Application for Temporary Public Entertainment Licence - Music Concert - Greenock Cricket Club

Councillor Snoddy declared a personal interest in this matter and left the meeting.  Councillor Nimmo took the Chair.

 

 

There was submitted a report dated 2 September 2004 by the Director of Corporate Services on an application for a Temporary Public Entertainment Licence by James Snoddy, Greenock Cricket Club, Glenpark, Brisbane Street, Greenock to allow a music concert to take place between the hours of 2 pm and 7 pm on Sunday, 19 September 2004 in the grounds of Greenock Cricket Club.  The report advised that the application had been dealt with by way of powers delegated to the Chief Executive to authorise the grant of the licence in view of the short timescale for the organisation of the event.

Application for Second Hand Dealer’s Licence - McDonald Motors, 1 Drumfrochar Road, Greenock

Councillor Snoddy entered the meeting and resumed the Chair.  Councillor Nimmo declared a personal interest in this item and left the meeting.

 

 

There was submitted a report dated 25 August 2004 by the Director of Corporate Services on an application for renewal of Second Hand Dealer’s Licence by James McDonald to allow him to trade in second hand vehicles at the premises at 1 Drumfrochar Road, Greenock.  The Panel heard Mr Bruce of Transportation & Roads Service and Mr McLaren of Planning Services with regard to the objections lodged by their respective Services.  The Panel also heard Mr Marshall and Mr McDonald in support of the application.

 

 

Decided:  that consideration of the item be continued to the Panel meeting in November to allow the planning application to be dealt with.

Application for Street Trader’s Licence - Peter Owens

Councillor Nimmo re-entered the meeting.

 

 

There was submitted a report dated 25 August 2004 by the Director of Legal & Support Services on an application for renewal of Street Trader’s Licence by Peter Owens to allow him to operate a snack van at Upper Nicolson Street, Greenock. The Panel heard Mr' Bruce of Transportation and Roads Service in support of his objection with regard to the location of the snack van and Mr Owens. 

 

 

Decided:  that the application be granted for the period of one year subject to the Council's standard conditions and a further condition that the van be situated adjacent to the existing one way sign ex adverso the gable end of 61 Nicolson Street, Greenock.

Application for Street Trader’s Licence - Sean Middleton

There was submitted a report dated 25 August 2004 on an application for  a Street Trader’s Licence by Sean Middleton to allow him to operate a snack van at Woodhall, Port Glasgow.  The Board considered a letter of objection from Mr Jardine with regard to the location of the snack van. 

 

 

It was noted that neither the applicant nor the objector appeared for the hearing.

 

 

Decided:  that the application be continued to the next meeting of the Panel unless the objection were to be withdrawn, allowing the application to be dealt with under delegated powers.

Review of Marches and Parades in Scotland

There was submitted a report dated 25 August 2004 by the Director of Corporate Services advising that the Council had been asked to submit its views to Sir John Orr carrying out a review for the Scottish Executive on the consultation process in respect of the review of marches and parades in Scotland. 

 

 

Decided:  that the following proposals be submitted to Sir John Orr:-

(a)      that the period of notice required for a proposed march or parade be a minimum of 4 weeks with power to be given to the Local Authority to shorten that period in appropriate circumstances;  and

(b)      that the grounds for refusal and amending routes of marches and parades be amended to include undue public nuisance or a threat to public order or public safety.

Application for Taxi Licence - James Easdale

There was submitted a report dated 16 August 2004 by the Director of Corporate Services advising of the use of the powers delegated to the Chief Executive between Committees to authorise the grant of a taxi licence to Mr Easdale who had omitted to make timeous application for the licence to be renewed before it expired.

There was submitted a report dated 16 August 2004 by the Director of Corporate Services advising of the use of the powers delegated to the Chief Executive between Committees to authorise the grant of a taxi licence to Mr McGlynn who had omitted to make timeous application for the licence to be renewed before it expired.

Licensing of Taxis and Private Hire Cars - Comprehensive and Third Party Insurance

There was submitted a report dated 27 August 2004 by the Director of Corporate Services advising cof (a) a previous reference in error to cover for fire and theft risks as part of third party insurance which had been agreed as the new requirement for insurance for taxis and private hire cars and (b) the use of the Chief Executive’s delegated powers between Committees to allow existing licenceholders to benefit from the change in Council policy at a date earlier than the next renewal of their licences.

 

 

Noted

 

 

It was agreed in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973 as amended that the public and press be excluded from the meeting for the following items on the grounds that the business involved the likely disclosure of exempt information as defined in Paragraph 6 of Part I of Schedule 7(A) of the Act.

Application for Taxi Driver’s Licence - Andrew Van Oostenrijk

There was submitted a report dated 23 August 2004 by the Director of Corporate Services on an application by Andrew Van Oostenrijk for a taxi driver’s licence following a representation by the Chief Constable.  The Panel heard Superintendent Stewart and Mr Oostenrijk.  Following discussion Councillor McKenzie moved that the application be refused.  As an amendment Councillor Moran moved that the application be granted.  On a vote 3 Members voted for the motion and 4 for the amendment which was declared carried.

 

 

Decided:  that the application be granted.

There was submitted a report dated 16 August 2004 by the Director of Corporate Services on an application by Mark McGuigan for a taxi driver’s licence following a representation by the Chief Constable.  The Panel heard Superintendent Stewart and Mr McGuigan.

 

 

Decided:  that the application be granted.

Councillor McCormick returned to the meeting.

 

 

Councillor Tucker left the meeting at this point. 

 

 

There was submitted a report dated 16 August 2004 by the Director of Corporate Services on an application by James Callander for a taxi driver’s licence following a representation by the Chief Constable.  The Panel heard Superintendent Stewart, Mr Callander and Mr McGhee.

 

 

Decided:  that the application be granted.

Application for Taxi Driver’s Licence - Robert McIntyre

There was submitted a report dated 16 August 2004 by the Director of Corporate Services on an application by Robert McIntyre for a taxi driver’s licence following an objection by the Chief Constable that the applicant was not a fit and proper person to hold such a licence by virtue of his previous convictions.  The Panel heard Superintendent Stewart, Mr Cairns, agent for the applicant and the applicant.  Following discussion, Councillor Nimmo moved that the application be granted.  As an amendment Councillor McCormick moved that the application be refused.  On a vote 2 Members voted for the amendment and 4 for the motion which was declared carried.%

 

 

Decided:  that the application be granted.

There was submitted a report dated 23 August 2004 by the Director of Corporate Services on an application for a taxi driver’s licence by Paul Wallace following an objection by the Chief Constable that the applicant was not a fit and proper person to hold such a licence by virtue of his previous convictions. The Panel heard Superintendent Stewart and Mr Wallace.  

 

 

Decided:  that the application be granted.
