Public Entertainment Licence: Greenock Arts
Guild, Campbell Street, Greenock |

There was submitted a report dated 7 November 2000 by the Director of Legal & Support Services on an application for a Public Entertainment Licence by Greenock Arts Guild in respect of premises at Campbell Street, Greenock to permit them to hold various forms of live entertainment between the hours of 9.00 am and 12.00 midnight daily. |

There was submitted a report dated 7 November 2000 by the Director of Legal & Support Services on an application for a Second Hand Dealer's Licence by Peter Mustard to permit him to trade in used cars at the premises at 3 Haig Street, Greenock. The report noted that an objection to the application had been received. |

There was submitted a report dated 7 November 2000 by the Director of Legal & Support Services on an application to renew a Late Hours Catering Licence by Mr Lau Fong Chan in respect of premises known as The Lucky House, 83/84 Shore Street, Gourock to allow the operation of a hot food takeaway between the hours of 11.00 pm and 12.00 midnight on Sundays to Thursdays and between 11.00 am and 1.00 am on Fridays and Saturdays. It was noted that an objection had been received to the renewal of this licence for its existing hours. |

Taxi Licence - James and Linda Callaghan |

There was submitted a report dated 19 October 2000 by the Director of Legal & Support Services on an application for a Taxi Licence by James and Linda Callaghan who had omitted to make timeous application for their licence to be renewed before its expiry on 30 September 2000. The report advised that Mr and Mrs Callaghan's licence was granted following the use of the emergency powers procedures under Standing Order 66(a). Noted |

Revocation of
Taxi Stance - Newton Street, Greenock:

There was submitted a report dated 20 November 2000 by the Director of Legal & Support Services setting out the results of the statutory procedure followed in respect of the proposal to designate a new taxi stance at 48 Inverkip Street and to revoke the existing stance at Newton Street, Greenock. The report noted that an objection had been lodged on behalf of the Lower Clyde Taxi Owners Association to the proposals. Mr Bagstad was present at the meeting and with the consent of the Chairman spoke in support of the Association's objection. Following discussion, Councillor Nimmo moved that the Council proceed with the proposal. As an amendment, Councillor Rebecchi moved that consideration be continued for a site visit. On a vote, 3 Members voted for the amendment and 3 for the motion. There being equality in voting, the Chairman exercised his casting vote in favour of the motion which was declared carried. |

Decided: that the Council proceed to designate a new stance for 4 taxis at 48 Inverkip Street and to revoke the existing stance at Newton Street, Greenock, the designation and revocation to take effect once the relevant Traffic Regulation Orders could be put into effect by the Council as Roads Authority and that authority be delegated to the Director of Legal & Support Services to take all necessary action in connection therewith. |

Taxi Services for
the Disabled |

There was submitted a report dated 20 November 2000 by the Director of Legal & Support Services, consideration of which was continued from the meeting held on 12 October 2000 to permit the Director of Legal & Support Services to ascertain from the Scottish Executive progress with regard to the implementation of the provisions of the Disability Discrimination Act with respect to taxis. |

Decided: that consideration of any new Council policy be continued to await the issue of the relevant Central Government consultation documents and guidelines regarding implementation of the Disability Discrimination Act through the Civic Government code. The meeting adjourned at 3.50 pm to be reconvened at 5.00 pm or at the conclusion of the meeting of The Inverclyde Council, whichever was the later. The meeting reconvened at 6.00 pm. Councillor Nimmo did not return for the reconvened meeting which continued in his absence. |

It was agreed in terms of Section 50(A)(4) of the Local Government
(Scotland) Act 1973 as amended, that the public and press be excluded from
the meeting during consideration of the following items of business on the
grounds that the business involved the likely disclosure of exempt
information as defined in paragraph 6 of Part I of Schedule 7(A) of
the Act. |

Request for Suspension of Taxi Driver's Licence - Arthur Taggart |

There was submitted a report dated 6 November 2000 by the Director of Legal & Support Services following a letter dated 4 August 2000 by the Chief Constable, Strathclyde Police submitting that consideration should be given to the suspension of the Taxi Driver's Licence held by Mr Arthur Taggart on the grounds that Mr Taggart was no longer a fit and proper person to hold such a licence. The licence had been suspended at the Panel's meeting on 22 September 2000. The Panel heard Superintendent Gordon and Mr Taggart. |

Decided: that the Taxi Driver's Licence held by Mr Arthur Taggart be suspended immediately until the meeting of the Licensing and Registration Panel to be held on 11 January 2001 to allow the licenceholder to be examined by the Council's Medical Adviser. |

There was submitted a report dated 1 November 2000 by the Director of Legal & Support Services on an application for a Taxi Driver's Licence by James McCleary following an objection by the Chief Constable that the applicant was not a fit and proper person to hold such a licence by virtue of his previous convictions. The Panel heard Superintendent Gordon and Mr McCleary. Decided: that the application be refused. |

The Panel heard Superintendent Gordon and Mr Williamson. Decided: that the application be granted. |

There was submitted a report dated 2 November 2000 by the Director of Legal & Support Services on an application for a Taxi Driver's Licence by William Smiley following an objection by the Chief Constable that the applicant was not a fit and proper person to hold such a licence by virtue of his previous convictions. The Panel heard Superintendent Gordon, Mr Gallagher (agent for the applicant) and Mr Smiley. Following discussion, Councillor Morrison (M) moved that the application be granted. As an amendment, Councillor Rebecchi moved that the application be refused. On a vote, 1³ Member voted for the amendment and 4 for the motion which was declared carried. Decided: that the application be granted. |
