Present:- Councillors Calvert, McGhee, Robertson (Y), Mulholland and Rebecchi, Councillor McGhee, Convener, in the Chair.
Present also:- Provost Allan.
In attendance:- The Assistant Chief Executive (Economic Development and Urban Regeneration), the Director of Central Services, Mr C Clelland (for the Director of Legal Services) and the Director of Planning.
Apologies for absence were intimated on behalf of Councillors Roach and Campbell.
The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

SUBMITTED: Reports by the Director of Planning on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-
(a) Change of Use of Former Resource Centre to Hotel Incorporating Existing Adjacent
Restaurant/Bar:
Fitzgerald ATC, Custom House Place, Greenock (IC/98/122)
DECIDED: That planning permission be granted subject to the condition that details of the roof balustrade be submitted to and approved in writing by the Director of Planning and thereafter implemented prior to the roof garden terrace being opened for use by the public, in the interests of visual amenity.
(b) Erection of Non-Food Retail Warehouse and Formation of Car Parking:
Unit 8, Waterfront Retail
Park, Custom House Way, Greenock (IC/98/79)
The report recommended that planning permission be granted subject to a number of conditions.
DECIDED: That planning permission be refused for the following reasons:-
(1) As the proposed development will result in the loss of 45 prime car parking spaces, in the immediate vicinity of the existing retail units, to the detriment of their effective operation;
(2) As the proposed replacement car parking, by virtue of its location and design, is to the detriment of the effective operation of the retail park; and
(3) As the proposed retail unit, by virtue of its
location, will have a detrimental impact on the setting and urban design
context of the Waterfront Development.
(c) Change of Use and Alterations to form Nine Flats and Associated Car Parking:
48 Forsyth Street, Greenock (IC/98/108 & LB/98/6)
DECIDED:
(a) That, under the terms of the Planning (Listed Building and Conservation Area) (Scotland) Act 1997, the Secretary of State be notified of the Council's intention to grant listed building and planning permission and that, subject to the Secretary of State's clearance, listed building permission be granted subject to the following conditions:-
(1) That a detailed specification of the doors and windows be submitted to and approved by the Director of Planning prior to the commencement of development; and
(2) That a sample of wall infill shall be erected on site and approved by the Director of Planning and thereafter all infilling shall be carried out to the approved detail and standard; and
(b) That planning permission be granted subject to the following conditions:-
(1) That a detailed specification of the doors and windows be submitted to and approved by the Director of Planning prior to the commencement of development;
(2) That a sample of wall infill shall be erected on site and approved by the Director of Planning and thereafter all infilling shall be carried out to the approved detail and standard, conditions (1) and (2) being imposed in the interests of visual amenity;
(3) That all car parking, access and verge reinstatement on Brisbane Street, as detailed on plan no. 97/1803A hereby approved shall be carried out to the satisfaction and specification of the Director of Planning in consultation with the Director of Transportation and Roads prior to any dwelling being occupied; and
(4) That the car parking and any associated works within the courtyard adjacent to Glenpark House be implemented prior to any dwelling being occupied, conditions (3) and (4) being imposed in the interests of road safety.
(d) Change of Use of Shop to Public House:
58 Maple Road, Greenock (IC/98/132)
Councillor Rebecchi declared an interest in this matter and took no part in its consideration or decision.
DECIDED: That planning permission be refused for the following reasons:-
(1) In the interests of the amenity of the adjacent residential properties since the proposed use would generate an unacceptable level of noise and activity in close proximity to residential properties; and
(2) In the interests of road safety in that the proposed development will give rise to on street traffic congestion.

SUBMITTED: Report dated 11 May 1998 by the Director of Planning advising that, following the decision of the Planning and Traffic Management Sub-Committee at the meeting held on 5 November 1997 to refuse an application for change of use of shop to wine bar at 1 Octavia Buildings, Kilmacolm (IC/97/312), notice had been received that the applicant had appealed to the Secretary of State against that refusal.

SUBMITTED: Report dated 11 May 1998 by the Director of Planning advising that following the service of a notice under Section 179 of the Town and Country Planning (Scotland) Act 1997 requiring the removal of building rubble and enclosure of part of the former Kvaerner Kincaid site at East Hamilton Street, Greenock, notice had been received that the applicant had appealed to the Secretary of State against the service of the notice.
