PLANNING AND TRAFFIC MANAGEMENT SUB-COMMITTEE

 

WEDNESDAY, 3 NOVEMBER 1999 - 3.00 pm

 

Present:- Councillors McGhee, Robertson (Y), Mulholland, McCormick, Blair, Hunter and Campbell, Councillor McGhee, Convener, in the Chair.

 

In attendance:-  The Depute Chief Executive, Mr C Clelland (for the Director of Legal and Support Services), the Director of Central Services, the Head of Planning Services and Mr G Cooper (for the Head of Transportation and Roads Service).

 

An apology for absence was intimated on behalf of Councillor Morrison (M).

 

The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

 

1119      PLANNING APPLICATIONS                                                                                                             1119

                                                                                                                                                                                    

SUBMITTED:  Reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

    (a)      Erection of Acoustic Screen Fence:                                                                                                                 

              Kelly Street, Greenock (IC/99/318)                                                                                                               

 

DECIDED:  That planning permission be granted subject to the condition that the acoustic screen fence hereby approved shall be erected prior to the occupation of the first flat approved under planning permission IC/99/81 and shall thereafter be maintained in perpetuity in full working order to the satisfaction of the Head of Planning Services in consultation with the Chief Environmental Services Officer, to enable the adjacent laundry to continue to operate in its current form without being the subject of a statutory noise complaint.

 

    (b)      Amendment to Opening Hours of Shop Premises:

DECIDED:   That planning permission be refused as the hours of operation proposed would result in early morning activity at the shop premises which would generate noise and cause disturbance to the detriment of the amenity of nearby residents.

 

    (c)      Erection of Garage:

DECIDED:  That planning permission be granted.


1119      Provision of Hot Food Take-Away within Existing Retail Unit:                                                                 1119

    (d)      11 Kempock Street, Gourock (IC/99/281)                                                                                                    

 

DECIDED:  That  planning permission be granted subject to the following conditions:-

(1)  That the premises shall not be open to the public outwith the hours of 8.00 am to 11.00 pm on any day, to reflect the hours of operation requested by the applicant and to ensure adjoining and nearby residents are not unnecessarily inconvenienced by late night activity from the premises;

(2)  That any noise generated from the ventilation system or from within the premises shall be inaudible in any adjoining dwelling; and

(3)  That the details of the ventilation system shall be submitted to and approved in writing by the Head of Planning Services and thereafter implemented prior to the take-away facility commencing trading.  The system shall incorporate the following features:-

(i)     the fans shall be of the low noise centrifugal type;

(ii)    all wall and ceiling mounts shall be anti-vibrational;

(iii)    the ducting shall be damped as required; and

(iv)   details of the finish of the external flue;

conditions (2) and (3) being imposed to ensure the external flue blends with the external walls of no. 13 Kempock Street thereby minimising its visual impact and safeguards the residential amenity of adjoining residential properties.

 

    (e)      Erection of Dwellinghouse:

DECIDED:  That planning permission be refused for the following reasons:-

(1)  As the proposal by virtue of its plot size, represents overdevelopment of the site and is out of character with the established amenity of the area; and

(2)  As the proposal is likely to generate additional vehicle movement and on street parking to the detriment of road safety.

 

     (f)      Formation of Off-Road Car Parking Bay/Driveway Adjacent to Footway:

DECIDED:  That planning permission be refused as the overall design of the off-street parking bay/driveway and the visibility splays proposed would present operational difficulties to the detriment of road safety.

 

    (g)      Re-roofing of Shop, Alterations to Shop Front and Installation of Cash Machine:                                             

              64 Main Street, Inverkip (IC/99/262)                                                                                                             

 

DECIDED:  That planning permission be refused for the following reasons:-

(1)  As the proposed cash machine would increase vehicular and pedestrian movement to the detriment of road safety; and

(2)  As lack of information supplied by the applicant prevents proper consideration of the proposals in terms of policy DCm of the Inverclyde Local Plan.


1120      PLANNING APPEAL:  54 SINCLAIR STREET, GREENOCK                                                           1120

                                                                                                                                                                                    

SUBMITTED: Report dated 13 October 1999 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 23 June 1999 to refuse an application for change of use to hot food take-away and alterations to form a pitched roof at 54 Sinclair Street, Greenock  (IC/98/304), and the subsequent appeal by the applicant to the Secretary of State against that refusal, the Scottish Executive had issued its decision which was to dismiss the appeal and uphold the Sub-Committee’s decision to refuse planning permission.

1121      ADVERTISEMENT APPEAL: LYNEDOCH STREET/DRUMFROCHAR ROAD,                             1121

              GREENOCK                                                                                                                                                

 

SUBMITTED:  Report dated 20 October 1999 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 4 August 1999 to refuse an application for consent to display 2 advertisement hoardings at Lynedoch Street/Drumfrochar Road, Greenock (CA/99/15), and the subsequent appeal by the applicant to the Secretary of State against that refusal, the Scottish Executive had issued its decision which was to uphold the appeal and grant advertisement consent subject to a number of conditions as detailed in the report.
