Review of Civic Government (Scotland) Act 1982

Final Report by COSLA/Scottish Executive Task Group

There was submitted a report by the Director of Corporate Services on the finalised report by the COSLA/Scottish Executive Task Group on proposals for reform and improvement to the Civic Government (Scotland) Act 1982 and advising the Panel of the terms of the report.

 

 

Decided: 

 

 

(1)      that the terms of the final report of the COSLA/Scottish Executive Task Group on the review of the Civic Government (Scotland) Act 1982 be noted;  and

 

 

(2)      that it be remitted to the Director of Corporate Services to report on the terms of a condition for Late Hours Catering Licences requiring the premises to be cleared of customers by a specified time.

Taxis and Private Hire Cars - Review of Conditions

There was submitted a report dated 26 January 2005 by the Director of Corporate Services requesting the Panel to revise, for the purposes of removing confusion and doubt when interpreted in conjunction with road traffic legislation and regulations, the conditions in the licences for taxi drivers, taxi operators and private hire car operators on the carrying of passengers in licensed vehicles.

 

 

Decided:  that the revised conditions as set out in the appendix to the report be incorporated within licences for which application is made for grant or renewal on or after a date to be determined by the Director of Corporate Services.

Application for Taxi Licence:  Robert McFarlane and Karen McFarlane

There was submitted a report dated 18 January 2005 by the Director of Corporate Services advising that Mr Robert McFarlane and Ms Karen McFarlane had omitted to make timeous application for the licence to be renewed before it expired and was dealt with using the procedure for the exercise of powers delegated to the Chief Executive for use between Committees and it was agreed to authorise the grant of a taxi licence to Mr and Ms McFarlane.

Application for Taxi Licence:   John Murdoch

It was noted that the applicant had requested that this application be continued to the next meeting of the Panel and this was agreed.

 

 

It was agreed in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973 as amended that the public and press be excluded from the meeting during consideration of the following items of business on the grounds that the business involved the likely disclosure of exempt information as defined in Paragraph 6 of Part I of Schedule 7(A) of the Act.

Application for Window Cleaner’s Licence:  Joseph Eardley

There was submitted a report dated 26 January 2005 by the Director of Corporate Services on an application for a Window Cleaner’s Licence by Joseph Eardley following representations by Strathclyde Police.

 

 

Decided:  that the application be refused.

Application for Taxi Driver’s Licence:  Mark Gunn

There was submitted a report dated 21 January 2005 by the Director of Corporate Services on an application for a Taxi Driver’s Licence by Mark Gunn following an objection by the Chief Constable that the applicant was not a fit and proper person to hold such a licence by virtue of his previous convictions.

 

 

Decided:  that the application be refused.

There was submitted a report dated 21 January 2005 by the Director of Corporate Services on an application for a Taxi Driver’s Licence by Mark Bryan following an objection by the Chief Constable that the applicant was not a fit and proper person to hold such a licence by virtue of his previous convictions.

 

 

Decided:  that the application be refused.
