Present:- Councillors Roach, McGhee, Robertson (Y), Mulholland and Campbell, Councillor McGhee, Convener, in the Chair.
In attendance:- The Depute Chief Executive, Mr C Clelland (for the Executive Director Legal, Information & Support Services), the Director of Central Services and Mr F Williamson (for the Director of Planning).
Apologies for absence were intimated on behalf of Councillors Calvert and Morrison (M).
The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.
1288 PLANNING APPLICATIONS 1288
SUBMITTED: Reports by the Director of Planning on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-
(a) Erection of 26 Flats:
Castle Levan, Gourock (IC/98/256)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That no development shall commence until the conversion of the listed building approved under planning permission IC/98/22 and Listed Building Consent LB/98/2 have been completed to the satisfaction of the Director of Planning in writing, to ensure the proper completion of the listed building;
(2) That no development shall commence until samples of all external materials and details of the proposed bin stores have been submitted to and approved by the Director of Planning in writing;
(3) That no development shall commence until full details of tree protection measures have been submitted to and approved by the Director of Planning in writing and the tree protection measures have been implemented, conditions (2) and (3) being imposed in the interests of visual amenity;
(4) That none of the proposed flats shall be occupied until the approved parking layout shown on Drawing No 332/200B has been completed to the satisfaction of the Director of Planning in writing, in the interests of road safety; and
(5) That the approved scheme of landscaping shall be implemented within the first planting season following completion of the flats and any specimens that in the subsequent 5 years die, become diseased or are damaged shall be replaced in the next planting season unless the Director of Planning gives his prior written consent to any variation that may be sought, in the interests of visual amenity.

(b) 25 Finnart Road, Greenock (IC/98/327)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That details of the hard and soft landscaping be submitted and approved by the Director of Planning prior to the work commencing on site; and
(2) That notwithstanding the provisions of Article 3 and Parts 1 and 2 of Schedule 1 of the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 any developments specified in these Parts within the curtilage of the dwellinghouse will require planning permission, conditions (1) and (2) being imposed in the interests of visual amenity.
(c) Installation of Structural Supports to Gables (in retrospect):
8 & 14 South Street, Greenock (IC/96/403)
DECIDED: That planning permission be granted subject to the condition that the GRP mouldings on the front elevation of 8 South Street shall be replaced to the satisfaction of the Director of Planning within 6 months of the date of this consent, in the interests of visual amenity.
(d) Erection of 46 Dwellinghouses:
Irwin Street and Lansbury Street, Greenock (IC/98/313)
DECIDED: That, subject to the applicants lodging a Bond to be agreed by the Director of Planning in respect of the contribution to play facilities elsewhere in Gibshill, planning permission be granted subject to the following conditions:-
(1) That samples of all materials to be used on external surfaces be submitted to and approved in writing by the Director of Planning prior to the commencement of development, in the interests of visual amenity;
(2) That all surface water run-off shall be intercepted within the site;
(3) That the maximum gradient of the dwellinghouse driveways shall be 10%;
(4) That the accesses to the parking courts shall be via footway crossovers, conditions (2) - (4) being imposed in the interests of road safety; and
(5) That notwithstanding the details shown on the drawing titled "Site 1: Option A - 46 Units", the boundary treatments shall be carried out to the specification detailed on the approved drawing titled "externals and landscape layouts", in the interests of visual amenity.
