Present:- Councillors Morrison (M), Roach, McGhee, Robertson (Y) and Campbell, Councillor McGhee, Convener, in the Chair.
In attendance:- The Assistant Chief Executive (Economic Development and Urban Regeneration), the Director of Central Services, Mr C Clelland (for the Director of Legal Services) and Mr F Williamson (for the Director of Planning).
An apology for absence was intimated on behalf of Councillor Calvert.
The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.
329 PLANNING APPLICATION SUBMITTED FOR CONTINUED CONSIDERATION 329
SUBMITTED: Report dated 11 March 1998 by the Director of Planning regarding an application by Mr S Wilson for extension to the boundary wall at 26 High Carnegie Road, Port Glasgow (IC/98/28), consideration of which had been continued from the meeting on 4 March 1998 for a site visit.
The report recommended that planning permission be granted.
After discussion, Councillor Morrison moved that planning permission be refused. As an amendment, Councillor McGhee moved that planning permission be granted. On a vote, 2 Members voted for the motion and 3 for the amendment which was declared carried.
DECIDED: That planning permission be granted.
330 PLANNING APPLICATIONS 330
SUBMITTED: Reports by the Director of Planning on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-
(a) Re-roofing of Dwellinghouse:
104 Finlaystone Road, Kilmacolm (IC/98/33)
The Convener orally advised the Sub-Committee that the applicant had intimated withdrawal of the application.
DECIDED: That the withdrawal of the application be noted.
(b) Erection of Dwellinghouse, Garage and Off-Street Storage of Buses (in outline):
Glasgow Road, Port Glasgow (IC/97/422)
The report recommended that planning permission be granted.
Councillor Clocherty was present and with consent spoke on the matter.
330 DECIDED: That planning permission be refused on the grounds that the proposal would be 330
detrimental to the amenity of neighbouring properties in that it would generate unacceptable levels of noise and disturbance.
(c) Erection of Fence:
47 Cardross Avenue, Port Glasgow (IC/98/67)
DECIDED: That planning permission be granted.
(d) Erection of Dwellinghouse:
19 Luss Avenue, Greenock (IC/97/450)
Councillor Robertson declared an interest in this matter and took no part in its consideration or decision.
There were circulated copies of a letter received from the objectors' solicitors withdrawing their objection to the application.
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That the first 2m of the driveway when measured from the heel of the kerb be paved to the satisfaction of the Director of Planning; and
(2) That all surface water run off be intercepted within the site to the satisfaction of the Director of Planning, conditions (1) and (2) being imposed in the interests of road safety.
(e) Erection of Dwellinghouse:
Aileymill Gardens, Inverkip Road, Greenock (IC/98/60)
DECIDED:
(a) That planning permission be granted subject to the following conditions:-
(1) That samples of all external materials be submitted to the Director of Planning and approved in writing prior to the commencement of development;
(2) That no trees, other than those shown on the tree survey plan hereby approved, shall be lopped, topped or felled without the prior written approval of the Director of Planning; and
(3) That all tree planting shall be carried out in the first planting season following completion of the development, conditions (1), (2) and (3) being imposed in the interests of visual amenity; and
(b) That it be noted the applicant had given an undertaking to carry out infilling of potholes along the stretch of unadopted road at Aileymill Gardens between Inverkip Road and the application site.
(f) Alterations and Change of Use to Form Hot Food Take-Away:
7 John Street, Gourock (IC/98/38)
DECIDED: That planning permission be refused as the proposed hot food take-away will give rise to levels of noise, disturbance, litter and odours, all of which will be to the detriment of nearby residential properties and, as such, the proposal is contrary to policy Sc of the Inverclyde Local Plan which states: "the establishment of hot food take-away shops will be strictly controlled. Careful consideration will be given to traffic, nuisance and amenity implications and as such planning applications will be dealt with on individual merit."

