Present:- Councillors Morrison (M), McGhee, Mulholland, Blair, Hunter and Campbell, Councillor McGhee, Convener, in the Chair.
In attendance:- The Depute Chief Executive, Mr C Clelland (for the Executive Director Legal, Information and Support Services), the Director of Central Services, the Chief Planning Officer and the Chief Environmental Services Officer.
An apology for absence was intimated on behalf of Councillor McCormick.
The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

APPLICATIONS SUBMITTED FOR CONTINUED CONSIDERATION 723
(a) Erection
of 10 Flats:
Johnston Street/Glen Street,
Greenock (IC/99/105R)
SUBMITTED: Report dated 26 July 1999 by the Chief Planning Officer regarding an application by MacIntosh Homes Ltd & Allied Capital Investments for the erection of 10 flats at Johnston Street/Glen Street, Greenock (IC/99/105R), consideration of which had been continued from the meeting held on 23 June 1999 for discussion with the applicants with a view to reducing the density of the development, with due regard to the relevant planning guidelines.
Councillor Mitchell was present and with consent spoke on the matter.
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That no development shall commence until samples of all external materials have been submitted to and approved by the Chief Planning Officer in writing, to ensure that the materials approved are appropriate for the Greenock West End Conservation Area; and
(2) That no flats shall be occupied until the 15 off-street parking spaces shown on the docquetted site layout drawing have been implemented, to ensure adequate off-street parking thereby reducing the requirement of on-street parking and the subsequent impact on road safety.
(b) Erection
of 28 Flats:
Kelly Street/South Street,
Greenock (IC/99/81)
SUBMITTED: Report dated 26 June 1999 by the Chief Planning Officer regarding an application by MacPherson Homes & Construction Ltd for the erection of 28 flats at Kelly Street/South Street, Greenock (IC/99/81), consideration of which had been continued from the meeting held on 23 June 1999 to allow further discussion with the relevant parties in respect of the density of the proposed development and potential noise problems.
Councillor Blair declared an interest in this matter and took no part in its consideration or decision.
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That no development shall commence until
samples of all external materials have
been submitted to and approved by the Chief Planning Officer in writing, to ensure that the proposed materials are in character with the built form of the surrounding area;
(2) That no development shall commence until fully detailed landscaping proposals including details of all boundary treatments have been submitted to and approved by the Chief Planning Officer in writing;
(3) That the approved scheme of landscaping shall be implemented in the first planting season following completion of the flats, and any specimens that in the subsequent 5 years die, become diseased or are damaged, shall be replaced in the next planting season with a similar specimen unless the Chief Planning Officer gives his prior written consent to any variation that may be sought, conditions (2) and (3) being imposed to ensure the provision of a quality landscape setting from the proposed development;
(4) That the off-street and on-street parking layout shown on docquetted drawing 1265-115 shall be implemented prior to any flats being occupied, to ensure that all parking for the proposed development is properly contained within designated areas and to avoid conflict with other on-street parking in an area of high parking demand; and
(5) That details of sound attenuation methods to ensure that no statutory noise complaint may be made against the adjacent laundry operation shall be submitted to and approved by the Chief Planning Officer in consultation with the Chief Environmental Services Officer prior to the commencement of work on site, and should be implemented prior to the occupancy of the first flat, to enable the adjacent laundry to continue to operate in its current form without being the subject of a statutory noise complaint.

SUBMITTED: Reports by the Chief Planning Officer on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-
(a) Change
of Use of Former British Telecom Yard to Car Park:
Forbes Place, Greenock Road,
Wemyss Bay (IC/99/187)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That details of the gates and fencing along the northmost boundary of the site be submitted to and approved in writing by the Chief Planning Officer prior to the car park becoming operational, to ensure a suitably designed enclosure along the northmost boundary of the site;
(2) That the top surface of the car park, as detailed in the application, be surfaced prior to the car park becoming operational, to secure an aesthetically acceptable and functional surface; and
(3) That the existing hedge located adjacent to the trunk road along the eastern boundary of the church grounds, which lies within the approved visibility splay, be maintained at a height of 1 metre above carriageway channel level, in the interests of road safety to ensure vehicles exiting the site have maximum visibility splay onto the trunk road.
(b) Erection of 36 Flats:
Inverkip Garage, Main Street/Daff
Avenue, Inverkip (IC/99/151R)
DECIDED: That planning permission be granted subject to the following conditions:-
724 (1) That no development shall commence until a
sample of the proposed roof finish has 724
been submitted to and approved by the Chief Planning Officer, to ensure a quality of development appropriate to the Inverkip Conservation Area;
(2) That no flats shall be occupied until the parking layout detailed on Drawing No 161/01A has been implemented, to prevent the requirement for on-street parking on Main Street and Daff Avenue;
(3) That no development shall commence until fully detailed landscape proposals have been submitted to and approved by the Chief Planning Officer in writing, to ensure a quality of development appropriate to the Inverkip Conservation Area; and
(4) That the approved planting scheme shall be implemented in the first planting season following completion of the flats and any specimens that in the subsequent 5 years die, become diseased or are damaged shall be replaced in the next planting season with a similar specimen unless the Chief Planning Officer gives his prior written consent to any variation that may be sought, to ensure a quality landscape setting for the flats.
(c) Change
of Use of Retail Unit to Create Extended Betting Office and Alterations:

