Present:- Councillors Calvert, Morrison (M), Roach, McGhee, Robertson (Y) and Campbell, Councillor McGhee, Convener, in the Chair.

 

In attendance:-  The Depute Chief Executive, the Director of Central Services, Mr C Clelland (for the Executive Director Legal, Information and Support Services) and Mr F Williamson (for the Director of Planning).

 

An apology for absence was intimated on behalf of Councillor Mulholland.

 

The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

 

   929      PLANNING APPLICATIONS                                                                                                               929

 

SUBMITTED:  Reports by the Director of Planning on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-

 

    (a)      Erection of Non-Food Retail Units, Car Showrooms, Fast Food Drive Thru' Restaurant and                           

Associated Car Parking and Services:


              Pottery Street/Port Glasgow Road, Greenock (IC/95/243)                                                                             

 

DECIDED:  That planning permission be refused as the applicant has failed to submit the Retail and Traffic Impact Studies necessary to enable this application to be fully assessed and determined.

 

    (b)      Demolition of Former Grain Mill, Erection of Retail Unit, Associated Car Parking, Etc:                                    

Dellingburn Street, Greenock (IC/97/289 & LB/97/10)

 

The report recommended, inter alia, that planning permission be granted subject to a number of conditions and copies of proposed amendments to several of the conditions were circulated.

DECIDED:

(a)  That the applications for planning permission and listed building consent be notified to the Secretary of State under the provisions of the Town and Country Planning (Notification of Applications) (Scotland) Direction 1997 and the Town and Country Planning (Listed Building and Conservation Area) Act 1997;

(b)  That subject to the Secretary of State declining to exercise his discretion to determine the applications for planning permission and listed building consent, authority be delegated to the Director of Planning to grant planning permission and listed building consent, the planning permission to be subject to the following conditions:-


   929      (1)  That samples of all materials to be used on external surfaces, including the finishes to the                      929

parking and circulation areas, shall be submitted to the Director of Planning and approved in writing prior to the commencement of development;

(2)  That all external stonework will be constructed using 6 mm joints and a sample of the mortar to be used shall be submitted to the Director of Planning and approved in writing prior to the commencement of development;

(3)  That all soft landscaping shall be carried out in the first planting and seeding season following the occupation of the development or the completion of the development, whichever is sooner;

(4)  That any trees or plants which, within a period of 5 years from completion of the development, die or are removed or become damaged or diseased, be replaced unless the Director of Planning gives prior written consent to any variation which may be sought, conditions (1) - (4) being imposed in the interests of visual amenity;

(5)  That the area marked "Area for Public Artwork" shaded on plan No SW/GR/01 Rev.D, a scheme providing for the erection of a piece of Artwork/Signage and associated landscaping, shall be submitted to and approved, in writing, by the Director of Planning and thereafter implemented no later than six months after the store has commenced trading, in the interests of townscape and visual amenity;

(6)  That a plaque shall be erected in the landscaping at the entrance of the site, the details and location of which shall be submitted to and approved, in writing, by the Director of Planning and thereafter erected no later than six months after the store has commenced trading.  The plaque shall be designed to reflect the historical importance of the site and the grain mill;

(7)  That the existing stone plaque depicting a wheelwright at work, inserted into the front wall of the premises at 5 Bogle Street, shall be carefully removed during demolition, set aside and stored, and thereafter incorporated into the development, the details of which shall be submitted to and approved in writing by the Director of Planning prior to the store commencing trade, conditions (6) and (7) being imposed in the interests of acknowledging the historical influence of the site;

(8)  That following the demolition of the existing buildings abutting the boundary walls of the railway station and ramp and removal of the disused steps leading from the station boundary down to Bogle Street and the consequent changes of levels in the event of any reinstatement works being required to be carried out to the walls and ramps as a direct result of the said demolition and removal, details of such works shall be submitted to and approved by the Director of Planning and thereafter implemented insofar as permitted by the proprietors of the walls and station as soon as practical thereafter, in the interests of visual amenity;

(9)  That no development shall take place within the application site until the developer has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation which has been submitted by the applicant, agreed by the West of Scotland Archaeological Service and approved in writing by the Director of Planning, to accord with the terms of PAN 42;

(10)  That trunk road infrastructure modifications to Dellingburn Street/A8 Rue End Street and Virginia Street/A8 Rue End Street, as indicated in DBA Drawing No. 7097/PL/03 Revision C, shall be provided to the satisfaction of the Director of Planning, in consultation with The Scottish Office National Roads Directorate (SONRD) as follows:-


   929      (a)  The widening of the Rue End Street westbound approach to the junction with Dellingburn                    929

Street to three lanes to enable the approach to operate with a dedicated left turn lane and two ahead lanes.

(b)  To widen the Dellingburn Street approach to three lanes to operate with one dedicated left turn lane and two right turn lanes.

(c)  Staggered pedestrian crossing facilities across Dellingburn Street.

(d)  A traffic signal installation at Virginia Street junction incorporating full pedestrian facilities.

(e)  Relocation of the existing bus lay-by and bus shelter on the westbound carriageway of Rue End Street maintaining a minimum of 2.0 metre footway.

