

              Hill Cottage, Inverkip (IC/99/309)                                                                                                                 

 

The report recommended that planning permission be granted subject to a number of conditions.

After discussion, Councillor McGhee moved that planning permission be granted subject to the conditions detailed in the report.  As an amendment, Councillor Campbell moved that consideration of the application be continued for 2 months to allow for further discussion and negotiations on the alleged right of way affecting the site.  On a vote, 3 Members voted for the amendment and 4 for the motion which was declared carried.

DECIDED:  That planning permission be granted subject to the following conditions:-

(1) This permission is granted under the provisions of the Town and Country Planning

(General Development Procedure) (Scotland) Order 1992 on an outline application and the further approval of the Council or of the Scottish Executive on appeal shall be required with respect to the undermentioned matters hereby reserved before any development is commenced:

(a)  the siting, size, height, design and external appearance of the proposed development;

(b)  details of the access arrangements;

(c)  details of landscaping of the site;

(2)  That in the case of the reserved matters specified above application for approval must be made before:-

(i)  the expiration of 3 years from the date of grant of outline permission; or

(ii)  the expiration of 6 months from the date on which an earlier application for such approval was refused; or

(iii)  the expiration of 6 months from the date on which an appeal against such refusal was dismissed whichever is the latest;


1191      Provided that only one such application may be made in the case after the expiration of                            1191

the three year period mentioned in sub-paragraph (i) above;

(3)  That the development to which this permission relates must be begun not later than the expiration of 5 years from the date of this permission or within 2 years from the final approval of reserved matters, whichever is the later, conditions (1) - (3) being imposed to comply with Section 59 of the Town and Country Planning (Scotland) Act 1997; and

(4)  That the design of the proposed dwellinghouse shall adopt the design principles detailed in the approved design guidelines for Clyde Muirshiel Regional Park, to ensure a high standard of design within the Clyde Muirshiel Regional Park.

 

    (b)      Erection of Balcony:

It was noted that a replacement report submitted by the Head of Planning Services recommended that planning permission be granted.

DECIDED:   That planning permission be granted subject to the condition that prior to the use of the balcony, the end screens with obscure glass panels (as shown on drawing no. 07a) shall be erected and thereafter retained at all times, to the satisfaction of the Head of Planning Services, to ensure that the privacy of adjacent properties is protected.

 

    (c)      Extension to Dwellinghouse:                                                                                                                           

              8 St Andrew’s Drive, Gourock (IC/99/351)                                                                                                   

 

DECIDED:  That planning permission be granted.

 

    (d)      Installation of Electronically Controlled Gates to Pend:                                                                                    

              Cloch Court, 57 Albert Road, Gourock (IC/99/257)                                                                                      

 

              The report recommended that planning permission be refused in the interest of road safety as should the remote control device fail to operate, requiring the gates to be manually operated, the entering car would require to park temporarily in front of the gates and cause obstruction to pedestrians and motorists.

DECIDED:  That consideration of the application be continued to the next meeting of the Sub-Committee to allow the Head of Planning Services to discuss the matter further with the applicants.

 

(e)          Erection of 12 Dwellinghouses and Clubhouse:                                                                                               

              207 Old Inverkip Road, Greenock (IC/99/251)                                                                                             

 

DECIDED:  That planning permission be granted subject to the following conditions:-

(1)  That details of proposed driveways, which shall have a maximum gradient of 10%, shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of work on site;

(2)  That  the 2m wide footway along the frontage of the site onto Old Inverkip Road shown on docquetted drawing L(00)02(b) shall be completed prior to any of the development being occupied, conditions (1) and (2) being imposed in the interests of road safety;

(3)  That no development shall commence until samples of all external materials have been submitted to and approved in writing by the Head of Planning Services prior to the commencement of work on site, in the interests of visual amenity; and

1191      (4)  That the car parking for the clubhouse shall be implemented prior to the occupation                           1191

of the building, in the interests of road safety.

 

     (f)      Extension to Rear Courtyard to Form Toilet Facilities:                                                                                     

              Lindores Guest House, 61 Newark Street, Greenock (IC/99/296 & LB/99/15)                                              

 

Councillor Blair declared an interest in this matter and took no part in its consideration or decision.

DECIDED:  That listed building consent and planning permission be granted and that, under the terms of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997, the First Minister be notified of the Council’s intention to grant listed building consent and planning permission.