The Sub-Committee was advised that the planning application had been withdrawn.
DECIDED: That the withdrawal of the planning
application be noted.
(d) Erection
of Non-Food Retail Unit and Associated Car Park:

The report recommended that, subject to the applicant entering into an Agreement under Section 75 of the Town and Country Planning (Scotland) Act 1997, planning application IC/99/132 for the erection of a non-food retail unit and associated car parking be granted subject to a number of conditions and that planning application IC/99/131 for the erection of a non-food retail unit be refused as the proposed development will result in the loss of 45 prime car parking spaces to the detriment of the effective operation of the retail park.
After discussion, Councillor
McGhee moved that, in respect of planning application IC/99/132, planning
permission be granted subject to the applicant entering into an Agreement under
Section 75 of the Town and Country Planning (Scotland) Act 1997 and subject to
the conditions detailed in the report.
As an amendment, Councillor Morrison moved that planning permission be
refused (1) as the proposed development will give rise to an additional parking
requirement which is not addressed sufficiently in the proposal and which will
exacerbate existing parking problems within the Waterfront locality; and
(2) as the proposed replacement car
parking, by virtue of its location, is to the detriment of the effective
operation of the retail park and will lead to vehicle/pedestrian conflict and
give rise to safety and security concerns.
On a vote, 2 Members voted for the motion and 4 for the amendment which
was declared carried.
DECIDED:
(a) That planning application IC/99/132 be refused for the following reasons:-
(1) As the proposed development will give rise to an additional parking requirement which is not addressed sufficiently in the proposal and which will exacerbate existing parking problems within the Waterfront locality; and
(2) As the proposed replacement car parking, by virtue of its location, is to the detriment of the effective operation of the retail park and will lead to vehicle/pedestrian conflict and give rise to safety and security concerns; and
(b) That planning application IC/99/131 be
refused as the proposed development will result in the loss of 45 prime car
parking spaces to the detriment of the effective operation of the retail park.
(e) Erection
of Dwellinghouse:
Glenneuk, Clune Brae, Port
Glasgow (IC/99/113)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That no development shall commence until samples of all external materials have been submitted to and approved by the Chief Planning Officer in writing, to ensure the compatibility with the colour of building materials in the surrounding area; and
(2) That road markings, at the junction with
Clune Brae, be provided to the satisfaction of the Chief Planning Officer, in
co-ordination with the Director of Transportation and Roads, prior to the
occupation of the dwellinghouse, to ensure safe access and egress to and from
Clune Brae.

DECIDED: That advertisement consent be refused for the following reasons:-
(1) As the proposals are contrary to Policy DCr (iv) in the Local Plan, which states “advertisement on the gables of road side buildings will, in general, be resisted”; and
(2) As the proposed display panels would
introduce a discordant element into the street scene to the severe detriment of
the visual amenity of the immediate area.

APPEAL: HYDRO HOUSE, WEST GLEN ROAD,

SUBMITTED: Report dated 6 July 1999 by the Executive Director Legal, Information and Support Services advising that following the decision of the Sub-Committee at the meeting held on 4 November 1998 to refuse an application for the erection of 5 dwellinghouses in outline at Hydro House, West Glen Road, Kilmacolm (IC/98/169), and the subsequent appeal by the applicant to the Secretary of State against that refusal, the Reporter appointed by the Secretary of State had issued his decision which was to uphold the appeal and grant planning permission subject to conditions as detailed in the Appendix to the report. The report advised that the appellant’s claim for expenses against the Council had been dismissed by the Reporter.

Planning Officer advising that following the decision of the Sub-Committee at

(CA/99/15), notification had been received that the applicant had appealed to
the Secretary of State against that refusal.
