PLANNING AND TRAFFIC MANAGEMENT SUB-COMMITTEE

 

WEDNESDAY, 6 OCTOBER 1999 - 3.00 pm

 

Present:- Councillors Morrison (M), McGhee, Nimmo, Mulholland, McCormick, Blair and Campbell, Councillor McGhee, Convener, in the Chair.

 

In attendance:-  The Depute Chief Executive, Mr C Clelland (for the Director of Legal and Support Services), the Director of Central Services, the Head of Planning Services and Mr G Cooper (for the Head of Transportation and Roads).

 

An apology for absence was intimated on behalf of Councillor Hunter.

 

The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

 

   970      PLANNING APPLICATIONS                                                                                                               970

                                                                                                                                                                                    

SUBMITTED:  Reports by the Head of Planning Services on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

    (a)      Erection of Dwellinghouse (in outline):                                                                                                             

              103 Albert Road, Gourock (IC/99/242)                                                                                                         

 

DECIDED:  That planning permission be granted subject to the following conditions:-

(1) This permission is granted under the provisions of the Town and Country Planning

(General Development Procedure) (Scotland) Order 1992 on an outline application and the further approval of the Council or of the First Minister on appeal shall be required

with respect to the undermentioned matters hereby reserved before any development is commenced:

(a)  the siting, size, height, design and external appearance of the proposed development;

(b)  details of the access arrangements;

(c)  details of landscaping of the site;

(2)  That in the case of the reserved matters specified above application for approval must be made before:-

(i)  the expiration of 3 years from the date of grant of outline permission; or

(ii)  the expiration of 6 months from the date on which an earlier application for such approval was refused; or

(iii)  the expiration of 6 months from the date on which an appeal against such refusal was dismissed whichever is the latest;

(3)  That the development to which this permission relates must be begun not later than the expiration of 5 years from the date of this permission or within 2 years from the final approval of reserved matters, whichever is the later, conditions (1) - (3) being imposed to comply with Section 59 of the Town and Country Planning (Scotland) Act 1997;

(4)  That the only vehicular access to the site shall be off the access lane at the south east boundary of the site and all surface water shall be intercepted within the curtilage, to maintain road safety on the narrow Hillside Road; and

(5)  That the design to be submitted for the approval of reserved matters shall be in accordance with docquetted drawing 99-23-02-A in terms of massing, roof design and


   970      attachment to the adjacent dwellinghouse, to ensure a design that sympathises with the                                970

existing house at 103 Albert Road and with the built form of the surrounding area.

 

    (b)      Alterations to Height of Extension Roof (variation to planning permission IC/99/29):                                        

              9 Octavia Terrace, Greenock (IC/99/278)                                                                                                     

 

The report recommended that planning permission be granted subject to the condition that the demolition of the garage and formation of additional garden ground shall take place before the completion of the new extension, to ensure the availability of adequate garden ground for the enjoyment of the residents of the ground floor flat.

Councillor Blair declared an interest in this matter and took no part in its consideration or decision.

Following discussion, Councillor Morrison moved that planning permission be refused.  As an amendment, Councillor McGhee moved that planning permission be granted subject to the condition detailed in the report.  On a vote, three Members voted for the motion and three for the amendment.  There being equality in voting, the Convener exercised his casting vote in favour of the amendment which was declared carried.

DECIDED:   That planning permission be granted subject to the condition that the demolition of the garage and formation of additional garden ground shall take place before the completion of the new extension, to ensure the availability of adequate garden ground for the enjoyment of the residents of the ground floor flat.

 

    (c)      Formation of Hardstanding and Erection of Fencing and Shed:                                                                        

              12 Cornhaddock Street, Greenock (IC/99/264)                                                                                             

 

The report recommended that planning permission be refused as the proposed driveway access, by virtue of its position on Dunn Street within 9 metres of the junction into Cornhaddock Street, would be to the detriment of road safety.

Following discussion, Councillor Morrison moved that planning permission be refused for the reason detailed in the report.  As an amendment, Councillor Nimmo moved that planning permission be granted.  On a vote, three Members voted for the amendment and four for the motion which was declared carried.

DECIDED:  That planning permission be refused as the proposed driveway access, by virtue of its position on Dunn Street within 9 metres of the junction into Cornhaddock Street, would be to the detriment of road safety.

 

    (d)      Change of Use from Class 11 to Class 10 to Include Alterations to Existing Hall to Pre-5                                

              Facility with All Ancillary Accommodation:                                                                                                     

              1 Houston Street, Greenock (NI/99/5)                                                                                                           

 

              The Convener referred to letters from the objectors to the application withdrawing their objections and it was noted that should the Sub-Committee agree to grant planning permission there would now be no requirement to refer the matter to the First Minister.

DECIDED:  That it be noted that by virtue of the objections being withdrawn planning permission is deemed to be granted subject to the condition that the approved scheme of landscaping shall be implemented in the first planting season following completion of the works and any specimens that in the subsequent 5 years die, become diseased or are damaged shall be replaced in the next planting season with a similar specimen unless the Head of Planning Services gives his prior written consent to any variations that may be sought, in the interests of the visual amenity of the street scene.

 

   970      Formation of Short-term Quarry:                                                                                                               970

    (e)      Harelaw, by Port Glasgow (IC/98/93)                                                                                                            

 

Councillor Calvert was present and with consent spoke on the matter.

