Application for Taxi Licence

Mr Robert Millar

There was submitted a report dated 7 November 2006 by the Head of Legal and Administration advising that Mr Millar had omitted to make timeous application for his licence to be renewed before it expired, but it had been dealt with using the procedure for the exercise of powers delegated to the Chief Executive for use between Committees, and it had been agreed to authorise the grant of a taxi licence to Mr Millar.

Application for Variation of Street Trader’s Licence

There was submitted a report dated 24 November 2006 by the Head of Legal and Administration advising that Mr An proposed to vary his existing licence to include the Christmas lights switch-on event at Kempock Place, Gourock on 29 November 2006 but did not submit his application in time for it to be considered within the usual timescale. Mr An’s application had been dealt with using the procedure for the exercise of powers delegated to the Chief Executive for use between Committees, and it had been agreed to authorise the grant of a temporary street trader’s licence to Mr An.

Provision of Taxi Ranks

Area in Vicinity of Newton Street, Greenock

There was submitted a report dated 13 December 2006 by the Head of Legal and Administration on the outcome of the statutory procedures on the proposal to designate a stance on the north side of Roxburgh Street, Greenock and the revocation of the existing designation of the stance at Inverkip Street, Greenock.

 

 

Decided:

 

 

(1)                                                                                                   that a new stance be designated at Roxburgh Street, Greenock for three cabs facing westwards extending 15 metres in length along the north side of Roxburgh Street commencing from a point 32.5 metres or thereby east of the extended south kerbline of Inverkip Street, Greenock; and

 

 

(2)                                                                                                   that the designation of the existing stance for four cabs at Inverkip Street, Greenock be revoked, the designation and revocation to take effect on a day or days to be determined by the Head of Legal and Administration in consultation with the Council as Roads Authority, the former being authorised to take all necessary actions in connection therewith.

Auchmead Road Car Park, Greenock

There was submitted a report dated 13 December 2006 by the Head of Legal and Administration seeking the Panel’s agreement to revoke the existing designation of the taxi stance at Auchmead Road Car Park, Greenock to facilitate the development of a new school for south-west Greenock.

 

 

Decided: that the appointment of the existing stance for ten cabs within the Auchmead Road Car Park, Greenock be revoked with effect from 7 January 2007.

Application for Late Hours Catering Licence

Ms Roslyn Ghareh, Three in One, 17 Kempock Street, Gourock

Councillor Tucker entered the meeting at the start of  this item of business.

 

 

There was submitted a report dated 30 November 2006 by the Head of Legal and Administration on an application for the renewal of a late hours catering licence with additional hours by Mrs Roslyn Ghareh to allow the operation of a takeaway facility at Three in One, 17 Kempock Street, Gourock. The Panel heard Mr Ghareh in support of the application and Mrs Margaret McQuilkin in support of her objection.

The meeting was then adjourned at 4pm for discussion and resumed at 4.10pm.

 

 

Decided: that the application for renewal be granted for the existing hours of operation and the application be refused in respect of the hours in excess of those existing hours.

Dog Fouling (Scotland) Act 2003

Request for Hearing  - Mr Michael Gavin

Councillors McCormick and Moran declared a non financial interest by virtue of personal acquaintance with the applicant and left the meeting.

 

There was submitted a report dated 1 November 2006 by the Head of Legal and Administration on a request for a hearing by Mr Michael Gavin on his receipt of a fixed penalty notice. The Panel heard Mr McNeilly, Solicitor, Mr J W Cushnaghan and Miss A M Black, the two officers responsible for the issue of the fixed penalty notice, and Mr Gavin who requested its withdrawal.

The meeting was then adjourned at 4.20pm for discussion and resumed at 4.30pm.

 

 

Decided: that the fixed penalty notice not be withdrawn.

 

 

 

 

 

Councillors McCormick and Moran returned to the meeting.

 

 

 

 

 

It was agreed in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973 as amended that the public and press be excluded from the meeting during consideration of the following items of business on the grounds that the business involved the likely disclosure of exempt information as defined in Paragraph 6 of Part I of Schedule 7(A) of the Act.

Application for Taxi Driver’s Licence

There was submitted a report dated 23 November 2006 by the Head of Legal and Administration on an application for a taxi driver’s licence by Mr Francis Quinn following an objection by the Chief Constable on the grounds that the applicant was not a fit and proper person to hold such a licence by virtue of his previous convictions. The Panel heard Inspector Crawford and Mr Quinn.

 

 

Decided: that the application be granted.

There was submitted a report dated 9 November 2006 by the Head of Legal and Administration on an application for a taxi driver’s licence by Mr Mark Scott Graves following an objection by the Chief Constable on the grounds that the applicant was not a fit and proper person to hold such a licence by virtue of his previous convictions. The Panel heard Inspector Crawford and Mr Graves.

 

 

Decided: that the application be refused.

Civic Government (Scotland) Act 1982

Conditions attaching to Street Trader’s Licences

There was submitted a report dated 13 December 2006 by the Head of Legal and Administration asking the Panel to consider whether the existing conditions attaching to  street trader’s licences should be revised to discourage the sale of hot and cold food by street traders in the vicinity of schools in order to encourage the take-up of school meals based on healthy menus.

 

 

Decided: that it be remitted to the Head of Legal and Administration to provide a further report on a proposed condition for consideration by the Panel.

Application for Taxi Driver’s Licence

Mr Joseph Sutherland

907

 

 

 

 

There was submitted a report dated 28 November 2006 by the Head of Legal and Administration on an application for a taxi driver’s licence by Mr Joseph Sutherland following an adverse medical report from the Council’s Medical Adviser. On 11 October 2006 the Panel had decided to continue the application in order to obtain more information regarding the criteria required. Further information having been acquired, the application had been dealt with using the procedure for the exercise of powers delegated to the Chief Executive for use between Committees and it had been agreed to grant the renewal of Mr Sutherland’s licence on its existing conditions.
