Present:- Councillors Calvert, Morrison (M), Roach, McGhee, Robertson (Y), Mulholland and Campbell, Councillor McGhee, Convener, in the Chair.
In attendance:- The Depute Chief Executive, Mr H McNeilly (for the Executive Director Legal, Information and Support Services), the Director of Central Services, Mr N McLaren (for the Chief Planning Officer) and Mr S Hartley (for the Director of Transportation and Roads).
With the exception of the decision marked “C” which is open for confirmation or otherwise, the following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

APPLICATIONS 384
SUBMITTED: Reports by the Chief Planning Officer on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-
(a) Erection
of Dwellinghouse (in outline):
Greenock Road, Wemyss Bay
(IC/99/2)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) This permission is granted under the provisions of the Town and Country Planning (General Development Procedure) (Scotland) Order 1992 on an outline application and the further approval of the Council or of the Secretary of State on appeal shall be required with respect to the undermentioned matters hereby reserved before any development is commenced:
(a) the siting, size, height, design and external appearance of the proposed development;
(b) details of the access arrangements;
(c) details of landscaping of the site;
(2) That in the case of the reserved matters specified above application for approval must be made before:-
(i) the expiration of 3 years from the date of grant of outline permission; or
(ii) the expiration of 6 months from the date on which an earlier application for such approval was refused; or
(iii) the expiration of 6 months from the date on which an appeal against such refusal was dismissed whichever is the latest:
Provided that only one such application may be made in the case after the expiration of the three year period mentioned in sub-paragraph (i) above; and
(3) That the development to which this permission relates must be begun not later than the expiration of 5 years from the date of this permission or within 2 years from the final approval of reserved matters, whichever is the later, conditions (1) - (3) being imposed to comply with Section 59 of the Town and Country Planning (Scotland) Act 1997.

DECIDED: That planning permission be granted.
(c) Change
of Use and Extension to Form Residential Care Home:
Alt-na-Craig, Lyle Road,
Greenock (IC/99/67)
The report recommended that planning permission be granted subject to a number of conditions.
Councillor Roach declared an interest in this matter and took no part in its consideration or
decision.
Councillor Mitchell was present
and with consent spoke on the matter.
Following discussion, Councillor Morrison moved that planning permission be granted subject to the conditions detailed in the report. As an amendment, Councillor Campbell moved that planning permission be refused as (1) the proposals are contrary to local plan policies DCc and DCo in respect of the proposed high density of development which would lead to over development of the site; (2) the proposed development would result in loss of amenity by way of lack of privacy and light and the generation of an unacceptable level of noise and disturbance in adjoining properties; and (3) vehicles entering and exiting the site would create a traffic hazard to the detriment of road safety. On a vote, 3 Members voted for the amendment and 3 for the motion. There being equality in voting, the Convener exercised his casting vote in favour of the motion which was declared carried.
Those Members who had voted in
favour of the amendment requested, in terms of the relevant Standing Order,
that the matter be referred to The Inverclyde Council for decision in terms of
the amendment.
C DECIDED: That planning permission be granted subject
to the following conditions:- C
(1) That notwithstanding the details shown in the application, samples of the materials to be used on all external surfaces shall be submitted to and approved in writing by the Chief Planning Officer prior to the commencement of development;
(2) That details of the measures to be adopted to protect the trees to be retained along the eastmost and westmost boundaries of the site and in the vicinity of the proposed car parking shall be submitted to and approved in writing by the Chief Planning Officer prior to the commencement of development and thereafter implemented and retained throughout the duration of construction works;
(3) That no trees, other than those identified for removal on plan no 1281/07 hereby approved shall be removed without the prior written approval of the Chief Planning Officer;
(4) That details of the windows shall be submitted to and approved in writing by the Chief Planning Officer prior to the commencement of development;
(5) That details of any external lighting shall be submitted to and approved in writing by the Chief Planning Officer prior to installation, conditions (1) - (5) being imposed in the interests of amenity; and
(6) That car parking at a ratio of one space per four residents shall be provided prior to residents occupying the premises, in the interests of road safety.

(d) 42 Octavia Terrace, Greenock (IC/99/44)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That a sample of the colour and texture of the render finish to the building be submitted to and approved in writing by the Chief Planning Officer prior to the commencement of development;
(2) That no tree, other than the tree shown to be felled on plan no 02A hereby approved, shall be removed without the prior written consent of the Chief Planning Officer;
(3) That the rear wall of the existing coach house shall be retained at the same height as the adjoining garden wall immediately to the south, conditions (1) - (3) being imposed in the interests of visual amenity; and
(4) That the residential care unit shall operate in conjunction with the residential care home at 42 Octavia Terrace and not as an independent facility, in the interests of residential amenity.
(e) Erection
of Dwellinghouse:
23 Eldon Street, Greenock
(IC/99/17)
The report recommended that
planning permission be refused for a number of reasons.
The Convener orally advised the Sub-Committee that the report had been withdrawn as the applicants had indicated that they wished to discuss the matter further with the Chief Planning Officer.
DECIDED: That the withdrawal of the report be noted.
(f) Erection
of 18 Flats:
11 Houston Street, Greenock
(IC/99/8)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That no development shall commence until samples of all external materials have been submitted to and approved by the Chief Planning Officer in writing, in the interests of visual amenity; and
(2) That none of the flats shall be occupied until the parking layout shown on the docquetted layout plan No 9642/11 has been completed, in the interests of road safety.
(g) Extension
of Coffee Shop onto Pavement:
118 Cathcart Street, Greenock
(IC/99/61)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That the premises shall not at any time be open to the public between 6.00 pm and 8.00 am, in the interests of residential amenity; and
(2) That all furniture and the planter shall be removed from the pavement area outwith the opening hours specified in condition (1), in the interests of public safety.