(e) Erection of 71 Dwellinghouses:
Gibson Street, Bell Street and Cobham Street, Greenock (IC/98/312)
DECIDED: That, subject to the applicant lodging a Bond to be agreed by the Director of Planning in respect of the contribution to play facilities elsewhere in Gibshill and for the landscaping within the open spaces, planning permission be granted subject to the following conditions:-
(1) That samples of all materials to be used on external surfaces be submitted and approved in writing by the Director of Planning prior to the commencement of the development;
1288 (2) That prior to the commencement of development a landscaping scheme for the areas of 1288
open space shall be submitted to and approved in writing by the Director of Planning and thereafter implemented within the first planting season of the completion of the development. Any trees or plants which, within a period of 5 years from completion of the development, die,
are removed or become damaged or diseased, shall be replaced within the next planting season
unless the Director of Planning gives prior written consent to any variation which may be sought, conditions (1) and (2) being imposed in the interests of visual amenity;
(3) That all surface water run-off shall be intercepted within the site;
(4) That the maximum gradient of the dwellinghouse driveways shall be 10%, conditions (3) and (4) being imposed in the interests of road safety; and
(5) That notwithstanding the details shown on the drawing titled "Site 2: 71 units", the boundary treatments shall be carried out to the specification detailed on the approved drawing titled "externals and landscape layouts", in the interests of visual amenity.
(f) Change of Use to Hot Food Take-Away and Alterations to Form Pitched Roof:
54 Sinclair Street, Greenock (IC/98/304)
DECIDED: That planning permission be refused as the proposed use would have a detrimental impact on the established amenity of the location by virtue of the potential generation of noise, disturbance and nuisance.
(g) Change of Use of Byres to 2 Dwellinghouses and Formation of New Access:
Faulds Farm, Kilmacolm (IC/98/161)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That the access and car parking as detailed on plan No 97a hereby approved shall be implemented prior to the occupation of the dwellinghouses hereby approved to the satisfaction of the Director of Planning in consultation with the Director of Transportation and Roads;
(2) That the existing access shall be closed immediately following the opening of the new access, details of the means of closure being submitted to and approved in writing by the Director of Planning prior to the commencement of development;
(3) That notwithstanding the details shown on Plan No 97a, details of visibility splays to the east and west of the proposed access shall be submitted to and approved by the Director of Planning in writing. Thereafter any obstruction within the splays shall be lowered to a height not exceeding one metre above the adjacent road channel level prior to dwellinghouses being occupied and thereafter so maintained;
(4) That notwithstanding the details shown on Plan No 97a, full details of a turning area at the proposed access shall be submitted to and approved in writing by the Director of Planning prior to the commencement of development and thereafter implemented prior to the dwellinghouses being occupied, conditions (1) - (4) being imposed in the interests of road safety; and
(5) That a sample of the roof slate and external render to the proposed dwellings and a detailed specification of the doors and windows be submitted to and approved in writing by the Director of Planning prior to the commencement of development, in the interests of visual amenity.
(h) Erection of 10 Bed Residential Care Home (in outline):
Land Adjacent to Bridge of Weir Hospital, Quarrier's Village, Bridge of Weir (IC/98/296)
DECIDED:
(a) That planning permission be granted subject to the following conditions:-
(1) This permission is granted under the provisions of the Town and Country Planning (General Development Procedure) (Scotland) Order 1992 on an outline application and the
further approval of the Council or of the Secretary of State on appeal shall be required with
respect to the undermentioned matters hereby reserved before any development is commenced:
(a) the siting, size, height, design and external appearance of the proposed developments;
(b) details of the access arrangements which will include widening and upgrading of the access road to include 2 passing places and a 1.2 m wide footpath on the north side of the road;
(c) details of landscaping of the site;
(2) That in the case of the reserved matters specified above application for approval must be made before:-
(i) the expiration of 3 years from the date of grant of outline permission; or
(ii) the expiration of 6 months from the date on which an earlier application for such approval was refused; or
(iii) the expiration of 6 months from the date on which an appeal against such refusal was dismissed whichever is the latest:
Provided that only one such application may be made in the case after the expiration of the 3 year period mentioned in sub-paragraph (i) above; and
(3) That the development to which this permission relates must be begun not later than the expiration of 5 years from the date of this permission or within 2 years from the final approval of reserved matters, whichever is later, conditions (1) - (3) being imposed to comply with Section 59 of the Town and Country Planning (Scotland) Act 1997; and
(b) That the application for reserved matters be submitted to the Sub-Committee for determination.