 

    (g)      External Alterations to Render Property, Stone Cleaning and Repairs and Refurbishment                                 

              of Existing Nightclub:                                                                                                                                      

              Cafe Cini, Cathcart Street/Cross Shore Street, Greenock (IC/99/58, LB/99/2 & IC/99/291)                          

                                                                                                                                                                                    

DECIDED:  That applications IC/99/58, LB/99/2 & IC/99/291 be refused as the applicant has failed to supply sufficient information to enable the applications to be fully considered and determined.

 

    (h)      Change of Use of Vacant Industrial Premises to Children’s Play Facility and Formation                                   

              of Associated Car Parking:                                                                                                                             

              Drumfrochar Road, Greenock (IC/99/265)                                                                                                    

 

DECIDED:  That planning permission be granted subject to the following conditions:-

(1)  That notwithstanding detail shown on drawing no. 01 hereby approved, a revised parking layout incorporating a single access/egress and coach parking shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of development and thereafter implemented prior to the children’s play facility becoming operational; and

(2)  That details of the means of closing off the westmost vehicular access and any other alterations to the boundary walls required to achieve road safety sightlines shall be submitted to and approved in writing by the Head of Planning Services prior to the commencement of development and thereafter implemented prior to the children’s play facility becoming operational, conditions (1) and (2) being imposed in the interests of road safety to ensure vehicular movements to and from Drumfrochar Road are concentrated in one location and to ensure adequate visibility for vehicles exiting the site.

 

     (i)      Change of Use of Retail Shop to Tanning Salon:                                                                                             

              17 John Wood Street, Port Glasgow (IC/99/357)                                                                                          

 

The report recommended that planning permission be granted.

DECIDED:  That notification of intention to grant planning permission be referred to the First Minister in view of the Council’s interest as owner of the property.

 


     (j)      Re-tiling of Roof (in retrospect):                                                                                                                     

              1 Bardrainney Avenue, Port Glasgow (IC/99/348)                                                                                         

 

The report recommended that planning permission be refused as the roof tiles used, by virtue of their size and profile, have a detrimental impact on the appearance of the building. 

After discussion, Councillor McGhee moved that planning permission be refused for the reason detailed in the report.  As an amendment, Councillor Morrison moved that planning permission be granted.  On a vote, 1 Member voted for the motion and 6 for the amendment which was declared carried.

DECIDED:  That planning permission be granted.

 

    (k)      Erection of 2 Storey Extension to Dwellinghouse:                                                                                            

              91 Moorfield Avenue, Port Glasgow (IC/99/368)                                                                                           

 

DECIDED:  That planning permission be refused as the proposed extension, by virtue of its design, position and size, will have a detrimental impact on the adjacent residential property at 93 Moorfield Avenue by virtue of loss of sunlight and privacy to rear rooms and garden ground.

 

1192      ADVERTISEMENT APPLICATION                                                                                                    1192

                                                                                                                                                                                    

SUBMITTED:  Report dated 17 November 1999 by the Head of Planning Services regarding an application for the display of non-illuminated signs on towers at James Watt College, Waterfront Campus, Customhouse Way, Greenock (CA/99/51).

DECIDED:   That advertisement consent be refused as the signage, by virtue of its scale, design and position, will be overdominant and detrimental to the visual appearance and character of the college building and Greenock Waterfront generally.

 

1193      PLANNING APPEAL:  WATERFRONT RETAIL PARK, GREENOCK                                            1193

                                                                                                                                                                                    

SUBMITTED:  Report dated 17 November 1999 by the Head of Planning Services intimating the withdrawal of a planning appeal against the non-determination of an application for change of use of up to 1394m2 (gross) non-food retail floor space to food retail space at the Waterfront Retail Park, Greenock (IC/98/292).

SUBMITTED:  Report dated 22 November 1999 by the Director of Legal and Support Services advising that following the decision of the Sub-Committee at the meeting held on 4 August 1999 to refuse an application for the erection of a non-food retail unit at the Waterfront Retail Park, Greenock (IC/99/132), notification had been received that the applicant had appealed to the First Minister against that refusal.

SUBMITTED:  Report dated 16 November 1999 by the Head of Planning Services advising that following the notification of the application for mixed used development in outline at East Glen and Scott Lithgow Yard (Part), Port Glasgow (IC/98/299) to the Scottish Executive under the provisions of the Town and Country Planning (Notification of Applications) (Scotland) Direction 1997 with a recommendation for approval, the Scottish Executive had advised that the matter should be considered at a public local inquiry.
