The following paragraphs are submitted for
information only, having been dealt with under the powers delegated to the
Panel. |

|
It was agreed in terms of Section 50(A)(4)
of the Local Government (Scotland) Act 1973 as amended that the public and
press be excluded from the meeting during consideration of the following
items on the grounds that the business involved the likely disclosure of
exempt information as defined in Paragraph 6 of Part I of Schedule 7(A) of
the Act. |

Application for Taxi Driver’s
Licence: James Michael Devenny |

|
Councillor
Moran declared a non-financial interest by virtue of personal acquaintance
with the applicant and left the meeting. |
|
|
|
|
|
There was
submitted a report by the Head of Legal & Administration following an
observation by the Chief Constable and an adverse medical report from the
Council’s Medical Adviser. The Panel
heard Superintendent Stewart and Mr Devenny. |
|
|
Councillor
Nimmo moved to refuse the application.
As an amendment Councillor McCormick moved to grant the
application. On a vote 1 Member voted
for the amendment and 4 Members for the motion which was declared carried. |

Decided:
that the
application be refused. |

Request for Suspension of Taxi Driver’s
Licence: James Michael Devenny |

|
|
|
There was
submitted a report by the Head of Legal & Administration following
receipt of an adverse medical report by the Council’s Medical Adviser. The Panel heard Superintendent Stewart and
Mr Devenny. |

|
Councillor
Nimmo moved to suspend the licence immediately for the remainder of its term. As an amendment Councillor McCormick moved
not to suspend the licence. On a vote
1 Member voted for the amendment and 4 Members for the motion which was
declared carried. |
|
|
Decided: that the licence be suspended immediately for the
remainder of its term. |
|
|
|
|
|
Councillor Moran returned to the meeting
at this juncture. |

Bentley |

|
|
|
There was submitted a report by the Head
of Legal & Administration following the receipt of an objection by
Michael McGranaghan. The Panel heard
Ms Bentley. |

Decided: that the application be granted. |