(g) 11 Cowal Crescent, Gourock (IC/98/13)
The report recommended that planning permission be granted.
DECIDED: That consideration of the application be continued for a site visit to be arranged by the Director of Central Services in consultation with the Convener.
(h) Alterations and Extension to School (Phase 2):
Inverkip Primary School, Station Road, Inverkip (NI/98/3)
DECIDED: That the application proposal be notified to the Secretary of State in accordance with the Town and Country Planning (Development by Planning Authorities) (Scotland) Regulations 1981.
(i) Erection of 15 Flats:
Station Avenue, Inverkip (IC/98/16)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That samples of external materials be submitted to the Director of Planning and approved in writing prior to the commencement of development, in the interests of visual amenity;
(2) That the temporary 900mm high fence detailed on plan number 2c, required for the protection of the trees at Commoncraig Place, shall be erected prior to the commencement of development and no other development shall take place until the Director of Planning has
given his written confirmation that this fence has been erected in accordance with the approved plans and to his satisfaction;
(3) That the temporary fence referred to in condition (2) above shall be erected, retained and maintained until all other construction works on site have been completed;
(4) That no branches from the trees in the Commoncraig Place Tree Preservation Order which overhang the application site shall be lopped without the prior written approval of the Director of Planning, conditions (2), (3) and (4) being imposed in the interests of amenity and to avoid unnecessary damage to trees within the adjoining Tree Preservation Order;
(5) That notwithstanding the landscaping details shown on plan number 2c a revised landscaping scheme shall be submitted to the Director of Planning and approved in writing prior to the commencement of development;
(6) That all landscaping within the site shall be implemented in the first planting and seeding season following occupation of the development or completion of the development, whichever is sooner, and that any plants, trees or shrubs which die, or are damaged or removed within 5 years shall be replaced within the next planting and seeding season to the satisfaction of the Director of Planning, conditions (5) and (6) being imposed in the interests of residential amenity;
(7) That no flat within the development shall be occupied until the parking layout shown on drawing number 2c has been implemented to the satisfaction of the Director of Planning; and
(8) That details of a revised footway crossover provision and access to the parking area for block number B3 shall be submitted to and approved by the Director of Planning in consultation with the Director of Transportation and Roads, conditions (7) and (8) being imposed in the interests of road safety.
(j) Erection of Dwellinghouse (in outline):
Seafield, Finnockbog Road, Inverkip (IC/98/36)
DECIDED: That planning permission be refused for the following reasons:-
(1) As the configuration of the proposed plot determines that a house, with garden ground of a shape and size commensurate with the established pattern of development in the vicinity, cannot be developed; and
(2) As the relationship of the site to the adjacent house at 'Seafield' and the adjacent trees deem that the plot may not be developed without adverse impact on residential amenity by way of overlooking and lack of daylight.
(k) Erection of Linked Balcony:
20/22 Toward Road, Wemyss Bay (IC/98/35)
DECIDED: That planning permission be granted.
(l) Erection of 4 Dwellinghouses:
Plots 3-6 Burns Drive, Castle Site, Wemyss Bay (IC/98/71)
DECIDED: That planning permission be granted subject to the condition that any future development carried out within the curtilages of the houses shall be carried out in accordance with the attached design brief, in the interest of visual amenity.
(m) Erection of Church Meeting Room:
Church of St Joseph and St Patrick, Forbes Place, Wemyss Bay (IC/97/299)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That the finished colour of the rendering to the walls of the meeting room and existing garage block shall match the existing presbytery building;
(2) That a sample of the roof material shall be submitted to and approved by the Director of Planning prior to the commencement of development;
(3) That details of the windows shall be submitted to and approved by the Director of Planning prior to the commencement of development, conditions (1), (2) and (3) being imposed in the interests of visual amenity; and
(4) That the hedge, which is located adjacent to the Trunk Road along the eastern boundary of the church ground will be reduced and maintained to a height of 1.0m above carriageway channel level to provide visibility splays, these splays being the triangles of ground bounded on two sides by the first 2.5m of the centreline of the access driveway (the set back dimension) and the nearside Trunk Road carriageway measuring 120m (the Y dimension) in both directions from the intersection of the access with the Trunk Road, in the interests of road safety.

SUBMITTED: Report dated 12 March 1998 by the Director of Planning regarding an application for consent to display a non-illuminated signboard at James Watt Dock, East Hamilton Street, Greenock (CA/97/75).
The report recommended that advertisement consent be refused for a number of reasons.
DECIDED: That consideration of the application be continued to allow investigation of other means of signage for the hotel.

SUBMITTED: Report dated 13 March 1998 by the Director of Planning advising that following the decision of the Sub-Committee at the meeting held on 6 August 1997 to refuse an application for the erection of a garage workshop and MOT station at 2 MacDougall Street, Greenock (IC/97/134), notice had been received that the applicant had appealed to the Secretary of State against that refusal.

SUBMITTED: Report dated 11 March 1998 by the Director of Planning advising that following refusal to issue a Certificate of Lawful Use or Development under delegated powers on the basis that planning permission is required for a funeral parlour at Units 1 & 2, Admiral Court, Kempock Street, Gourock, notice had been received that the applicant had appealed to the Secretary of State against that refusal.

SUBMITTED: Report dated 13 March 1998 by the Director of Planning advising that following the decision of the Sub-Committee at the meeting held on 3 September 1997 to refuse an application by the Allam Group Limited for consent to display 3 illuminated 48 sheet advertising hoardings at the Clydeside Bus Depot, Port Glasgow Road, Greenock (CA/97/53), and the subsequent appeal by the applicant to the Secretary of State against that refusal, the Reporter appointed by the Secretary of State had issued his decision which is to dismiss the appeal and uphold the Sub-Committee's decision to refuse advertisement consent.

SUBMITTED: Report dated 11 March 1998 by the Director of Planning advising that following the decision of the Sub-Committee at the meeting held on 1 October 1997 to refuse an application by Maiden Outdoor Advertising for the display of 2 illuminated advertisement hoardings at Cartsburn Street, Greenock (CA/97/41), and the subsequent appeal by the applicant to the Secretary of State against that refusal, the Reporter appointed by the Secretary of State had issued his decision which is to dismiss the appeal and uphold the Sub-Committee's decision to refuse advertisement consent.