The report recommended that planning permission be refused for a number of reasons.
Councillors O’Rourke and Jackson were present and with consent spoke on the matter.
DECIDED: That planning permission be refused for the
following reasons:-
(1) As the proposal is to the detriment of the area by virtue of potential generation of noise and nuisance; and
(2) As the proposal would result in the generation of traffic and parking congestion to the detriment of road safety.
(i) Change
of Use of Metal Transfer Site to Waste Transfer Site:
40 Upper Cartsburn Street,
Greenock (IC/99/45)
The report recommended that planning permission be granted subject to a number of conditions.
Councillor Jackson was present and with consent spoke on the matter.
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That the approval for the waste transfer station is limited to 6 April 2000 at which date the use as a waste transfer station will be terminated and the site will be restored to its former condition and use within one month to the satisfaction of the Chief Planning Officer unless an application to continue the development authorised by this consent is submitted to and approved by the Planning Authority by 6 April 2000;
(2) That the hours of operation shall be restricted to 08.00 hours to 17.00 hours Mondays to Fridays and 08.00 hours to 12.30 hours on Saturdays, to ensure the effective management of the site works;
(3) That details of the proposed vehicle wheel
cleaning facilities shall be submitted to and agreed in writing by the Chief
Planning Officer prior to the approved use commencing;
(4) That the vehicle wheel cleaning facilities shall be installed prior to the approved use commencing and retained thereafter and be fully operational at all times during working hours. All vehicles exiting the site will be required to use the cleaning facilities, conditions (3) and (4) being imposed in the interests of road safety;
(5) That the materials to be sorted and transferred from the site shall not include toxic materials or domestic waste, to ensure the effective management of site works;
(6) That the boundary fencing shall be repaired and painted in a colour to be agreed with the Chief Planning Officer prior to the approved use commencing and maintained thereafter in a reasonable condition, in the interests of visual amenity; and
(7) That all foul and surface water drainage from
the site shall be connected to the Local Authority sewer, in the interests of
road safety.
(j) Erection
of New Clubhouse:
Whinhill Golf Club, Beith Road,
Greenock (IC/99/23)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That no development shall commence until details of passing bays for Beith Road have been submitted to and approved by the Chief Planning Officer, the passing bays to be constructed prior to the clubhouse being occupied; and
(2) That the clubhouse shall not be occupied until the parking layout shown on the approved layout plan has been completed, with the exception of the proposed bus parking area and turning circle, which must be completed within two months of the occupation of the new clubhouse, conditions (1) and (2) being imposed in the interests of road safety.
(k) Erection
of 8 Dwellinghouses:

DECIDED: That planning permission be granted subject
to the condition that any future development within the curtilage of the 8
houses shall be carried out in accordance with the approved design brief, in
the interests of visual amenity of the Quarriers Village outstanding
conservation area.
(l) Erection
of Conservatory:

The report recommended that planning permission be refused for a number of reasons.
DECIDED: That consideration of the application be continued to allow the applicant the opportunity to discuss the matter further with the Chief Planning Officer.
(m) Replacement
of Roof Light with Velux Window (in retrospect):

DECIDED: That planning permission be granted.

BUILDING APPLICATION 385
SUBMITTED: Report dated 22 March 1999 by the Chief Planning Officer on an application by Clydeport Operations for the demolition of Garvel House, James Watt Dock, Greenock (LB/97/5).
DECIDED: That it be remitted to the Chief Planning Officer to forward to the Secretary of State a recommendation that listed building consent be granted subject to the condition that the stonework facade on the front and rear elevations shall be carefully dismantled, labelled and stored in accordance with a method statement to be submitted to and approved by the Chief Planning Officer in writing prior to the commencement of work and shall subsequently be reused in future development, in order to secure the future use of the significant elements of the listed building.

APPEAL: ALT-NA-CRAIG, LYLE ROAD,

SUBMITTED: Report dated 29 March 1999 by the Executive Director Legal, Information and Support Services advising that following the decision of the Sub-Committee at the meeting held on 3 February 1999 to refuse an application for change of use and extension to form a residential care home at Alt-na-Craig, Lyle Road, Greenock (IC/98/326), notification had been received that the applicants had appealed to the Secretary of State against that refusal.

LOCAL INQUIRY: LEVAN FARM, GOUROCK 387
SUBMITTED: Report dated 29 March 1999 by the Executive Director Legal, Information and Support Services advising that following notification received from the Secretary of State that he was minded to grant the application by Westminster Investments Ltd for residential development in outline at Levan Farm, Gourock (IC/95/35) subject to the conclusion of an Agreement under Section 75 of the Town and Country Planning (Scotland) Act 1997 for the provision of a landscaped buffer zone between the development and the neighbouring enterprise zone site, the Agreement had been concluded and the Secretary of State had indicated that he was satisfied with the terms of the Agreement and had proceeded to issue outline planning consent subject to a number of conditions, as detailed in the Appendix to the report.
Mr McNeilly advised the Sub-Committee orally that paragraph 2.3 of the report should state that the Levan Farm site can now be regarded as forming part of the established housing land supply for the Inverclyde local market area.
