LICENSING AND REGISTRATION PANEL

 

THURSDAY 3 JUNE 1999 - 3.00 pm

 

Present:-  Councillors Morrison (D), Morrison (M), Mulholland, McCormick, Nimmo and Rebecchi, Councillor Morrison (D), Convener, in the Chair.

 

In attendance:-  Mr H McNeilly (for the Executive Director Legal, Information & Support Services) and the Director of Central Services.

 

An apology for absence was intimated on behalf of Councillor Calvert.

 

The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Panel.

 

   514      APPLICATION FOR LATE HOURS CATERING LICENCE:                                                              514

BLUE LAGOON, 75 WEST BLACKHALL STREET, GREENOCK

 

SUBMITTED:  Report dated 24 May 1999 by the Executive Director Legal, Information & Support Services on an application for a Late Hours Catering Licence by Angelo Varese to allow the operation of a hot food takeaway between the hours of 11.00 pm and 12.00 midnight daily at the premises at 75 West Blackhall Street, Greenock.  A letter of objection to the application from Margaret Stewart was considered by the Panel, together with a representation from the Chief Environmental Services Officer.  The Panel heard Ms McConnachie, agent for the applicant, and Mr S McKenzie for the Chief Environmental Services Officer.  After discussion, Councillor Mulholland moved that the application be granted.  As an amendment, Councillor Morrison (D) moved that the application be continued to the next meeting of the Panel to allow proposed further work to the ventilation system to be carried out before determining the application for the premises.  On a vote, 2 Members voted for the motion and 4 for the amendment which was declared carried.

DECIDED:  That consideration of the application be continued until the next meeting of the Panel to allow a further report to be submitted on the outcome of the proposed further work to the ventilation system for the premises.

 

   515      APPLICATION FOR TAXI LICENCE:                                                                                                  515

JOSEPHINE HURRELL

 

SUBMITTED:  Report by the Executive Director Legal, Information & Support Services on an application for a Taxi Licence by Josephine Hurrell.  The report advised that Ms Hurrell had omitted to make timeous application for renewal of her licence prior to its expiry and advised that authority had been received using the procedure under Standing Order 66(a) to grant Ms Hurrell a Taxi Licence.

MR RICHARD HARRISON AND MRS ROSALINE HARRISON

 

SUBMITTED:  Report by the Executive Director Legal, Information & Support Services on an application for a Taxi Licence by Richard Harrison and Rosaline Harrison.  The report advised that Mr & Mrs Harrison had omitted to make timeous application for renewal of their taxi licence prior to its expiry and advised that authority had been received using the procedure under Standing Order 66(a) to grant Mr & Mrs Harrison a Taxi Licence.

   517      RESOLUTION:  EXCLUSION OF PUBLIC AND PRESS                                                                    517

 

On the motion of the Convener, it was agreed unanimously that, in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973 as amended, the public and press be excluded from the meeting during consideration of the undernoted items of business on the grounds that consideration of the items involved the likely disclosure of exempt information as defined in paragraph 6 of Part I of Schedule 7(A) of the Act.

 

   518      CUTTY SARK TALL SHIPS RACE 1999:  STREET TRADER'S LICENCES                                      518

 

SUBMITTED:  Report dated 25 May 1999 by the Executive Director Legal, Information & Support Services requesting the Panel to consider modifying its policy to allow individuals who would be trading within the Tall Ships Event area in normal circumstances the opportunity to continue trading during the Tall Ships Event period.

DECIDED:  That Mrs Angela Rodgers and Mr Charles Scholte be permitted to continue to trade within the Tall Ships Event area during the period 23 July to 9 August 1999 inclusive.

 

   519      APPLICATION FOR TAXI DRIVER'S LICENCE:                                                                                519

WILLIAM McNEE

 

SUBMITTED:  Report dated 5 May 1999 by the Executive Director Legal, Information & Support Services on an application for a Taxi Driver's Licence by William McNee following an objection by the Chief Constable that the applicant is not a fit and proper person to hold such a licence by virtue of his previous convictions.  The Panel heard Chief Superintendent O'Connell and Mr McNee.

DECIDED:  That the application be refused.

 

   520      APPLICATION FOR TAXI DRIVER'S LICENCE:                                                                                520

DEREK THOMPSON

 

SUBMITTED:  Report dated 25 May 1999 by the Executive Director Legal, Information & Support Services on an application for a Taxi Driver's Licence by Derek Thompson following an objection by the Chief Constable that the applicant is not a fit and proper person to hold such a licence by virtue of his previous

convictions, including his spent convictions.  The Panel heard Chief Superintendent O'Connell and Mr Thompson.

DECIDED:  That the application be refused.


   521      APPLICATION FOR TAXI DRIVER'S LICENCE:                                                                                521

WILLIAM TAYLOR

 

SUBMITTED:  Report dated 27 May 1999 by the Executive Director Legal, Information & Support Services on an application for a Taxi Driver's Licence by William Taylor advising of Mr Taylor's medical condition and comments made by the Council's Medical Adviser.

DECIDED:  That the application be granted and that Mr Taylor undergo a three-yearly medical examination as an exception to the Council's policy of applying Group 2 standards.
