WEDNESDAY, 4 FEBRUARY 1998 - 3.00 pm
Present:- Councillors Morrison (M), McGhee, Robertson (Y) and Campbell, Councillor McGhee, Convener, in the Chair.
In attendance:- The Assistant Chief Executive (Economic Development and Urban Regeneration), the Director of Central Services, Mr C Clelland (for the Director of Legal Services) and the Director of Planning.
An apology for absence was intimated on behalf of Councillor Calvert.
The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Sub-Committee.

SUBMITTED: Reports by the Director of Planning on the following applications which were submitted, together with letters of objection and support where submitted, and dealt with as follows:-
(a) Change of Use of Vacant Ground to Form Beer Garden and Associated Alterations to Licensed
Premises:
29 King Street, Greenock (IC/97/425)
DECIDED: That planning permission be granted subject to the following conditions:-
(1) That a sample of the facing brick for the walls be submitted to the Director of Planning and approved in writing prior to the commencement of development, in the interests of visual amenity;
(2) That the beer garden will not be open to the public outwith the hours of 11 am and 8 pm on any day; and
(3) That no acoustic or amplified music/noise be played in the beer garden at any time, conditions (2) and (3) being imposed in the interests of residential amenity.
(b) Change of Use of Cellar to Waiting Area for Hot Food Take-Away:
Waterfront Bar, 12 East India Breast, Greenock (IC/97/408)
DECIDED: That planning permission be granted.
(c) Change of Use of Ground Floor Flat and Basement to 2 Flats:
45 Brougham Street, Greenock (IC/97/423)
DECIDED: That planning permission be granted.
(d) Installation of Replacement Windows:
Ardgowan Club, Ardgowan Square, Greenock (IC/97/302)
The report recommended that planning permission be refused for a number of reasons.
DECIDED: That consideration of the application be continued to allow the Director of Planning to have further discussions with the applicants.
(e) Extension to Rear of Dwellinghouse:
9 Octavia Terrace, Greenock (IC/97/421)
DECIDED: That planning permission be granted subject to the condition that the demolition of the garage and formation of additional garden ground shall take place before the completion of the new extension, in the interest of residential amenity.
(f) Installation of Replacement Windows:
1 Levanne Place, Gourock (IC/97/411)
The report recommended that planning permission be granted.
After discussion, Councillor Morrison moved that planning permission be refused as the proposal would be detrimental to the amenity of the block of flats. As an amendment, Councillor McGhee moved that planning permission be granted. On a vote, 2 Members voted for the amendment and 2 for the motion. There being equality in voting, the Convener exercised his casting vote in favour of the amendment which was declared carried.
DECIDED: That planning permission be granted.
131 PLANNING APPEAL: 75 WEST BLACKHALL STREET, GREENOCK 131
SUBMITTED: Report dated 23 January 1998 by the Director of Planning advising that following the decision of the Planning and Traffic Management Sub-Committee at the meeting held on 1 October 1997 to refuse an application for change of use from retail shop to restaurant, snack bar and hot food take-away and installation of new shop front at 75 West Blackhall Street, Greenock (IC/97/240), notice had been received that the applicant had appealed to the Secretary of State against that refusal.
