Present:- Councillors Calvert, Morrison (M), McGhee, Robertson (Y), Mulholland and Campbell, Councillor McGhee, Convener, in the Chair.
In attendance:- The Assistant Chief Executive (Economic Development and Urban Regeneration), the Director of Central Services, Mr H McNeilly (for the Director of Legal Services), the Director of Planning and the Director of Transportation and Roads.
An apology for absence was intimated on behalf of Councillor Roach.
The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.
771 PLANNING APPLICATIONS 771
SUBMITTED: Reports by the Director of Planning on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-
(a) Formation
of Multi-Sport Area, Rubber Surfacing, Floodlighting and Seating Area:
Wemyss Bay Community Centre, Ardgowan Road, Wemyss Bay (IC/98/160)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That the floodlighting hereby approved must be angled onto the multi-sport area in such a manner that the beams do not extend beyond the boundaries of the multi-sport area to the satisfaction of the Director of Planning; and
(2) That the floodlighting shall not be in use after 22.00 hours, conditions (1) and (2) being imposed in the interests of residential amenity and road safety.
(b) Construction
of Golf Driving Range:
Finnockbog Road, Inverkip (IC/98/88)
The report recommended that planning permission be refused as the proposal is contrary to Policy ENc of the Inverclyde Local Plan which states "Development which will fragment farm units or create further pressures on farmland bordering on the built-up areas will be opposed" in that the proposal will result in the loss of agricultural land to the detriment of an established agricultural unit.
After discussion, Councillor McGhee moved that planning permission be refused for the reason detailed in the report. As an amendment, Councillor Mulholland moved that planning permission be granted subject to appropriate conditions. On a vote, 2 Members voted for the amendment and 4 for the motion which was declared carried.
DECIDED: That planning permission be refused as the proposal is contrary to Policy ENc of the Inverclyde Local Plan which states "Development which will fragment farm units or create

(c) Provision of Parking and Turning Area and Re-paving of Hardstanding:
5 Ashgrove Avenue, Gourock

DECIDED: That planning permission be refused as the construction of a hardstanding and vehicle turning area would encourage vehicular traffic on to the sub-standard Ashgrove Avenue to the severe detriment of road safety.
(d) Change of Use of Dwellinghouse and Alterations to Extend Hotel:
121/122 Albert Road, Gourock (IC/98/166 & LB/98/9)
DECIDED: That planning permission and listed building consent be granted.
(e) Alterations to Form Balcony/Roof Terrace and Handrail:
16 Rodney Road, Gourock (IC/98/140)
DECIDED: That planning permission be granted.
(f) Change of Use of Shop to Form Banking Outlet for Saving and Loans Co-operative: Unit 9, 14 Kilblain Street, Greenock (IC/98/154)
DECIDED: That planning permission be granted.
(g) Erection of 24 Flats and Associated Car Parking: Wellpark West Church, Regent Street/Bank Street, Greenock (IC/98/150)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That samples of all materials to be used on external surfaces shall be submitted to and approved by the Director of Planning in writing prior to the commencement of the development;
(2) That a scheme of hard and soft landscaping shall be submitted to and approved by the Director of Planning in writing prior to the commencement of the development;
(3) That the landscaping shall be carried out in the first planting and seeding season following completion of the development and any trees or shrubs which, within a period of five years from the completion of the development, die, are removed or become diseased, shall be replaced within the next planting and seeding season with another of similar size and species, unless the Director of Planning gives prior written consent to any variation, conditions (1), (2) and (3) being imposed in the interests of visual amenity; and
(4) That the car parking on the approved layout plan shall be implemented prior to the occupation of any of the flats, in the interests of traffic safety.
(h) Erection of Rear Extension and Installation of French Doors at Front of Property: 11 Bridgend Avenue, Port Glasgow (IC/98/173)
The report recommended that planning permission be granted subject to the condition that samples of the proposed facing brick and roofing tile on the rear extension be submitted to and approved by the Director of Planning in writing prior to the commencement of work on site, in the interest of visual amenity.
After discussion, Councillor McGhee moved that planning permission be granted subject to the condition detailed in the report. As an amendment, Councillor Morrison moved that planning permission be refused as the proposal would be detrimental to the visual amenity of the area. On a vote, 1 Member voted for the amendment and 5 for the motion which was declared carried.
DECIDED: That planning permission be granted subject to the condition that samples of the proposed facing brick and roofing tile on the rear extension be submitted to and approved by the Director of Planning in writing prior to the commencement of work on site, in the interest of visual amenity.
(i) Erection of Gates and Temporary Fencing:
Sandspoint, Glencairn Road, Kilmacolm (IC/98/194)
DECIDED: That planning permission be granted subject to the condition that the temporary fencing erected for the purpose of supporting hedging shall be removed by 5 August 2000, as the fencing is of a non-permanent nature and is purely to allow the hedge to become established.
(j) Erection of Agricultural Shed (amendment to planning permission IC/97/409):
Land Southwest of Gryfe Neuk Nursery, Kilmacolm (IC/98/210)
DECIDED: That planning permission be granted.
772 ADVERTISEMENT APPLICATION 772
SUBMITTED: Report dated 17 July 1998 by the Director of Planning regarding an application for consent to display a welcome sign above the entrance and four posterboards at Unit 4, Custom House Quay, Greenock (CA/98/30).
DECIDED: That advertisement consent be refused for the following reasons:-
(1) In the interests of visual amenity as the proposed signs will detract from the appearance of the building, the retail park and the Waterfront generally; and
(2) As, if approved, the proposed signs will set an undesirable precedent for other operators at the Waterfront which may lead to additional signage proposals, to the detriment of the visual amenity of the area.

