The following paragraphs are
submitted for information only, having been dealt with under the powers
delegated to the Panel. |

It was agreed in terms of
Section 50(A)(4) of the Local Government (Scotland) Act 1973 as amended that
the public and press be excluded from the meeting during consideration of the
following items of business on the grounds that the business involved the
likely disclosure of exempt information as defined in paragraph 6 of Part I
of Schedule 7(A) of the Act. |

Application for Taxi Driver’s
Licence - Joseph Cush |

There was submitted a report dated 6 June 2003 by the Director of Legal & Support Services on an application for a Taxi Driver’s licence by Joseph Cush following representations made by the Council’s Medical Adviser that the applicant was not a fit and proper person to hold such a licence by virtue of his medical condition. |

The Panel heard Dr Sykes, the Council’s Medical Adviser, and Miss Stevenson on behalf of the applicant. |
|
|
Decided: that
consideration of the application be continued until the next scheduled
meeting of the Panel, anticipated to be Wednesday, 13 August 2003 at 3 pm. |

Request for Suspension of Taxi
Driver’s Licence - Joseph Cush |

There was submitted a report dated 6 June 2003 by the Director of Legal & Support Services asking the Panel to consider the suspension of the Taxi Driver’s licence held by Mr Joseph Cush following representations by the Council’s Medical Adviser that the applicant was not a fit and proper person to hold such a licence by virtue of his medical condition. The report noted that the licence had been suspended temporarily under delegated powers. |

The Panel heard the Council’s Medical Adviser, Dr Sykes, and Miss Stevenson on behalf of the applicant. |
|
|
Decided:
that the Taxi Driver’s licence held by Mr Joseph Cush be suspended
immediately until the next scheduled meeting of the Licensing &
Registration Panel, anticipated to be Wednesday, 13 August 2003 at 3 pm to
allow Mr Cush a further opportunity to submit evidence in support of his
application and that a further Hearing be held on that date. |

There was submitted a report dated 11 June 2003 by the Director of Legal & Support Services on an application for a Taxi Driver’s licence by Mr Anthony Pavia following representations from the Council’s Medical Adviser that the applicant was not a fit and proper person to hold such a licence by virtue of his medical condition. There was also circulated a letter dated 12 June 2003 from Mr Pavia in support of his application. |

The Panel heard the Council’s Medical Adviser, Dr Sykes, with further information on his representations. |
|
|
Decided:
that the application be refused. |
