LICENSING AND REGISTRATION PANEL

Present:- Councillors Calvert, Morrison (M), Mulholland, Nimmo and Rebecchi, Councillor Mulholland in the Chair.
In attendance:- Mr H McNeilly (for the Executive Director Legal, Information & Support Services) and the Director of Central Services.
Apologies for absence were intimated on behalf of Councillors Morrison (D) and McCormick.
In the absence of the Chair and Substitute Chair, it was agreed in terms of the relevant Standing Order that Councillor Mulholland should preside at the meeting.
The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Panel.
684 APPLICATION FOR LATE HOURS CATERING LICENCE: 684

LAGOON, 75 WEST BLACKHALL STREET, GREENOCK
SUBMITTED: Report dated 16 July 1999 by the Executive Director Legal, Information & Support Services on an application for a Late Hours Catering Licence by Angelo Varese to allow the operation of a hot food takeaway between the hours of 11.00 pm and 12.00 midnight daily at the premises at 75 West Blackhall Street, Greenock, consideration of which was continued from the previous meeting to allow a further report to be submitted on the outcome of the proposed further work to the ventilation system for the premises. The Panel heard Mr D Hall for the Chief Environmental Services Officer who advised that the filter had not been installed properly and would be further checked in two weeks. Ms McMillan spoke as agent for the applicant.
DECIDED: That the application be granted subject to an additional condition on terms detailed by the Director of Central Services requiring maintenance to be carried out on a fortnightly basis and that it be remitted to the Chief Environmental Services Officer to submit a report to a future meeting of the Panel on the outcome of his inspections.

SUBMITTED: Report dated 20 July 1999 by the Executive Director Legal, Information & Support Services on an application for a Taxi Licence by William and Jacqueline Diver. The report advised that Mr & Mrs Diver had omitted to make timeous application for renewal of their licence prior to its expiry.
DECIDED: That the application be granted.
686 RESOLUTION: EXCLUSION OF PUBLIC AND PRESS 686
On the motion of the Convener, it was agreed unanimously that, in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973 as amended, the public and press be excluded from the meeting during consideration of the undernoted items of business on the grounds that consideration of the items involved the likely disclosure of exempt information as defined in the respective paragraphs of Part I of Schedule 7(A) of the Act as are set opposite each item.

SUBMITTED: Report by the Executive Director Legal, Information & Support Services on an application for a Taxi Driver's Licence by Jonathan Forbes following an objection by the Chief Constable that the applicant is not a fit and proper person to hold such a licence by virtue of his previous convictions. The Panel heard Chief Superintendent O'Connell and Mr Alexander Forbes, the applicant’s father. After discussion, Councillor Morrison (M) moved that the application be granted. As an amendment, Councillor Rebecchi moved that the application be refused. On a vote, 1 Member voted for the amendment and 4 for the motion which was declared carried.
DECIDED: That the application be granted.

SUBMITTED: Report dated 7 July 1999 by the Executive Director Legal, Information & Support Services on an application for a Taxi Driver's Licence by William Kelly following an objection by the Chief Constable that the applicant is not a fit and proper person to hold such a licence by virtue of his previous convictions. The Panel heard Chief Superintendent O'Connell and Mr Kelly. After discussion, Councillor Rebecchi moved that the application be refused. As an amendment, Councillor Mulholland moved that the application be granted. On a vote, 2 Members voted for the amendment and 3 for the motion which was declared carried.
DECIDED: That the application be refused.
