Present:- Councillors Morrison (M), McGhee, McCormick, Rebecchi, Hunter and Campbell, Councillor McGhee, Convener, in the Chair.
In attendance:- The Depute Chief Executive, Mr C Clelland (for the Executive Director Legal, Information & Support Services), the Director of Central Services, the Chief Planning Officer and Mr G Cooper (for the Director of Transportation & Roads).
Apologies for absence were intimated on behalf of Councillors Mulholland and Blair.
The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.
859 PLANNING APPLICATIONS 859
SUBMITTED: Reports by the Chief Planning Officer on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-
(a) Alterations and Change of Use of Betting Office to Use as Vehicle Repair Workshop:
Ashgrove Lane, Port Glasgow (IC/99/163)
The report recommended that planning permission be refused as the required parking provision of five off-road parking spaces, visibility splay of 2.5m x 35m x 1.05m high, and appropriate vehicle turning facilities cannot be achieved within the site to the detriment of road safety.
Councillor Moody was present and with consent spoke on the matter.
After discussion, Councillor McGhee moved that the application be determined without a site inspection. As an amendment, Councillor Rebecchi moved that consideration of the application be continued for a site visit. On a vote, 3 Members voted for the amendment and 3 for the motion. There being equality in voting, the Convener exercised his casting vote in favour of the motion which was declared carried.
DECIDED: That there be no site visit prior to determining the application.
The Sub-Committee then resumed consideration of the application.

859 Alterations to Provide Rooflights and Parapet Railings: 859
(b) Castle Levan Manor, Cloch Road, Gourock (IC/99/219 & LB/99/11)
DECIDED: That planning permission and listed building consent be granted.
(c) Erection of 46 Dwellinghouses:
Levan Farm, Gourock (IC/99/171)
DECIDED: That, subject to the applicant fulfilling all the requirements of the Section 75 Agreement under the Town and Country Planning (Scotland) Act 1997 relative to the density of the development required in terms of the outline planning permission granted by the Secretary of State, including the submission of a Bond to secure completion of the landscaping, reserved matters be approved subject to the condition that no development shall commence until samples of all external materials have been submitted to and approved by the Chief Planning Officer in writing, to ensure that the materials used are in keeping with the character of this prominent edge of settlement location.
(d) Additional 2 Flats and Reduction in Roof Scape (Amendment to Planning
Permission IC/98/16):
Station Avenue, Inverkip (IC/99/238)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That the development to which this permission relates must be begun with five years from the date of this permission, to comply with Section 58 of the Town and Country Planning (Scotland) Act 1997;
(2) That samples of external materials be submitted to the Chief Planning Officer and approved in writing prior to the commencement of development, to ensure appropriate materials in this location;
(3) That the temporary 900mm high fence detailed on plan no. 2E, required for the protection of the trees at Commoncraig Place, be erected prior to the commencement of development and no other development shall take place until the Chief Planning Officer has given his written confirmation that this fence has been erected in accordance with the approved plans to his satisfaction;
(4) That the temporary fence referred to in condition (3) above shall be erected, retained and maintained until all other construction works on site have been completed;
(5) That no branches from the trees in the Commoncraig Place Tree Preservation Order which overhang the application site shall be lopped without the prior written approval of the Chief Planning Officer, conditions (3), (4) and (5) being imposed in the interest of amenity and to avoid unnecessary damage to trees within the adjoining Tree Preservation Order;
(6) That notwithstanding the landscaping details shown on plan no. 2E, a revised landscaping scheme shall be submitted to the Chief Planning Officer and approved in writing prior to the commencement of development;
859 (7) That all landscaping within the site shall be implemented within the first planting and 859
seeding season following occupation of the development or completion of the development, whichever is sooner. Any plants, trees or shrubs which die or are damaged or removed within five years shall be replaced within the next planting and seeding season to the satisfaction of the Chief Planning Officer, conditions (6) and (7) being imposed to ensure an appropriate landscaping scheme is provided and maintained;
(8) That no flat within the development shall be occupied until the parking layout shown on drawing no. 2E has been implemented to the satisfaction of the Chief Planning Officer, to enable residents to park their vehicles off the new access road; and
(9) That details of a revised footway crossover provision and access to the parking area for Block no. 3 shall be submitted to and approved by the Chief Planning Officer in consultation with the Director of Transportation and Roads, to meet the requirements of the Council’s Approved Roads Development Guide.
(e) Erection
of 1½ Storey Dwellinghouse:
Greenock Road, Wemyss Bay (IC/98/360R)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That sightlines of 2.5 x 90 x 1.05 metres shall be provided and maintained above carriageway channel level to the satisfaction of the Chief Planning Officer in consultation with the Director of Transportation and Roads, to ensure that drivers of vehicles leaving the site are able to see and be seen by vehicles on the trunk road carriageway and join the traffic stream safely;
(2) That the proposed means of footway crossover shall be constructed to a layout and construction to be approved by the Chief Planning Officer, after consultation with the Director of Transportation and Roads, before development is commenced, to minimise interference with the safety and the free flow of traffic on the trunk road;
(3) That there shall be provided within the curtilage of the site 2 parking spaces and an adequate and unobstructed turning area, to ensure that vehicles may park clear of the trunk road and to ensure that vehicles may enter and leave in forward gear;
(4) That the gradient of the driveway shall not exceed 1 in 25 for a distance of 5 metres from the nearside edge of the trunk road carriageway and thereafter shall not exceed 1 in 10, with the first 10 metres being surfaced in bituminous surface and measures being taken to ensure that all drainage from the site does not discharge onto the trunk road, to ensure that vehicles entering or exiting the access can undertake the manoeuvre safely and with minimum interference to the safety and free flow of traffic on the trunk road and ensure that water run-off from the site does not enter the trunk road; and
(5) That any access gate shall be located at least 5 metres from the edge of the trunk road carriageway and that gate shall only be capable of opening away from the trunk road, to ensure that accessing vehicles can stand clear of the trunk road carriageway when the gates are opened or closed.
(f) Erection
of 4 Dwellinghouses:

