In attendance:- Mr H McNeilly (for the Director of Legal and Support Services) and the Director of Central Services.
An apology for absence was intimated on behalf of Councillor McCormick.
The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Panel.
1149 APPLICATION FOR LATE HOURS CATERING LICENCE: 2 KILBLAIN STREET, 1149
GREENOCK
SUBMITTED: Report dated 12 November 1999 by the Director of Central Services on an application by Mehrdad Radmehr to allow the operation of a hot food takeaway between the hours of 11 pm and 12 midnight on Sundays to Thursdays and between 11 pm and 1.30 am on Fridays and Saturdays at the premises known as 2 Kilblain Street, Greenock.
The Panel considered a petition from Miss J Lynn, 52 Kilblain Court, Mr Drummond, one of the objectors, and heard a submission from Councillor McGhee as Ward Councillor. The Board heard Mr Stalker, agent for the applicant, in support of the application. Following discussion, Councillor Rebecchi moved that the application be granted on Fridays and Saturdays between 11 pm and 12 midnight for one year only. As an amendment, Councillor Morrison (D) moved that the application be granted as sought for a period of 6 months. On a vote, 2 Members voted for the amendment and 3 for the motion which was declared carried.
DECIDED: That the application be granted between the hours of 11 pm and 12 midnight on Fridays and Saturdays for the period of one year only.
1150 APPLICATION FOR TAXI LICENCE: JOHN G MOORE AND MARGARET STEWART 1150
SUBMITTED: Report dated 2 November 1999 by the Director of Legal and Support Services on an application for a Taxi Licence by John G Moore and Margaret Stewart. The report advised that Mr Moore and Ms Stewart had omitted to make timeous application for renewal of their Taxi Licence prior to its expiry and that, following consultation with the Chief Executive, Councillors McCormick, Rebecchi and Morrison (D), the Taxi Licence was granted under Standing Order 66(a).

On the motion of the Convener it was agreed unanimously that, in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973 as amended, the public and press be excluded
from the meeting during consideration of the undernoted items of business on the grounds that consideration of the items involved the likely disclosure of exempt information as defined in the respective paragraphs of Part I of Schedule 7(A) of the Act as are set out opposite each item:-

SUBMITTED: Report dated 8 November 1999 by the Director of Legal and Support Services on an application for a Private Hire Car Licence by Gary Power. It was noted that an objection had been received from Mr Robert Dyer of the Lower Clyde Taxi Owners Association.
It was agreed by the applicants (where present), Mr Hendry, agent for a number of the applicants, Mr Bagstad on behalf of the Association and the Director of Central Services who had prepared reports on the applications that the hearing and the decision on the application by Mr Power would be applied to all similar applications at the meeting. The Panel heard Mr Hendry, agent for the applicant, and Mr Bagstad on behalf of the Association and the Director of Central Services; after the hearing these parties withdrew to allow the Panel to consider its decision.
DECIDED:
(a) That the application should be granted and that authority be delegated to the Director of Central Services to finalise the grant of the licence following the bringing forward and approval of a suitable vehicle; and
(b) That, in support of the decision to grant a licence, authority be delegated to the Director of Central Services to grant a temporary licence until any appeal against the decision was determined.

(b) That, in support of the decision to grant a licence, authority be delegated to the Director of Central Services to grant a temporary licence until any appeal against the decision was determined.

SUBMITTED: Report dated 8 November 1999 by the Director of Legal and Support Services on an application for a Private Hire Car Licence by William L Smiley. It was noted that an objection had been received from Mr Robert Dyer of the Lower Clyde Taxi Owners Association. This application was the subject of an individual hearing at which, in addition to taking into account the arguments made already in the application by Mr Power, the Panel heard Mr Smiley.
DECIDED:
(a) That the application should be granted and that authority be delegated to the Director of Central Services to finalise the grant of the licence following the bringing forward and approval of a suitable vehicle; and
(b) That, in support of the decision to grant a licence, authority be delegated to the Director of Central Services to grant a temporary licence until any appeal against the decision was determined.

SUBMITTED: Report dated 8 November 1999 by the Director of Legal and Support Services on an application for a Private Hire Car Licence by Robert McLaughlin. It was noted that an objection had been received from Mr Robert Dyer of the Lower Clyde Taxi Owners Association. This application was the subject of an individual hearing at which, in addition to taking into account the arguments made already in the application by Mr Power, the Panel heard Mr McGilley for the applicant.

SUBMITTED: Report dated 11 November 1999 by the Director of Legal and Support Services on an application for a Street Trader's Licence by Daniel McConnell following an objection by the Chief Constable that the applicant is not a fit and proper person to hold such a licence by virtue of his previous conviction. The Panel heard Chief Superintendent O'Connell, Mr McConnell and his mother.
DECIDED: That the application be refused.

SUBMITTED: Report dated 3 November 1999 by the Director of Legal and Support Services on an application for a Taxi Driver's Licence by Brian Dobbin following an objection by the Chief Constable that the applicant is not a fit and proper person to hold such a licence by virtue of his previous convictions. The Panel heard Chief Superintendent O'Connell and Mr Dobbin.
DECIDED: That the application be granted.

SUBMITTED: Report dated 3 November 1999 by the Director of Legal and Support Services on an application for a Taxi Driver's Licence by Edward Toye following an objection by the Chief Constable that the applicant is not a fit and proper person to hold such a licence by virtue of his previous convictions.

The Panel heard Chief Superintendent O'Connell, Mr McMillan and his father.

The Panel heard Chief Superintendent O'Connell, Mr Hendry, agent for the applicant, and Mr Guiller. Following discussion, Councillor Morrison (D) moved that the application be granted. As an amendment, Councillor Rebecchi moved that the application be refused. On a vote, 2 Members voted for the amendment and 3 for the motion which was declared carried.