DECIDED:  That, on the conclusion of a Bond with the Council to cover the cost of the restoration of the site, planning permission be granted for a temporary 5 year period subject to the following conditions:-

(1)  That repairs and improvements to the access abutting the B788 shall be carried out to the satisfaction of the Head of Planning Services in consultation with, and to the specification of, the Director of Transportation and Roads prior to the commencement of work on site;

(2)  That the existing wheel cleaning facilities at the access to the landfill site shall be retained and be fully operational at all times during working hours.  All vehicles exiting the site will be required to use the cleaning facilities, conditions (1) and (2) being imposed to maintain road safety on the B788;

(3)  That Phase 4 of Harelaw I shall be topsoiled and seeded prior to the commencement of quarrying to the satisfaction of the Head of Planning Services unless written agreement is given to an extension of this time period, to maintain visual amenity at Harelaw;

(4)  That the hours of operation shall be restricted to 07.30 - 18.00 Monday to Fridays and 07.30 - 13.00 on Saturdays, in the interests of the amenity of Port Glasgow Golf Course;

(5)  That the cut off ditches carrying clean water shall not connect to the settling ponds, to prevent  pollution of water courses;

(6)  That all haul roads within the site shall be kept damped down in dry and/or windy weather to prevent dust generation, to prevent pollution from dust;

(7)  That no development shall take place within the development site until the developer has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation, this scheme to be submitted for approval by the Head of Planning Services following consultation and agreement with West of Scotland Archaeological Services, to reflect the potential archaeological significance of the site;

(8)  That no development shall commence until the applicants have submitted a survey to (i) determine the presence of water voles and (ii) to confirm the flora and fauna on the site to the satisfaction of the Head of Planning Services in consultation with Scottish Natural Heritage.  If water voles are found within the site they shall be relocated to a place of safety nearby prior to the start of any work on site, as agreed by the Head of Planning Services in consultation with Scottish Natural Heritage, in the interests of nature conservation;

(9)  That the approved restoration scheme shall be implemented in the first planting season following one year of the cessation of the 5 year quarrying period and any specimens that in the subsequent 5 years die become diseased or are damaged shall be replaced in the next planting season with a similar specimen  unless the Head of Planning Services gives his prior written consent to any variation that may be sought, to maintain visual amenity at Harelaw; and

(10)  That a scheme of dust monitoring shall be submitted to and approved by the Head of Planning Services prior to the commencement of work on site, to ensure that dust generation does not have an adverse impact on the use of adjacent land and road safety.

 


     (f)      Change of Use of Licensed Restaurant to Brasserie:                                                                                        

              4 St James Terrace, Lochwinnoch Road, Kilmacolm (IC/99/225)                                                                   

 

The report recommended that planning permission be refused in the interests of amenity of the adjacent residential properties as the proposed use may generate an unacceptable level of noise and activity in close proximity to the residential properties.

Councillor Blair declared an interest in this matter and took no part in its consideration or decision.

Councillor Calvert was present and with consent spoke on the matter.

Following discussion, Councillor Morrison moved that planning permission be granted.  As an amendment, Councillor McGhee moved that planning permission be refused for the reason detailed in the report.  On a vote, two Members voted for the motion and four for the amendment which was declared carried.

DECIDED:  That planning permission be refused in the interests of the amenity of the adjacent residential properties as the proposed use may generate an unacceptable level of noise and activity in close proximity to the residential properties.

 

   971      ADVERTISEMENT APPLICATION                                                                                                      971

                                                                                                                                                                                    

SUBMITTED: Report dated 24 September 1999 by the Head of Planning Services regarding an application in retrospect for the erection of an advertisement hoarding at 58 Maple Road, Greenock (CA/99/42).

DECIDED:  That advertisement consent be refused for the following reasons:-

(1)  As the retrospective proposals are contrary to policy DCr(iv) in the Local Plan which states that hoardings in predominantly residential areas and on road side gables will in general be resisted; and

(2)  As the hoarding has introduced a discordant element into the street scene to the severe detriment of the quality of visual amenity that was previously enjoyed in the predominantly residential area.

 

   972      PLANNING APPEAL:  90 BELVILLE STREET, GREENOCK                                                             972

                                                                                                                                                                                    

SUBMITTED:  Report dated 24 September 1999 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 23 June 1999 to refuse an application for change of use of retail unit to hot food carry out at 90 Belville Street, Greenock (IC/99/51), and the subsequent appeal by the applicant to the Secretary of State against that refusal, the Scottish Executive had issued its decision which was to dismiss the appeal and uphold the Sub-Committee’s decision to refuse planning permission.

   973      ADVERTISEMENT APPEAL:  CARDWELL ROAD/SHARP STREET, GOUROCK                           973

                                                                                                                                                                                    

SUBMITTED:  Report dated 28 September 1999 by the Head of Planning Services advising that following the decision of the Sub-Committee at the meeting held on 4 August 1999 to refuse an application for consent to display 2 internally illuminated display panels at Cardwell Road/Sharp Street, Gourock (CA/99/27), notification had been received that the applicant had appealed to the First Minister against that refusal.

   974      PROPOSED TRAFFIC REGULATION ORDER - ON-STREET PARKING PLACES                         974

              (WITHOUT CHARGES) ORDER NO. 2 1999                                                                                            

 

SUBMITTED:  Report dated 24 September 1999 by the Director of Legal and Support Services recommending the making of a Traffic Regulation Order to accompany the provision of parking bays for disabled drivers which will restrict parking within designated parking bays to disabled drivers only and enable the police to enforce such restrictions at various locations in Port Glasgow and Greenock.

DECIDED:  That The Inverclyde Council be recommended to make a Resolution under the Road Traffic Regulation Act 1984 in relation to a Traffic Regulation Order in respect of On-Street Parking Places (Without Charges) Order No. 2 1999 and that it be remitted to the Head of Transportation and Roads and the Director of Central Services to arrange for implementation of the Order.
