Present:-  Councillors Calvert, Morrison (D), Clocherty, Roach, Nimmo and Rebecchi, Councillor Morrison (D), Convener, in the Chair.

 

In attendance:-  The Director of Central Services.

 

An apology for absence was intimated on behalf of Councillor Sir Simpson Stevenson.

 

The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Panel.

 

   404      APPLICATION FOR LATE HOURS CATERING LICENCE:                                                              404

WEMYSS BAY HOLIDAY PARK

 

SUBMITTED:  Report dated 26 March 1999 by the Executive Director Legal, Information & Support Services on an application for a Late Hours Catering Licence by Jason Black to allow the operation of a hot food takeaway between the hours of 11.00 pm and 2.00 am daily.  It was noted that a Police representation had been received requesting that the hours of operation be restricted between 11.00 pm and 1.00 am.  At the meeting Chief Superintendent O'Connell intimated that the Police would accept the hours of 11.00 pm to 12.30 am on Sundays to Thursdays and 11.00 pm to 1.30 am on Fridays and Saturdays, the hours held by the previous licenceholder.

After consideration, Councillor Morrison moved that the application be granted between 11.00 pm and 12.30 am on Sundays to Thursdays and between 11.00 pm and 1.30 am on Fridays and Saturdays.  As an amendment, Councillor Roach moved that the application be granted between 11.00 pm and 1.00 am on Sundays to Thursdays and between 11.00 pm and 1.30 am on Fridays and Saturdays.  On a vote, 2 Members voted for the amendment and 4 for the motion which was declared carried.

DECIDED:  That the application be granted between 11.00 pm and 12.30 am on Sundays to Thursdays and between 11.00 pm and 1.30 am on Fridays and Saturdays.

 

   405      APPLICATION FOR PERMIT FOR AMUSEMENT WITH PRIZES MACHINES -                            405

BABYLON, 14/16 WEST STEWART STREET, GREENOCK

 

SUBMITTED:  Report dated 29 March 1999 by the Executive Director Legal, Information & Support Services on an application from Topcushion Ltd for permission to install two amusement with prizes machines at their premises known as Babylon, 14/16 West Stewart Street, Greenock.

DECIDED:  That the application be granted.

On the motion of the Chairman it was agreed unanimously that, in terms of Section 50(A)(4) of the Local Government (Scotland)


 

Act 1973 as amended, the public and press be excluded from the meeting during consideration of the undernoted items of business on the grounds that consideration of the items involved the likely disclosure of exempt information as defined in the respective paragraphs of Part I of Schedule 7(A) of the Act as are set opposite each item:-

   407      SAFETY OF SPORTS GROUNDS ACT 1975:  CAPPIELOW PARK, GREENOCK                          407

 

There was submitted a report by the Executive Director Legal, Information & Support Services advising of the current position relating to Cappielow Park following the annual inspection.  The Panel heard Mr Scott representing Morton Football Club and agreed to note the terms of the report and the terms of the submissions made by Mr Scott and to proceed in the manner detailed in the Appendix.

 

   408      APPLICATION FOR TAXI DRIVER'S LICENCE:  WILLIAM QUIGG                                               408

 

SUBMITTED:  Report dated 1 April 1999 by the Executive Director Legal, Information & Support Services on an application by William Quigg and advising of Mr Quigg's medical condition and comments made by Dr Sykes, the Council's medical adviser.

DECIDED:  That the application be granted on the conditions applying to Mr Quigg's previous licence.

 

   409      APPLICATION FOR TAXI DRIVER'S LICENCE:  JOHN KANE                                                       409

 

SUBMITTED:  Report dated 24 March 1999 by the Executive Director Legal, Information & Support Services on an application for a Taxi Driver's Licence by John Kane following an objection by the Chief Constable that the applicant is not a fit and proper person to hold such a licence by virtue of his previous convictions.  The Panel also considered Mr Kane's spent convictions.

DECIDED:  That the application be refused.

 

   410      APPLICATION FOR TAXI DRIVER'S LICENCE:  WILLIAM McPHERSON                                    410

 

SUBMITTED:  Report dated 25 March 1999 by the Executive Director Legal, Information & Support Services on an application for a Taxi Driver's Licence by William McPherson following an objection by the Chief Constable that the applicant is not a fit and proper person to hold such a licence by virtue of his previous convictions.  The Panel also considered Mr McPherson's spent convictions.  The Panel heard Chief Superintendent O'Connell and Mr McPherson.  Following discussion, Councillor Roach moved that the application be refused.  As an amendment, Councillor Clocherty moved that the application be granted.  On a vote, 2 Members voted for

amendment and 4 for the motion which was declared carried.

DECIDED:  That the application be refused.

SUBMITTED:  Report dated 25 March 1999 by the Executive Director Legal, Information & Support Services on an application for a Taxi Driver's Licence by John Boyd following an objection by the Chief Constable that the applicant is not a fit and proper person to hold such a licence by virtue of his previous convictions.
