powers delegated to the Sub-Committee.

PLANNING APPLICATIONS 858
SUBMITTED: Reports by the Director of
Planning on the following applications which were submitted, together with
letters of objection and support where submitted, and dealt with as follows:
(a) Erection of Dwellinghouse (in outline) and Erection
of Agricultural Shed:
Land Southwest of Gryfe Neuk
Nursery. Kilmacolm (IC/97/188 & IC/97/196)
DECIDED:
(a) That, subject to the
applicant entering into an Agreement under Section 75 of the Town and Country
Planning (Scotland) Act 1997 to restrict the occupancy of the dwellinghouse to
only person(s) engaged in full time agricultural work and ensure that the
agricultural shed is constructed prior to the dwellinghouse, planning
permission be granted subject to the following conditions:
(1) This permission is granted
under the provisions of the Town and Country Planning (General Development
Procedure) (Scotland) Order 1992 on an outline application and the further approval
of the Council or of the Secretary of State on appeal shall be required with
respect to the undermentioned matters hereby reserved before any development is
commenced:
(a) the siting, size, height,
design and external appearance of the proposed development; (b) details of the
access arrangements;
(c) details of landscaping of
the site;
(2) That in the case of the
reserved matters specified above application for approval must be made before:
(i) the expiration of three
years from the date of outline permission; or
(ii) the expiration of six
months from the date on which an earlier application for such approval was
refused; or
(iii) the expiration of six
months from the date on which an appeal against such refusal was dismissed,
whichever is the latest:
Provided that only one such
application may be made in the case after the expiration of the three-year
period mentioned in sub-paragraph (i) above;
(3) That the development to
which this permission relates must be begun not later than the expiration of
five years from the date of this permission or within two years from the final

approval of reserved matters, whichever is later, conditions (1), (2) and (3) being
imposed to 858
comply with Section 59 of the Town and Country Planning
(Scotland) Act 1997; and
(4) That the design and siting
of the house shall comply with the guidance as specified in
Scottish Office Planning
Advice Note 36 “Siting and Design of New Housing in the
Countryside”, to comply with
Scottish Office Planning Guidance; and
(b) That planning permission
for the erection of an agricultural shed be granted.
(b) Erection of Telecommunications Mast and Ancillary
Development:
Dubbs Road/Auchenleck Road.

The report recommended that
planning permission be refused for a number of reasons.
The Convener orally referred
to a letter received from the applicant’s agents intimating
withdrawal of the application.
DECIDED: That the withdrawal of the
application be noted.
(c) Change of Use from Retail Shop to Hot Food Take-Away
and Erection of Flue:
7 King Street. Port Glasgow

DECIDED: That planning permission be
refused for the following reasons:
(1) As the proposal is contrary
to Policy Sb of the Inverclyde Local Plan which states: “Therewill be a general
presumption against the change of use of existing shop uses to other uses
especially to offices, laundrettes, amusement arcades, cafes and restaurants in
Greenock, Port Glasgow and Gourock town centres”;
(2) As the proposal does not
comply with the terms of Policy Sc of the Inverclyde Local Plan which states:
“The establishment of hot food take-away shops will be strictly controlled. Careful
consideration will be given to traffic, nuisance and amenity implications and
as such individual planning applications will be dealt with on individual
merit”; because the amenity of residential properties in the immediate vicinity
would be adversely affected.
(d) Erection of Raised Patio/Terrace:
59 Bawhirley Road. Greenock
(IC/97/142)
The report recommended that
planning permission be granted.
DECIDED: That consideration of the
application be continued for a site visit to be arranged by the Director of
Central Services in consultation with the Convener.
(e) Erection of Garage Workshop and MOT
Station:
2 Macdougall Street. Greenock (IC/97/134)
DECIDED: That planning permission be
refused for the following reasons:
(1) As the proposals represent
an over-development of the site by encroaching on existing car parking space
and requiring additional car parking space which cannot be met within the site;
and
(2) As the proposals are
contrary to Inverclyde Local Plan Policy DCd in that the criteria for parking,
servicing and circulation space cannot be met.

(g) Realignment of Road Junction to Form
improved Vehicle Display and On-Site Parking:

DECIDED:
(a) That the Directors of
Planning and Legal Services be authorised to commence the road closure
procedure in respect of Ker Street; and
(b) That planning permission
be granted subject to the following conditions:
(1) That the end-on parking
layout at West Blackhall Street shown on Drawing
No TD4549/01E shall be formed
prior to the new vehicle display area being brought into use, in the interests
of road safety;
(2) That the gable exposed by
the demolition of the monumental sculptors showroom shall be rendered in
accordance with Drawing No TD4549/03A and finished in a colour to be agreed by
the Director of Planning prior to the vehicle display area being brought into
use; and
(3) That the approved scheme
of landscaping as shown on Drawing No 5R330.1 Rev. B shall be implemented
within the first planting season of the new vehicle display area being brought
into use and any specimens that, in the subsequent five years, die, become
diseased or are damaged, shall be replaced in the next planting season with a
similar specimen unless the Director of Planning gives his prior written
consent to any variation that may be sought, conditions (2) and (3) being
imposed in the interests of visual amenity.

planning permission be refused for a number of reasons. The Convener orally
referred to a letter received from the applicants’ agents requesting that

ADVERTISEMENT APPLICATION 859
SUBMITTED: Report dated 1 July 1997 by
the Director of Planning regarding an application for consent to erect
skywheels and two flagpoles (in retrospect) at 42/44 East Hamilton Street,
Greenock (CAJ97/34).
The report recommended that
advertisement consent be refused as the flagpoles and skywheels had introduced
advertisement clutter to the severe detriment of the quality of visual amenity
at this prominent site on the A8 trunk road.
DECIDED: That advertisement consent
be granted.

PLANNiNG APPEAL: 15 TIREE AVENUE PORT GLASGOW 860
SUBMITTED: Report dated 3 July 1997 by
the Director of Planning advising that, following the decision of The
Inverclyde Council at the meeting held on 9 January 1997 to refuse an
application for the erection of a garage at 15 Tiree Avenue, Port Glasgow
(IC/96/197), and the subsequent appeal by the applicant to the Secretary of
State against that refusal, the Reporter appointed by the Secretary of State
had issued his decision which was to dismiss the appeal.