(f)  Pedestrian guard railing;

(11)  That trunk road infrastructure modifications to the existing Brymner Street/A8 Rue End Street traffic signal controlled junction shall be provided to the satisfaction of the Director of Planning in consultation with the Scottish Office National Roads Directorate (SONRD) as follows:-

The introduction of a fourth traffic signal controlled stage incorporating a right turn indicative arrow and associated traffic signal control modifications;

(12)  That trunk road infrastructure modifications to link the existing Brymner Street/A8 Rue End Street and Cathcart Street/A8 Rue End Street traffic signalised junctions with the proposed Virginia Street/A8 Rue End Street and Dellingburn Street/A8 Rue End Street traffic signal controlled junctions shall be provided to the satisfaction of the Director of Planning, in consultation with SONRD;

(13)  That the road modifications indicated in conditions 10, 11 and 12 shall be provided by the applicant at his expense, and to the satisfaction of the Director of Planning, in consultation with SONRD;

(14)  That, excluding demolition and archaeological working, no development shall take place until details of construction of road modifications and footpaths have been submitted to and approved by the Director of Planning in consultation with SONRD;

(15)  That no part of the development shall become operational prior to the completion of the improvements indicated in conditions 10, 11 and 12 and in DBA Drawing No. 7097/PL/03 Revision C;

(16)  That the proposed modifications to the Trunk Road network shall be subject to, and amended as appropriate, to account for Road Safety Audits as per Volume 5 of the Design Manual for Roads and Bridges (DMRB), all at the expense of the applicant; and

(17)  That the applicant shall enter into a Minute of Agreement with SONRD as Trunk Roads Authority in relation to the provision and timescale of implementation of the infrastructure modifications as detailed above and in DBA Drawing No. 7097/PL/03 Revision C, this agreement being completed prior to any development commencing on site, conditions (10) - (17) being imposed to minimise interference with the safety and free flow of the traffic on the trunk road, to ensure that vehicles entering or exiting the access can undertake the manoeuvre safely and with minimum interference to the safety and free flow of traffic on the trunk road, to ensure that facilities are provided for the pedestrians that may access the proposed footpath system without interfering with the safety and free flow of traffic on the trunk road, to ensure that vehicles may park clear of the trunk road and to ensure that the development is provided with an adequate and safe access; and


   929      (c)  That, in the event of planning permission being granted, the Director of Legal Services be                     929

authorised to instigate the Road Closure Order relative to Chapel Street, Bogle Street and that part of Virginia Street, Greenock incorporated within the proposed development.

 

    (c)      Erection of Non-Food Retail Warehouse and Associated Car Parking:                                                           

              Waterfront Retail Park, Greenock (IC/98/214)                                                                                               

 

The report recommended that the amendments to the current application are not such that they merit a change to the previous refusal of planning consent for a number of reasons.

DECIDED:  That consideration of the application be continued to allow the Director of Planning to obtain further information from the applicant.

 

    (d)      Change of Use from Class 1 Shop to Class 2 Office:                                                                                      

              12 Clyde Square, Oak Mall Shopping Centre, Greenock (IC/98/224)                                                            

 

DECIDED:  That planning permission be granted.

 

    (e)      Change of Use from 2 Flats to 4 Maisonettes:                                                                                                 

              62 Union Street, Greenock (IC/98/225 & LB/98/16)                                                                                     

 

DECIDED:

(a)  That planning permission and listed building consent be granted subject to the condition that a detailed specification of the doors and windows be submitted to and approved by the Director of Planning prior to the commencement of development, in the interests of visual amenity; and

(b)  That it be noted that, under current legislation, planning consent may not be issued until clearance from Historic Scotland to issue listed building consent has been granted.

 

     (f)      Modification of Parking Layout (amendment to Planning Permission IC/98/108):                                             

              Glenpark House, 48 Forsyth Street, Greenock (IC/98/228)                                                                            

 

DECIDED:  That planning permission be granted subject to the following conditions:-

(1)  That details for the protection of the trees on the grass verge on Brisbane Street be submitted to and approved by the Director of Planning in writing prior to the commencement of development and thereafter implemented throughout the duration of the works on the site;

(2)  That the car parking spaces on the grass verge on Brisbane Street shall be surfaced in Grasscrete or equal vehicle loadbearing surface, details of which shall be submitted to and approved by the Director of Planning in writing prior to the commencement of development and thereafter implemented prior to the occupation of the flats, conditions (1) and (2) being imposed in the interests of visual amenity; and

(3)  That, for the avoidance of doubt, conditions 1 - 6 of planning permission IC/98/108 shall be adhered to, in the interests of visual amenity and road safety.

 


    (g)      Erection of 79 Dwellinghouses:                                                                                                                       

              Brueacre Road/Mountstuart Drive, Wemyss Bay (IC/98/156)                                                                        

 

The report recommended that planning permission be granted subject to conditions and that planning consent should not be issued until such time as the financial contribution towards the multi-sports facility and the landscape bond have been lodged with the Council.

DECIDED:  That consideration of the application be continued to allow the Director of Planning to have further discussions with the applicant relative to road safety issues and the proposed density of the development.

 

   930      PLANNING APPEAL:  1 OCTAVIA BUILDINGS, BRIDGE OF WEIR ROAD, KILMACOLM        930

 

SUBMITTED:  Report dated 18 August 1998 by the Director of Planning advising that following the decision of the Sub-Committee at the meeting held on 5 November 1997 to refuse an application for change of use of shop to wine bar at 1 Octavia Buildings, Bridge of Weir Road, Kilmacolm (IC/97/312), and the subsequent appeal by the applicant to the Secretary of State against that refusal, the Reporter appointed by the Secretary of State had issued his decision which is to dismiss the appeal and uphold the Sub-Committee's decision to refuse planning permission.
