The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Panel.

 

 

It was agreed in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973 as amended that the public and press be excluded from the meeting during consideration of the following items of business on the grounds that the business involved the likely disclosure of exempt information as defined in Paragraph 6 of Part I of Schedule 7(A) of the Act.

Application for Taxi Driver’s Licence: Craig Nelson

There was submitted a report dated 7 August 2006 by the Solicitor to the Council on an application for a taxi driver’s licence by Mr Nelson following an objection by the Chief Constable on the grounds that the applicant was not a fit and proper person to hold such a licence by virtue of his previous conviction.

 

 

Decided:  that the application be refused.

Application for Taxi Driver’s Licence: James A Mitchell

There was submitted a report dated 22 August 2006 by the Solicitor to the Council on an application for a taxi driver’s licence by Mr Mitchell following an adverse medical report from the Council’s Medical Adviser.  On 9 August 2006 the Panel had decided to continue the application to allow for a further medical examination of Mr Mitchell by the Council’s Medical Adviser and to grant delegated powers to the Solicitor to the Council to determine the application in the event of a favourable medical report being received.  Mr Douglas advised that a favourable medical report had now been received and  it had been decided to grant a licence to Mr Mitchell.

Request for Suspension of Taxi Driver’s Licence: James A Mitchell

There was submitted a report dated 28 August 2006 by the Solicitor to the Council requesting the suspension of Mr Mitchell’s taxi driver’s licence following an adverse report by the Council’s Medical Adviser.   On 9 August 2006 the Panel had decided that the licence be suspended immediately for the period to the next meeting of the Panel pending the result of Mr Mitchell’s further medical examination by the Council’s Medical Adviser and to grant delegated powers to the Solicitor to the Council to withdraw the suspension in the event of a favourable report being received.   Mr Douglas advised that a favourable report had now been received and  it had been decided to lift the suspension on Mr Mitchell’s licence. Request for Suspension of Taxi Driver’s Licence: Robert J Collins

There was submitted a report dated 27 July 2006 by the Solicitor to the Council requesting the suspension of Mr Collins’ taxi driver’s licence following the disclosure by Mr Collins of his medical condition of epilepsy shortly after the granting of the licence.   There was circulated a written submission from Mr Collins in support of his retaining his licence.   The Panel heard Mr Douglas for the Solicitor to the Council.

 

 

Decided:  that the licence be suspended immediately.
