In attendance:- Mr H McNeilly (for the Executive Director Legal, Information & Support Services) and the Director of Central Services.
An apology for absence was intimated on behalf of Councillor Mulholland.
The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Panel.
863 APPLICATION FOR LATE HOURS CATERING LICENCE: 863

REGENT STREET, GREENOCK
SUBMITTED: Report dated 18 August 1999 by the Executive Director Legal, Information & Support Services on an application for a Late Hours Catering Licence by Maqsood Shaffi to allow the operation of a hot food takeaway between the hours of 11.00 pm and 12.00 midnight on Sundays to Thursdays and between 11.00 pm and 1.00 am on Fridays and Saturdays at the premises known as 3 in 1, 29 Regent Street, Greenock.
The Panel considered a letter of objection from Mr & Mrs Williams, 33 Regent Street, Greenock and heard Mr Andrew Bradley, agent for the applicant, in support of the application and drew attention to the measures which the applicant was prepared to do to minimise noise emanating from and immediately around the premises, set out in a letter circulated to the Panel.
Following discussion, Councillor Morrison (D) moved that the application be granted subject to the undertaking given on behalf of the applicant. As an amendment, Councillor Rebecchi moved that the application be granted until 12.00 midnight daily subject to the undertaking given on behalf of the applicant. On a vote, 3 Members voted for the motion and 3 for the amendment and the Chairman, having given his casting vote, declared the motion carried.
DECIDED: That the application be granted between the hours of 11.00 pm and 12.00 midnight on Sundays to Thursdays and between 11.00 pm and 1.00 am on Fridays and Saturdays subject to the undertaking on behalf of the applicant taking steps to minimise all noise emanating from and immediately around the premises.
864 APPLICATION FOR RENEWAL OF CINEMA LICENCE: 864

CINEMA, CUSTOMHOUSE WAY, GREENOCK
SUBMITTED: Report dated 18 August 1999 by the Executive Director Legal, Information & Support Services on an application for renewal of Cinema Licence by Robert W Gilmour and Philip Pittman, trading as West Coast Cinemas, 41 John Street, Dunoon, for the use of the four-screen cinema complex known as The Waterfront, Customhouse Way, Greenock. The Panel considered Mr Gilmour’s request that condition 4(b) of the licence be amended which
states that an attendant must be present in the auditorium at all times when a film is being exhibited. The Panel heard Mr Gilmour in support of his application. Following discussion, Councillor McCormick moved that the application be granted subject to the existing conditions. As an amendment, Councillor Rebecchi moved that consideration of the application be continued for further information with regard to the conditions attached to cinema licences. On a vote, 3 Members voted for the motion and 3 for the amendment and the Chairman, having given his casting vote, declared the motion carried.
DECIDED: That the application be granted subject to the existing conditions.
865 TAXI FARES REVIEW 865
SUBMITTED: Report dated 18 August 1999 by the Executive Director Legal, Information & Support Services advising of the results of the informal consultation process in respect of the annual Taxi Fares Review where any revision of the existing fare scales would take effect in November. In addition to its views on an increase in fares and charges, the Lower Clyde Taxi Owners Association requested that Tariff 3 be used on 31 December 1999 only in view of the special circumstances of the Millennium.
DECIDED:
(a) The contents of the report be noted and the proposed fare scales be advertised as follows:-

Subsequent charge (each additional 188 yards or part thereof) 10p

(c) That, consequently, the request by the Lower Clyde Taxi Owners Association to use Tariff 3 on 31 December 1999 only due to the Millennium be refused.
866 APPLICATION FOR TAXI LICENCE: HENRY FULTON 866
SUBMITTED: Report dated 18 August 1999 by the Executive Director Legal, Information & Support Services on an application for a Taxi Licence by Henry Fulton. The report advised that Mr Fulton had omitted to make timeous application for renewal of his licence prior to its expiry on 31 July 1999.
DECIDED: That the application be granted.
867 RESOLUTION: EXCLUSION OF PUBLIC AND PRESS 867
On the motion of the Convener, it was agreed unanimously that, in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973 as amended, the public and press be excluded from the meeting during consideration of the undernoted items of business on the grounds that consideration of the items involved the likely disclosure of exempt information as defined in paragraph 6 of Part I of Schedule 7(A) of the Act.
868 APPLICATION FOR TAXI DRIVER’S LICENCE: HENRY WILLIAMSON 868
SUBMITTED: Report dated 17 August 1999 by the Executive Director Legal, Information & Support Services on an application for a Taxi Driver’s Licence by Henry Williamson following an objection by the Chief Constable that the applicant is not a fit and proper person to hold such a licence by virtue of his previous convictions. The Panel heard Chief Superintendent O’Connell, Miss McMillan, agent for the applicant, and the applicant.
DECIDED: That the application be refused.
869 APPLICATION FOR TAXI DRIVER'S LICENCE: ANDREW TAIT 869
SUBMITTED: Report dated 17 August 1999 by the
Executive Director Legal, Information & Support Services on an application
for a Taxi Driver's Licence by Andrew Tait following an objection by the Chief
Constable that the applicant is not a fit and proper person to hold such a
licence by virtue of his previous convictions.
The report also indicated that Mr Tait had failed to arrange for a
medical examination on behalf of the Council to ascertain his fitness to hold a
licence.
DECIDED: That the application be refused.