SUBMITTED: Report dated 15 July 1998 by the Director of Planning advising that following the decision of the Sub-Committee at the meeting held on 7 January 1998 to refuse an application for the erection of a conservatory and balcony at 18 Carnoustie Avenue, Gourock (IC/97/370), notice had been received that the applicant had appealed to the Secretary of State against that refusal.

SUBMITTED: Report dated 17 July 1998 by the Director of Planning advising that following the decision of the Sub-Committee at the meeting held on 3 June 1998 to refuse planning permission for the erection of a non-food retail warehouse and formation of car parking at Unit 8, Custom House Way, Greenock (IC/98/79), notice had been received that the applicant had appealed to the Secretary of State against that refusal.

SUBMITTED: Report dated 15 July 1998 by the Director of Planning advising that following the decision of the Sub-Committee at the meeting held on 6 August 1997 to refuse an application for the erection of a garage workshop and MOT station at 2 MacDougall Street, Greenock (IC/97/134), and the subsequent appeal by the applicant to the Secretary of State against that refusal, the Reporter appointed by the Secretary of State had issued his decision which is to dismiss the appeal and uphold the Sub-Committee's decision to refuse planning permission.

SUBMITTED: Report dated 15 July 1998 by the Director of Planning advising that following the decision of the Sub-Committee at the meeting held on 6 May 1998 to refuse an application for the erection of 2 advertisement hoardings at Clarence Street/Laird Street, Greenock (CA/98/17), notice had been received that the applicant had appealed to the Secretary of State against that refusal.

777 CERTIFICATE OF LAWFUL USE APPEAL: UNITS 1 AND 2 ADMIRAL COURT, 777
KEMPOCK STREET, GOUROCK
SUBMITTED: Report dated 15 July 1998 by the Director of Planning advising that following refusal to issue a Certificate of Lawful Use under delegated powers for the use of a shop as a funeral parlour at Units 1 and 2 Admiral Court, Kempock Street, Gourock (CL/97/4), and the subsequent appeal by the applicant to the Secretary of State against that refusal, the Reporter appointed by the Secretary of State had issued his decision which is to uphold the appeal and that a certificate advising that planning permission for the use of the premises to conduct between 50 and 60 funerals a year of which approximately 15 would require a service at a funeral parlour is not required had been issued by the Scottish Office. A claim for costs by the appellant had been dismissed.
DECIDED:
(a) That the outcome of the appeals be noted; and
(b) That it be remitted to the Director of Planning to write to (i) the Secretary of State seeking a review of the appropriate legislation and (ii) the Convention of Scottish Local Authorities and all planning authorities seeking their support for such a review.
778 EAST INDIA BREAST: AREAS OF PRIVATE ROAD TO BE ADDED TO THE LIST OF 778
PUBLIC ROADS
SUBMITTED: Report dated 28 July 1998 by the Director of Transportation and Roads seeking approval to add parts of the private road at East India Breast to the List of Public Roads in accordance with Section 1(4) of the Roads (Scotland) Act 1984, together with letter of objection received following advertisement of the proposal.
DECIDED: That approval be given to the addition of the area of private road at East India Breast detailed in the plan appended to the report to the List of Public Roads in accordance with Section 1(4) of the Roads (Scotland) Act 1984.
