Present:- Councillors Calvert, Roach, McGhee, Robertson (Y) and Campbell, Councillor McGhee, Convener, in the Chair.
In attendance:- Mr C Clelland (for the Executive Director Legal, Information and Support Services), the Director of Central Services and Mr F Williamson (Chief Planning Officer).
Apologies for absence were intimated on behalf of Councillors Morrison (M) and Mulholland.
The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

APPLICATIONS 265
SUBMITTED: Reports by the Director of Planning on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-
(a) Erection
of 2 Dwellinghouses:
Cottage 32, Quarriers Village,
Bridge of Weir (IC/99/9)
DECIDED: That planning permission be refused for the following reasons:-
(1) As the development is contrary to Policy DCm of the Inverclyde Local Plan in that the proposals are of a design which would result in a development out of keeping with the general character of the conservation area and the buildings contained therein in terms of scale, detailing and materials;
(2) As the proposals constitute an overdevelopment of the site which would be out of character with the conservation area; and
(3) Due to the absence of off street parking the
development contravenes the Council’s approved car parking standards to the
detriment of safety and the established character of the Quarriers Village
conservation area.
(b) Erection
of 43 Sheltered Flats:
Port Glasgow Road/Woodrow
Avenue, Kilmacolm (IC/98/348)
The report recommended that, subject to the applicant entering into an Agreement under Section 75 of the Town and Country Planning (Scotland) Act 1997 to restrict principal occupancy of the flats to persons aged 60 or over, planning permission be granted subject to a number of conditions.
After discussion, Councillor McGhee moved that, subject to the applicant entering into an Agreement under Section 75 of the Town and Country Planning (Scotland) Act 1997, planning permission be granted subject to the conditions detailed in the report. As an amendment, Councillor Calvert moved that planning permission be refused as (1) the proposed design of the building would be out of character with adjacent properties; (2) the proposed density would result in overdevelopment of the site; and (3) the proposed building line of the development would not be in keeping with premises in the immediate vicinity. On a vote, 1 Member voted for the amendment and 4 for the motion which was declared carried.
265 DECIDED: That, subject to the applicant entering into
an Agreement under Section 75 of the 265
Town and Country Planning (Scotland) Act 1997 to restrict principal occupancy of the flats to persons aged 60 or over, planning permission be granted subject to the following conditions:-
(1) That no development shall commence until samples of all external materials have been submitted to and approved by the Director of Planning in writing, in the interests of visual amenity; and
(2) That none of the flats shall be occupied until the parking layout shown on site layout plan 08.856.PL10 has been completed, in the interests of road safety.
(c) Change
of Use of Open Space to Class 4 Business Use and Erection of Fencing and Gates:

DECIDED:
(a) That planning permission be granted: and
(b) That it be remitted to the Executive Director Legal, Information and Support Services to commence the Road Closure Order procedure in respect of Burnhead Road.
(d) Change

(e) Change

(f) Change

DECIDED: That planning permission be granted.
(g) Variation
of Planning Condition IC/91/355 Restricting Range of Goods to Allow Open
Class 1 Retail, Excluding Food:
Homebase Retail Unit, West Shaw
Street, Greenock (IC/99/19)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That the use of the unit shall be restricted to the sale of non food goods, to ensure the subjects are retained for non food retail warehousing purposes;
(2) That the premises shall only operate between the hours of 8.00 am and 8.00 pm and no vehicles servicing the premises will be permitted access or egress outwith these hours, in the interests of the amenity of nearby residents;
(3) That the existing garden centre shall be used solely for the display and sale of gardening goods in association with the existing retail unit. In the event of the unit being occupied by an operator not using the garden centre for this purpose, the garden centre shall be cleared and re-surfaced, the details of which shall be submitted to and approved by the Director of Planning prior to the new operator commencing trading or on cessation of the use as a garden centre, to ensure the subjects are retained for non food retail warehousing purposes; and
(4) That any sub-division of the retail unit shall require the express approval of the Director of Planning, in the interests of the amenity of nearby residents.
(h) Change
of Use of Retail Unit to Sunbed Salon and Launderette:
Unit 8, Ravenscraig

DECIDED: That planning permission be granted subject
to the condition that the premises shall not be open to the public outwith the
hours of 7.00 am to 9.00 pm daily, in the interest of residential amenity.
(i) Extension
to Church:
St Ninian’s Church, Royal Street, Gourock
(IC/99/24)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That no development shall commence until samples of all external materials have been submitted to and approved by the Director of Planning in writing, in the interest of visual amenity; and
(2) That no consent be granted for the vestibule bay window as proposed and that details of a revised window, which shall incorporate stained or obscure glass, shall be submitted to and approved by the Director of Planning in writing prior to the commencement of work on site, in the interests of the amenity of the adjacent property.

On the motion of the Convener it
was agreed unanimously that, in terms of Section 50(A)(4) of the Local
Government (Scotland) Act 1973 as amended, the public and press be excluded from
the meeting during consideration of the undernoted item of business on the
grounds that consideration of the item involved the likely disclosure of exempt
information as defined in paragraph 6 of Part I of Schedule 7(A)
of the Act.

There was submitted a report by the Director of Planning on the loss of heritable fixtures from Broadfield House, Port Glasgow and the Sub-Committee agreed to proceed, all as detailed in the Appendix.