3-6 Burns Drive, Wemyss Bay (IC/99/249)
The Chief Planning Officer orally advised the Sub-Committee that the developer had offered to carry out certain modifications.
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That any future development carried out within the curtilages of the dwellinghouses shall be carried out in accordance with the attached Design Brief, to ensure the design concept for the development site is maintained;
(2) That details of a 1.8m close boarded fence, to be positioned along the rear boundary of plots 3-6, shall be submitted to and approved by the Chief Planning Officer within 28 days of the date of this consent, and implemented prior to the occupation of the first house on site, in the interests of the residential amenity of the proposed and existing houses;
(3) That notwithstanding the information shown on the approved plan, the roof pitches of the houses on plots 4, 5 and 6 shall be reduced to 33.3 degrees, to ensure the proposed houses contribute positively to the townscape setting of the location;
(4) That details of the scheme of landscape works shall be submitted to and approved in writing by the Chief Planning Officer within 28 days of the date of this consent. Details of the scheme of landscaping works shall include:
a) location of new planting;
b) schedule of plants to comprise species, plant sizes and proposed numbers/density;
c) programme for completion and subsequent maintenance; and
(5) That all landscaping works shall be carried out in accordance with the scheme approved in writing by the Chief Planning Officer, conditions (4) and (5) being imposed to ensure that the landscape makes a positive contribution to the visual quality and setting of the area.
860 ADVERTISEMENT APPLICATION 860
SUBMITTED: Report dated 12 August 1999 by the Chief Planning Officer on an application by Safeway Stores plc for the erection of an illuminated free standing sign at the Safeway store, Rue End Street, Greenock (CA/99/34).
DECIDED: That advertisement consent be refused as the sign, by virtue of its scale and prominent location, will create a clutter of signs on the site detrimental to the visual amenity of the area.
861 ENFORCEMENT NOTICE APPEAL: 22D ESPLANADE, GREENOCK 861
SUBMITTED: Report dated 17 August 1999 by the Chief Planning Officer advising that following the service of an Enforcement Notice in May 1999 to ensure the reinstatement of the original windows in respect of which retrospective planning permission had been refused and the applicant’s subsequent appeal to the Secretary of State dismissed or the installation of the replacement windows which had received planning permission in February 1999, notification had been received that the applicant had appealed to the Secretary of State against the service of the Enforcement Notice.

862 ADVERTISEMENT APPEAL: LAIRD STREET, GREENOCK 862
SUBMITTED: Report dated 16 August 1999 by the Chief Planning Officer advising that following the decision of the Sub-Committee at the meeting held on 3 February 1999 to refuse an application for consent to display an advertisement hoarding at Laird Street, Greenock (CA/98/52) and the subsequent appeal by the applicant to the Secretary of State against that refusal, the Reporter appointed by the Secretary of State had issued his decision which was to dismiss the appeal and uphold the Sub-Committee’s decision to refuse advertisement consent.