1289 ADVERTISEMENT APPLICATION 1289
SUBMITTED: Report dated 18 November 1998 by the Director of Planning regarding an application for consent to display 2 illuminated advertisement hoardings at Newark Street, Port Glasgow (CA/98/44).
DECIDED: That advertisement consent be refused for the following reasons:-
(1) As the hoardings would distract drivers' attention when negotiating the Blackstone Roundabout to the severe detriment of road safety; and
(2) As the proposed hoardings would have a detrimental impact on the visual amenity of the location by virtue of their size and location.
1290 PLANNING APPEAL: EAST GLEN YARD, PORT GLASGOW 1290
SUBMITTED: Report dated 28 November 1998 by the Director of Planning advising that the appeal against the non-determination of the application for retail development at East Glen Yard, Port Glasgow (IC/97/13) by the Economic Development and Urban Regeneration
Committee at the meeting held on 10 April 1997, in respect of which a Public Local Inquiry was to be held, had been withdrawn.

1291 PLANNING APPEAL: EAST HAMILTON STREET, GREENOCK 1291
SUBMITTED: Report dated 28 October 1998 by the Director of Planning advising that following the service of a Notice under Section 179 of the Town and Country Planning (Scotland) Act 1997 requiring the removal of building rubble and enclosure of part of the
former Kvaerner Kincaid site at East Hamilton Street and the subsequent appeal by the
applicant to the Secretary of State against the service of the Notice, the Reporter appointed by the Secretary of State had issued his decision which is to dismiss the appeal but to amend the terms of the Notice.
DECIDED: That the outcome of the appeal be noted; that it be noted the appellants have been requested to contact Planning Services to discuss compliance with the steps specified by the Secretary of State; and that it be remitted to the Director of Planning to report on the progress made by the appellants in complying with the Enforcement Notice at the next meeting of the Sub-Committee.
1292 ADVERTISEMENT APPEAL: 14 KEMPOCK STREET, GOUROCK 1292
SUBMITTED: Report dated 17 November 1998 by the Director of Planning advising that following the decision of the Sub-Committee at the meeting held on 7 October 1998 to refuse an application for consent to display an internally illuminated display panel in retrospect at 14 Kempock Street, Gourock (CA/98/34), notification had been received that the applicant had appealed to the Secretary of State against that refusal.

1293 PUBLIC LOCAL INQUIRY: LEVAN FARM, GOUROCK 1293
SUBMITTED: Report dated 17 November 1998 by the Executive Director Legal, Information & Support Services advising that following the reconvened Public Local Inquiry into the application for planning permission by Westminster Investments Ltd for residential development in outline at Levan Farm, Gourock (IC/95/35), the Secretary of State had notified the Council that, subject to the conclusion of an Agreement under Section 75 of the Town and Country Planning (Scotland) Act 1997 in respect of (i) the provision of a landscaped buffer zone between the application site and the neighbouring enterprise zone site and (ii) the landscaping of the application site, he is minded to grant outline planning permission subject to a number of conditions, as detailed in the Appendix to the report.
DECIDED:
(a) That the terms of the report be noted; and
(b) That, in respect of the enforcement of condition 11, the Depute Chief Executive request the Secretary of State to clarify that the developer should provide such technical reports and studies as may reasonably be required by the Director of Planning to establish compliance.
1294 UNAUTHORISED SIGNAGE 1294
SUBMITTED: Report dated 17 November 1998 by the Director of Planning on the general powers available to the planning authority in respect of recurrent unauthorised erection or display of advertisement hoardings within Inverclyde.
DECIDED:
(a) That it be remitted to the Director of Planning to write to all signage companies active in Inverclyde to remind them of the powers available to the Council;
(b) That, in the event of further recurrence of unauthorised advertisement displays, the Executive Director Legal, Information & Support Services together with the Director of Planning raise interdict proceedings to restrain offenders from erecting further signage without recourse to the Council; and
(c) That where unauthorised signs are erected, poster agencies and advertisers be advised that the display is unauthorised.
